By downloading, installing, accessing, or using HYPERVOX (hereinafter referred to as "the Game"), you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this End User License Agreement ("EULA"). If you do not agree to these terms, do not download, install, or use the Game.


Stagnant Water Games (hereinafter referred to as "we," "us," or "the Team") grants you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the Game for your personal, non-commercial purposes only, subject to the terms of this EULA. The Game is provided free of charge, and this license does not constitute a sale of the Game or any portion thereof.


You agree NOT to:

• (a) Sell, rent, lease, license, distribute, or otherwise commercially exploit the Game or any portion thereof;
  
• (b) Modify, adapt, translate, reverse engineer, decompile, or disassemble the Game, except as permitted by applicable law;
  
• (c) Remove, alter, or obscure any proprietary notices, labels, or marks on the Game;
  
• (d) Use the Game for any unlawful purpose or in violation of any applicable laws or regulations.

IMPORTANT: The Game includes a track creation feature that allows users to create custom content. By using this feature, you acknowledge and agree to the following:

• (a) You shall only use audio files, images, and other resources that you legally own or possess, or for which you have obtained proper authorization, permission, or license from the rightful copyright holder(s);
  
• (b) You are solely and entirely responsible for ensuring that any content you use, create, or distribute through the Game does not infringe upon the intellectual property rights, copyrights, trademarks, or any other rights of any third party;
  
• (c) The Team does not intend, encourage, or condone any form of copyright infringement. Any unauthorized use of copyrighted materials is strictly prohibited and undertaken at your own risk;
  
• (d) You assume all legal responsibility and liability for any claims, damages, or legal actions arising from your use of third-party content within the Game. The Team shall not be held liable for any copyright infringement or other legal violations committed by users.

The Game, including but not limited to its code, graphics, user interface, audio, and documentation, is the intellectual property of Stagnant Water Games and is protected by applicable copyright and intellectual property laws. This EULA does not grant you any ownership rights to the Game.


THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE TEAM DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STAGNANT WATER GAMES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE GAME.


This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Game and destroy all copies in your possession.


We reserve the right to modify this EULA at any time. Changes will be effective upon posting. Your continued use of the Game after any changes constitutes your acceptance of the revised EULA.
