TERMS OF SERVICE AND END USER LICENSE AGREEMENT

IMPORTANT: This Agreement contains a binding arbitration provision and class action waiver that affect your legal rights. Please read Section 7 carefully.
This Terms of Service and End User License Agreement ("Agreement") is a binding legal contract between you ("User," "you") and CM-SS13 ("Developer," "we," "us") concerning your use of the CM Launcher software ("Software") and associated services (collectively, the "Services").
By clicking "I Agree," installing the Software, or accessing the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not install or use the Software.
1. THIRD-PARTY SOFTWARE REQUIREMENT
1.1. Mandatory Runtime Environment (BYOND)
You acknowledge that the Software is a specialised launcher and compatibility tool that cannot function without the installation and operation of the BYOND Game Engine ("Engine"), a separate third-party platform owned and operated by BYOND Software.
1.2. No Affiliation
The Developer is an independent entity. This Software is not affiliated with, endorsed by, sponsored by, or capable of binding BYOND Software.
1.3. BYOND Memberships & Subscriptions
BYOND Software may offer premium memberships, subscriptions, or account upgrades ("BYOND Membership"). You acknowledge that:
These are transactions solely between you and BYOND Software.
We do not manage, process, benefit from, or provide support for BYOND Memberships.
Any issues regarding billing, cancellation, or benefits of a BYOND Membership must be directed to BYOND Software, not us.
1.4. User Responsibility & Authorisation
Separate License: Your use of the Engine is governed exclusively by BYOND Software’s own Terms of Service and End User License Agreement. You are solely responsible for reviewing and complying with those terms.
Automated Acquisition: The Software includes features to automate the retrieval and installation of the Engine from public sources for your convenience. By using these features, you explicitly authorise the Software to act as your agent to download the Engine on your behalf. You represent that you have read and accepted BYOND Software’s licensing terms prior to utilising this feature. You may review these full policies at https://www.byond.com/TOS.
2. LICENSE GRANT & PROPRIETARY RIGHTS
2.1. Limited License
Subject to your compliance with this Agreement, Developer grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software solely for non-commercial entertainment purposes.
2.2. Ownership
The Developer retains all right, title, and interest in the Software, including all code, assets, and modifications to the CM game mode. "BYOND" is a registered trademark of BYOND Software. All other trademarks are the property of their respective owners.
2.3. Prohibited Conduct
You agree not to:
Reverse engineer, decompile, or disassemble the Software.
Create cheats, hacks, mods, or any other unauthorised software that interacts with the Services.
Use the Services to harass, abuse, or harm another person or group.
Interfere with the proper working of the Services (e.g., Network-Based attacks).

3. DATA PRIVACY & COLLECTION
3.1. Data Collection
We collect information as necessary to operate the Services, including but not limited to:
Account Data: BYOND CKey, Discord ID, Twitch ID.
Device Data: IP address, Hardware IDs (HWID), OS version.
Activity Logs: Connection timestamps, chat logs, and in-game actions.
3.2. Purpose of Use
Data is processed for the legitimate interests of providing the Services, detecting ban evasion, enforcing community rules, maintaining server integrity, and cooperating with law enforcement as required.
3.3. Retention
We retain moderation data (including IP and HWID linked to bans) indefinitely to ensure the permanent enforcement of community sanctions. Requesting deletion of your account does not entitle you to the deletion of evidence related to rule violations or active bans.
4. TERMINATION & ACCOUNT SUSPENSION
4.1. Right to Terminate
We reserve the right to terminate your license, suspend your access to the Services, or ban your account at any time, for any reason, or no reason, including but not limited to your violation of this Agreement, the community rules, or the BYOND Software EULA.
4.2. Effect of Termination
Upon termination, all licenses granted to you hereunder immediately expire. You must cease all use of the Software and destroy all copies in your possession.
5. DISCLAIMERS & LIMITATION OF LIABILITY
5.1. "As Is" Disclaimer
The Services are provided "as is" and "as available," without warranty of any kind, either express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
5.2. Third-Party Liability
We are not responsible for the actions, content, information, or data of third parties (including BYOND Software), and you release us, our directors, volunteers, and community members from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.
5.3. Limitation of Liability
To the maximum extent permitted by law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, whether incurred directly or indirectly.
6. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Developer and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of this Agreement; (c) your violation of any third-party right; or (d) your use, interaction with, or modification of the core modified game mode, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.
7. DISPUTE RESOLUTION (BINDING ARBITRATION)
Except for small claims actions, all disputes arising out of or related to this Agreement or the Services shall be resolved exclusively through binding arbitration. You acknowledge that due to the free, volunteer, and community-driven nature of the Services, any arbitration initiated by you shall be conducted solely at your own expense. You and the Developer waive the right to a trial by jury.
7.2. Class Action Waiver
You and the Developer agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
8. GENERAL PROVISIONS
8.1. Governing Law
This Agreement is governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
8.2. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
8.3. Broader Terms and Privacy Policy
This Agreement applies specifically to the Software and Game client. Your participation in the wider CM-SS13 community, including your use of our Account System, Website, Forums, and Discord, is also governed by our comprehensive Terms of Service and Privacy Policy.
