End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User", "Player") and Infinite Retry Studio ("Company", "we", "us") governing your access to and use of Endless TD ("Game").
By installing, accessing, or playing the Game, you agree to be bound by this Agreement. If you do not agree, do not use the Game.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Endless TD for personal, non-commercial entertainment purposes only.
You do not own the Game. All rights not expressly granted are reserved by Infinite Retry Studio.
2. Early Access Disclaimer
Endless TD is an Early Access game.
You acknowledge and agree that:
The Game is not complete and is actively under development
Features, systems, balance, and content may change significantly
Bugs, crashes, performance issues, or data loss may occur
Online services may be modified, interrupted, or discontinued
Save data or progress may be reset during development
No guarantees are made regarding future features, updates, content, or development timelines.
3. Online Features & Accounts
Some features of the Game require:
An active internet connection
A game account
A platform account (e.g., Steam)
When you first access the Game through Steam, a game account is automatically created and linked to your Steam ID. This account may later be linked to other platforms (such as Google Play) to enable cross-platform play and progress synchronization.
You are responsible for:
Maintaining the security and confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized use
We may suspend or terminate your access for violations of this Agreement or for any reason at our discretion.
4. Acceptable Use
You agree not to:
Cheat, exploit bugs, or use unauthorized third-party software
Reverse engineer, decompile, disassemble, or modify the Game
Use bots, automation tools, macros, or hacks
Harass, threaten, abuse, or engage in toxic behavior toward other players
Disrupt game servers, matchmaking, or other players' experiences
Circumvent security measures, anti-cheat systems, or access controls
Impersonate developers, moderators, or other players
Buy, sell, or trade accounts or in-game items for real money
Use the Game for commercial purposes without written permission
Violation of these terms may result in warnings, temporary suspension, or permanent bans without notice or refund.
5. User-Generated Content & Behavior
You may interact with other users through gameplay, chat, and communication systems.
You agree that:
You are solely responsible for your conduct and communications
You will not submit offensive, illegal, defamatory, or infringing content
You will not share personal information of others without consent
We may moderate, remove, or restrict content or accounts at our discretion
We may report illegal activity to appropriate authorities
We are not responsible for user-generated content but reserve the right to act on reports and enforce community standards.
6. Virtual Items & Purchases
The Game may include:
Virtual currency (e.g., gems)
Cosmetic items and skins
Unlocks, upgrades, or other digital content
All virtual items:
Have no real-world monetary value
Are licensed to you, not owned by you
Are non-transferable and non-refundable (except as required by law)
May be modified, rebalanced, or removed at any time
Purchases are processed through third-party platforms (e.g., Steam) and are subject to their respective terms and refund policies.
7. No Ownership of Progress or Data
Gameplay progress, statistics, rankings, achievements, and virtual items:
May change due to updates, balance adjustments, bug fixes, or resets
Are not guaranteed to persist indefinitely
Do not create any property rights, monetary claims, or legal entitlements
May be lost due to account termination, technical issues, or service discontinuation
8. Intellectual Property
All content in the Game, including but not limited to:
Source code and software
Art, graphics, sprites, and animations
Music, sound effects, and audio
Characters, storylines, and game mechanics
Logos, trademarks, and branding
User interface and game design
Is owned by Infinite Retry Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, distribute, modify, create derivative works, publicly display, or commercially exploit any Game content without our prior written permission.
Limited exception: You may create and share gameplay videos, streams, and screenshots for non-commercial purposes, provided you credit Endless TD and Infinite Retry Studio.
9. Termination
We may suspend or terminate this license at any time if you:
Violate any provision of this Agreement
Engage in abusive, fraudulent, or illegal behavior
Disrupt the game, servers, or community
Attempt to circumvent enforcement actions
Upon termination:
Your right to access the Game ends immediately
Your account and associated data may be deleted
You are not entitled to any refund for purchases made
You may terminate this Agreement at any time by uninstalling the Game and discontinuing use.
10. Disclaimers
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WE DO NOT GUARANTEE ERROR-FREE, UNINTERRUPTED, OR SECURE OPERATION
WE DO NOT GUARANTEE SERVER AVAILABILITY OR UPTIME
WE DO NOT GUARANTEE THAT DEFECTS WILL BE CORRECTED
WE ARE NOT RESPONSIBLE FOR DATA LOSS, HARDWARE DAMAGE, OR OTHER HARM
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
WE ARE NOT LIABLE FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO ACCESS THE GAME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Infinite Retry Studio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
Your use of the Game
Your violation of this Agreement
Your violation of any third-party rights
Your user-generated content or communications
13. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the United States, without regard to conflict of law principles.
Any disputes arising from this Agreement shall be resolved through:
Good faith negotiation between the parties
If negotiation fails, binding arbitration or small claims court (at your option for claims within the court's jurisdiction)
You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
14. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Changes to This Agreement
We may update this Agreement at any time by posting the revised version on our website or within the Game.
We will indicate the "Last Updated" date at the top of this Agreement.
Continued use of the Game after changes are posted constitutes your acceptance of the revised Agreement.
For material changes, we may provide additional notice through the Game or via email (if you have provided one).

17. Entire Agreement
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Infinite Retry Studio regarding your use of Endless TD.
This Agreement supersedes any prior agreements, communications, or understandings relating to the Game.
By installing, accessing, or playing Endless TD, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
