GCubeSDK END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and FenixFoxStudios ("Licensor") for the GCubeSDK software development kit and associated documentation, tools, and materials (collectively, the "Software").
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL OR USE THE SOFTWARE.
1. GRANT OF LICENSE
Subject to the terms and conditions of this Agreement, Licensor hereby grants you a non-exclusive, non-transferable, revocable license to:
(a) Use the Software for the purpose of developing applications, games, and other software products ("Your Products");
(b) Modify the Software's source code (if provided) for use in Your Products;
(c) Distribute the Software solely as incorporated into Your Products, subject to the terms of this Agreement.
2. PAID ACCESS AND FEES
2.1 One-Time Purchase License
Access to the Software and its source code is granted only to users who have lawfully purchased the Software from an authorized distribution channel designated by the Licensor.
Upon purchase, no additional license fees, royalties, or revenue sharing obligations are required for the use of the Software, regardless of revenue generated by products developed using the Software.
2.2 No Refund of License Rights
Refund of the purchase does not retroactively revoke rights granted under this Agreement, except as expressly stated in Section 9 (Termination).
3. NINTENDO INTELLECTUAL PROPERTY DISCLAIMER
3.1 No Affiliation
This Software is not affiliated with, endorsed by, or sponsored by Nintendo Co., Ltd. or any of its subsidiaries or affiliates ("Nintendo"). Nintendo is not responsible for this Software or its use.
3.2 Independent Development
This Software does not contain, incorporate, or use any proprietary Nintendo code, assets, trademarks, or intellectual property. The Software is developed independently using publicly available development tools and documentation.
3.3 User Responsibility
You are solely responsible for ensuring that Your Products and your use of this Software comply with all applicable laws, regulations, and intellectual property rights, including but not limited to Nintendo's intellectual property rights. Licensor makes no representations or warranties regarding the legality of using this Software or Your Products on Nintendo hardware.
3.4 No Warranty of Legality
LICENSOR EXPRESSLY DISCLAIMS ANY WARRANTY THAT YOUR USE OF THIS SOFTWARE OR YOUR PRODUCTS WILL NOT INFRINGE UPON THE INTELLECTUAL PROPERTY RIGHTS OF NINTENDO OR ANY THIRD PARTY. YOU ASSUME ALL RISK AND LIABILITY ASSOCIATED WITH SUCH USE.
4. THIRD-PARTY SOFTWARE AND TOOLS
4.1 Third-Party Tools
The Software may include or require the use of third-party software, tools, and libraries, including but not limited to:
- devkitPro toolchain and devkitPPC compiler
- libogc and associated GameCube/Wii support libraries
- Supporting libraries such as pngu, fat, iso9660, and related components
- MSYS2 or similar Unix-like build environments
- Dolphin Emulator, used for testing and development purposes
4.2 Third-Party License Compliance
You acknowledge that such third-party software is subject to its own separate license terms and conditions. You agree to comply with all applicable third-party license terms. Licensor makes no representations or warranties regarding third-party software.
4.3 Third-Party Acknowledgments
This Software incorporates or uses the following third-party components:
- devkitPPC/devkitPro: PowerPC development toolchain for GameCube/Wii (See https://devkitpro.org for license information)
- libogc: Open Source GameCube/Wii library (See libogc source for license information)
- Other open source libraries as bundled with devkitPro
You are solely responsible for reviewing and complying with all applicable third-party license terms. Dolphin Emulator is an independent, third-party emulator project and is not affiliated with or endorsed by Nintendo.
5. RESTRICTIONS
You may NOT:
(a) Remove or alter any copyright, trademark, or other proprietary notices contained in the Software;
(b) Use the Software to develop products that infringe upon the intellectual property rights of others;
(c) Use the Software in any manner that violates applicable laws or regulations;
(d) Sublicense, rent, lease, or lend the Software, except as incorporated in Your Products as permitted herein;
(e) Use the Software to develop malicious software, viruses, or other harmful code.
6. INTELLECTUAL PROPERTY
The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold. All rights not expressly granted to you are reserved by Licensor.
7. WARRANTY DISCLAIMER
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM THE USE OF THE SOFTWARE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. TERMINATION
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any term(s) of this Agreement. Upon termination, you must destroy all copies of the Software and cease all use thereof.

11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Licensor relating to the Software and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the Software.
BY USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

3.2 Independent Development
This Software does not contain, incorporate, or use any proprietary Nintendo code, assets, trademarks, or intellectual property. The Software is developed independently using publicly available development tools and documentation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. TERMINATION
