End User Licence Agreement (EULA)

This is the legal Contract between end user (hereby referred to as User) and the video game developer Nicola Cerrato (hereby referred to as Service Provider). By installing and using a game (hereby referred to as Video game) developed by Service Provider you accept the terms of this Contract and consequently his privacy in use accessible in Privacy Policy and Terms and Service, the User is required to comply with the provisions contained in the Associated Terms (section 11).
1. License to use
You are granted a limited, non-exclusive, non-transferable, and revocable license for install and use the Video game for personal and non-commercial use only on compatible devices mobile device etc. (hereby referred to as Various Systems).
2. License Restrictions
To the User is not permitted:
Modify, decompile, disassemble or attempt to do so for access the code or asset in any other way the Video game, resell it, distribute it, rent it, sublicensed it or use it for commercial purposes or in a manner that violates any applicable laws or third-party rights.
3. Intellectual Property and Copyright Information
The Video game is protected by copyright and from other rights. Every content, trademark and assets belongs to the Service Provider.

4. Intellectual Property of third-party
The Video game may use third-party services including but not limited to the list in the Privacy Policy of the Various Systems in use.
The User acknowledges and accepts that:
These services are operated by third-party and subject to their Privacy Policy and Terms of Service, each service is the intellectual property of its respective owner.
Use of these services may require the internet connection and a valid account.
The Service Provider is not responsible for the interruption, malfunction or changes made by these platforms.
5. Updates e Support
The Video game can receive automatic updates and the Service Provider is not obligated to provide technical support as described in the Terms and Service, if you have any problems with it, this is the contact e-mail for assistance support@epicalea.com.
6. Warranty Disclaimer and Limitation of Liability
This product is provided ‘as is’ (without express or implied warranties). The Service Provider is not responsible for direct or indirect damages resulting from the use of the Video game as described in the Terms and Service.
7. Terms and Termination of Use and Refund
The license is for an indefinite period and terminates automatically upon violation of the terms, in this case the User will no longer have to use the Video game, uninstall it and the license will be terminated.
Refund Policy
The conditions of the refund may vary depending on digital purchasing distribution platform in his time and specific policies. The User are invited to consult the conditions that apply at the time of purchase.
8. Applicable law
The law governing the agreement is that of the Italian Republic, excluding the rules of private international law which could lead to the referral to the application of a different law. Still, the User could benefit from the mandatory protection provisions provided by the legislation of one's own country of residence. None of this limits the statutory rights of the Contract which cannot be contractually excluded under applicable law.
9. Dispute Resolution
In case of any disputes arising from the interpretation, validity or performance of this Contract, the parties undertake to initially seek a friendly solution preferably through direct communication or through mediation procedure with a Competent Authority.
If it is not possible to reach an agreement within 30 days from the written notification of the dispute, exclusive jurisdiction will be attributed to the court of [Nocera Inferiore], unless otherwise provided by mandatory law.
10. Severability clause
In case a single section or more parts of the Agreement are deemed inapplicable by a Competent Authority or by a court or tribunal, the remaining parts of the Agreement remain valid, unless it affects the balance of the Contract.
11. Associated Terms
The User, including players, fans, content creators, media, influencers and others who post or share material related of the Video game are also required to comply with the User-Generated Content Guidelines and Community-Tournament Guidelines in addition to the Privacy Policy and Terms of Service, these documents regulate the use of the contents of it, publication of related material, terms and privacy.
