End User License Agreement (EULA)

Developer: FerioWorks LLC
This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and FerioWorks LLC (“Developer”) governing your use of the software RigidGems Museum (“Software”).
By installing, accessing, or using the Software, you agree to be bound by the terms of this Agreement.
If you do not agree with these terms, do not install or use the Software.
1. License Grant
FerioWorks LLC grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software for personal entertainment purposes.
The Software is licensed, not sold.
This license allows the User to run the Software on personal devices and interact with the Software as intended by the Developer.
No ownership rights in the Software are transferred to the User.
2. Ownership
All rights, title, and interest in and to the Software remain the exclusive property of FerioWorks LLC.
This includes but is not limited to:
• proprietary rendering engine technology
• gemstone simulation systems
• graphics technology and visual effects
• software code and architecture
• user interface systems
• benchmark systems
• game design and internal data structures
Nothing in this Agreement transfers any intellectual property rights to the User.
3. Restrictions
Except where prohibited by applicable law, the User may not:
• reverse engineer the Software
• decompile the Software
• disassemble the Software
• modify the Software
• extract or redistribute Software assets
• create derivative software based on the Software
• redistribute the Software without permission
Unauthorized modification or redistribution of the Software is prohibited.
4. Artificial Intelligence and Dataset Restrictions
The Software and any audiovisual output generated by the Software may not be used for the purpose of training artificial intelligence systems or creating machine learning datasets without explicit written permission from FerioWorks.
Prohibited uses include but are not limited to:
• machine learning model training
• dataset creation
• automated scraping of rendered images
• large-scale extraction of gameplay visuals
This restriction applies to:
• screenshots
• rendered gemstone images
• gameplay recordings
• benchmark output
This clause does not restrict normal gameplay sharing, streaming, or video creation.
5. Benchmark Results
The Software may include benchmarking features designed to evaluate rendering performance.
Benchmark results:
• may vary depending on hardware configuration
• are provided for informational purposes only
• should not be considered standardized performance measurements
FerioWorks does not guarantee that benchmark results are directly comparable across different systems.
If benchmark results are published, users should disclose relevant system configuration where possible.
6. Render Output and Screenshot Use
Users may capture screenshots and videos of gameplay for personal use and for sharing within online communities.
Permitted uses include:
• social media sharing
• gameplay videos
• streaming content
• personal galleries
Monetized streaming content on platforms such as YouTube or Twitch is permitted.
However, the following uses are not permitted without written permission from FerioWorks:
• selling rendered images created using the Software
• using rendered images in commercial products
• minting NFTs based on rendered output
• using rendered images as datasets for AI training
RigidGems Museum is intended as an interactive entertainment experience and creative exploration environment, not as a commercial rendering service.
7. Fan Content
Users may create fan content such as screenshots, edited videos, or artwork using gameplay visuals.
When possible, attribution should be included:

8. Third-Party Assets
The Software may include certain third-party assets licensed or obtained under separate terms.
These may include:
• public domain (CC0) assets
• licensed environment maps
• purchased 3D models
• developer-created assets
Such assets remain subject to their respective licenses where applicable.
FerioWorks does not claim ownership of third-party assets that are licensed separately.
9. Artificial Intelligence Disclosure
The Software does not use generative artificial intelligence to create its visual assets.
Visual assets included in the Software are either:
• created by the developer
• licensed from third-party sources
• obtained from public domain resources
All rendered imagery produced by the Software is generated through a deterministic real-time rendering engine.
10. Disclaimer of Warranty
The Software is provided “as is” without warranty of any kind.
FerioWorks makes no guarantees regarding:
• uninterrupted operation
• error-free functionality
• compatibility with all hardware systems
Use of the Software is at the User’s own risk.
11. Limitation of Liability
To the maximum extent permitted by law, FerioWorks shall not be liable for:
• indirect damages
• incidental damages
• loss of data
• loss of profits
• loss of business opportunities
arising from the use or inability to use the Software.
12. Termination
This Agreement automatically terminates if the User violates any terms of this Agreement.
Upon termination, the User must immediately cease use of the Software.
13. Governing Law
This Agreement shall be governed by the laws of Japan.
Any disputes arising from this Agreement shall be handled in accordance with applicable Japanese law.
