1. License Grant
The Game is licensed, not sold.
Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Game for personal, non-commercial purposes only, subject to this Agreement.
This license may be revoked if you materially breach this Agreement.
2. Ownership
All rights, title, and interest in and to the Game, including but not limited to software, source code, executable code, artwork, music, sound effects, text, characters, logos, trademarks, and any associated intellectual property, are owned by Developer or its licensors.
No ownership rights are transferred to you under this Agreement.
3. Restrictions
You may not, except as expressly permitted by applicable law:
Copy, reproduce, distribute, publicly perform, or publicly display the Game.
Modify, adapt, translate, reverse engineer, decompile, or disassemble the Game.
Create derivative works based on the Game.
Use the Game for commercial purposes.
Remove, alter, or obscure any copyright, trademark, or proprietary notices.
Exploit the Game in a manner that violates applicable law or third-party rights.
4. Online Features and Services
The Game may include online features or services (“Online Services”), including but not limited to updates, leaderboards, cloud functionality, or other online components.
Online Services are provided “as is” and may be modified, suspended, or discontinued at any time without notice.
Developer does not guarantee uninterrupted or error-free Online Services.
Access to Online Services may require an internet connection and may be subject to additional terms imposed by third parties (e.g. Steam).
5. Free and Paid Versions
The Game may be offered free of charge for a limited time or as a limited version.
Developer reserves the right to change the price, introduce paid versions, DLCs, or additional content at any time.
Use of a free version does not grant any entitlement to future paid content, updates, or features.
6. User-Generated Content (UGC)
If the Game allows you to create, upload, or share content (“User-Generated Content”):
You represent and warrant that you own or have all necessary rights to the content you submit.
You grant Developer a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, distribute, display, and publicly perform such content in connection with the Game and its promotion.
Developer reserves the right to remove or moderate User-Generated Content at its sole discretion.
You agree to indemnify and hold Developer harmless from any claims arising from your User-Generated Content.
7. Termination
This Agreement is effective until terminated.
Developer may terminate this Agreement immediately if you violate any provision of this Agreement.
Upon termination, you must cease all use of the Game and delete all copies in your possession.
8. Disclaimer of Warranty
To the maximum extent permitted by applicable law, the Game is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
Developer shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use or inability to use the Game.
Nothing in this Agreement shall limit or exclude liability for intent, gross negligence, or injury to life, body, or health, or any liability that cannot be excluded under mandatory consumer protection laws.
10. Privacy
The collection and use of personal data is governed by Developer’s Privacy Policy, which forms an integral part of this Agreement.
11. Steam and Third-Party Platforms
If the Game is distributed via Steam or another third-party platform:
Your use of the Game is also subject to the platform’s applicable terms and conditions.
Refunds, payments, and account-related matters are handled by the respective platform provider.
This Agreement does not override or replace any mandatory platform terms.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Your Country], excluding its conflict of law rules, without prejudice to mandatory consumer protection laws of your country of residence.
13. Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
This Agreement constitutes the entire agreement between you and Developer regarding the Game and supersedes all prior agreements or understandings.
