This End User License Agreement ("Agreement" or "EULA") is a legally binding agreement between you ("User") and Hawkeye Interactive Games and Hawkeye Interactive Studios (collectively referred to as "Hawkeye Interactive", "we", "us", or "our"), governing your use of the video game *Whispers of Montéiroz* (the "Game").

By installing, accessing, or using the Game, you confirm that you have read, understood, and agreed to be bound by this EULA. If you do not agree, you must not install, access, or use the Game.

Hawkeye Interactive grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game solely for personal, non-commercial purposes, subject to this EULA and the rules of the platform through which the Game is distributed, including Steam.

The license is granted for an **indefinite duration**, unless terminated in accordance with this EULA.

This EULA applies to:

• The base version of *Whispers of Montéiroz
  
• All updates, patches, bug fixes, downloadable content (DLC), and future additions released for the Game

You agree that you shall not, in whole or in part:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game
  
• Modify, adapt, translate, or create derivative works
  
• Use cheats, hacks, exploits, automation software, or unauthorized third-party tools
  
• Circumvent or disable security or technical protection measures
  
• Use the Game for any commercial purpose
  
• Copy, distribute, rent, lease, sublicense, sell, or transfer the Game
  
• Mine data or attempt to access internal systems or databases

Any unauthorized use constitutes a material breach of this EULA.

You are permitted to create and share non-commercial content such as gameplay videos, screenshots, streams, and fan art, provided that such content does not violate applicable laws, platform rules, or third-party rights.

Hawkeye Interactive reserves the right to revoke this permission at any time.

All rights, title, and interest in and to the Game, including but not limited to software code, original graphics, audio, music, storylines, characters, trademarks, and other original content, are owned by or licensed to Hawkeye Interactive and are protected by applicable intellectual property laws.

Certain third-party assets, tools, or materials used in the Game may be owned by their respective licensors and are used under valid license agreements. Such third-party content remains the property of its respective owners.

This EULA does not grant you any ownership rights in the Game or its content. All rights not expressly granted are reserved.

Although the Game is primarily offline, it may interact with platform services, analytics systems, update mechanisms, or backend services.

Hawkeye Interactive reserves the right to modify, suspend, or discontinue any online or connected features at any time without notice.

The Game may contain content including, but not limited to, violence, disturbing imagery, psychological horror elements, flashing lights, and intense audiovisual effects.

You acknowledge that you use the Game at your own risk and that it may not be suitable for all users.

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAWKEYE INTERACTIVE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Hawkeye Interactive does not warrant that the Game will be error-free, uninterrupted, or compatible with all systems.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAWKEYE INTERACTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data
  
• Hardware or software damage
  
• Loss of profits or business opportunities
  
• System failure or crashes

IN NO EVENT SHALL HAWKEYE INTERACTIVE'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE GAME.

This EULA is effective until terminated.

Hawkeye Interactive may terminate this license immediately if you violate this EULA or applicable platform policies, including those of Steam.

Upon termination, you must cease all use of the Game and delete all copies in your possession.

Hawkeye Interactive reserves the right to modify this EULA at any time.

Continued use of the Game or any Hawkeye Interactive product after changes constitutes acceptance of the revised EULA.

This EULA shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of law principles.

The courts of Istanbul, Türkiye shall have exclusive jurisdiction.

This EULA applies globally, regardless of the user's location.

Your use of the Game is also subject to the Steam Subscriber Agreement.

In the event of any conflict between this EULA and Steam’s terms, Steam’s terms shall prevail.

Hawkeye Interactive shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, war, pandemics, governmental actions, or technical failures.

If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This EULA constitutes the entire agreement between you and Hawkeye Interactive regarding the Game and supersedes all prior agreements or understandings.

This EULA is provided exclusively in English. In the event of any discrepancy or interpretation issue, the English version shall prevail.
