This End User License Agreement ("Agreement") is a legal agreement between you ("User") and the developer of HIKARIO. ("Developer") for the software application HIKARIO. ("Software").
By installing, copying, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.
1. License Grant
The Developer grants you a non-exclusive, non-transferable, non-sublicensable, limited license to install and use the Software for personal or commercial use in accordance with this Agreement.
2. Restrictions
You may not:
- Modify, reverse engineer, decompile, or disassemble the Software.
- Redistribute, sublicense, sell, rent, lease, or exploit the Software except as expressly permitted.
- Use the Software for any unlawful purpose or in violation of applicable laws or regulations.
3. Ownership
The Software is licensed, not sold. The Developer retains all rights, title, and interest in and to the Software, including all intellectual property rights.
4. User Responsibility
You are solely responsible for how you use the Software. The Developer is not responsible for any outcomes, damages, or consequences resulting from misuse or improper use of the Software.
5. Disclaimer of Warranties
The Software is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
To the maximum extent permitted by law, the Developer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use the Software.
7. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software.
8. Updates and Changes
The Developer may update or modify the Software at any time without notice. Continued use of the Software constitutes acceptance of any updates or changes.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Developer’s country of residence, without regard to conflict of law principles.
10. Entire Agreement
This Agreement constitutes the entire agreement between you and the Developer regarding the Software and supersedes all prior or contemporaneous agreements.
