END USER LICENSE AGREEMENT (EULA)
For KGT - Kevin Got Teleported by Marcel Klee - WuotanStudios
1. Grant of Rights
By purchasing [KGT - Kevin Got Teleported], you receive a perpetual, non-exclusive, worldwide, and transferable license to use the Software as if it were your property. This license grants you the following rights:
Installation: Install and use the Software on any number of your self owned devices for personal, non-commercial purposes.
Backup Copies: Create backup copies of the Software for personal use.
Transferability: Transfer your copy of the Software to another person (e.g., by sale or gift), provided you permanently delete all copies from your own devices and the recipient agrees to the terms of this EULA.
Modifications: Not allowed, as long as you do not distribute modified versions without written permission from the Licensor.
This license is irrevocable as long as you comply with the terms of this agreement.
2. Intellectual Property
While the copyright and intellectual property rights of the Software (including but not limited to graphics, code, text, sound effects, music, and trademarks) remain the exclusive property of [Marcel Klee, WuotanStudios] or its affiliates, your purchase grants you full usage rights as described in Section 1.
You do not own the source code or original assets of the Software, but you are free to use the Software without restrictions beyond those outlined in this agreement.
3. Restrictions on Use
You agree not to, and you will not permit others to:
Use the Software for commercial purposes (e.g., rental, public display for a fee, or any form of monetization).
Distribute modified versions of the Software without written permission from the Licensor.
Reverse engineer, decompile, or disassemble the Software to extract source code for commercial use or to create competing products.
Use the Software in any way that violates applicable laws or regulations.
4. DRM-Free Policy
This Software is provided without any digital rights management (DRM) restrictions. You may:
Use the Software offline without online activation or verification.
Install and run the Software on any compatible device without limitations.
5. Warranty and Limitation of Liability
As Is: The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the maximum extent permitted by applicable law, Marcel Klee shall not be liable for any indirect, incidental, or consequential damages (including loss of data or business interruption) arising out of the use or inability to use the Software. In no event shall Marcel Klee’s total liability exceed the amount actually paid by you for the Software.
6. Term and Termination
Effective Date: This Agreement is effective from the date you purchase or install the Software and remains in effect indefinitely.
Termination by You: You may terminate this Agreement at any time by destroying or uninstalling all copies of the Software.
Termination by Licensor: Marcel Klee may terminate this Agreement only if you violate its terms. Upon termination, you must delete all copies of the Software in your possession.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Austria (Europe/Vienna), without regard to its conflict of law provisions.
8. Miscellaneous
Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: This Agreement constitutes the entire agreement between you and Marcel Klee regarding the use of the Software.
Amendments: Marcel Klee reserves the right to amend this Agreement at any time. Continued use of the Software after such amendments constitutes acceptance of the new terms.
