Acceptance
This document (“End User License Agreement”, “EULA” ) is a legal agreement between you (“You”, “End User” or “User”), Informal Tech LLC (“Informal Tech” or “Informal Tech Games”). Informal Tech LLC is both the “Publisher” (“publisher”) and “Developer” (“developer”) as referenced in this document. This EULA governs Your use of the Game, whether or not You are a registered End User of the Game. River Runners (“Game”, “game”) is owned by Informal Tech LLC.
By accessing and/or playing the game you agree to abide by and be bound by this EULA. The publisher owns and controls all intellectual property rights in and to the game and permits you to play the game only in accordance with EULA. Your playing of the game constitutes your acceptance of this EULA. If you do not agree to this end user license agreement, do not access or play the game.
Unreal Engine & Epic Games
River Runners includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Informal Tech LLC, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Informal Tech LLC, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the River Runners, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this River Runners, or will not revoke approval of this River Runners for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Informal Tech LLC and Epic. Informal Tech LLC, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Informal Tech LLC, Epic, Epic’s licensors, nor its or their affiliates, nor any of Informal Tech LLC’s or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this EULA (End-user License Agreement), including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Informal Tech LLC, Epic, Epic’s licensors, nor its or their affiliates, nor any of Informal Tech LLC’s or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this EULA or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Informal Tech LLC’s, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Informal Tech LLC, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Informal Tech LLC, Epic, Epic’s licensors, its and their affiliates, and any of Informal Tech LLC’s or Epic’s service providers shall be limited to the full extent permitted by law.
Access to the game
The developer of the game reserves the right to restrict or revoke access to the game at any time for any reason the developer deems fit. No refunds will be issued outside of the agreement made between You and the vendor of the game (Steam, or any other vendor).
Delivery of the game
The developer provides the game on an “as is” basis. Any issues with the game or your ability to play it are not guaranteed to be resolved. The developer may release additional updates to the game which may resolve issues or introduce new ones.
Updates to the game
The developer reserves the right to release updates which may alter the game from its original state.
Indemnification
Your access to and/or playing of the game constitutes your agreement to defend, indemnify, and hold harmless the Publisher, affiliates, licensors, partners, platform/service providers and their respective members, employees, contractors, officers, and directors, from and against any actions, claims, demands, liability and expenses, including reasonable attorneys’ fees, arising out of your use or misuse of the game including related services by a third party with the use of your account.
Termination
This EULA is effective until amended by the developer in its sole discretion. The developer may change, suspend, or discontinue all or any aspect of the game at any time for any reason without prior notice or liability, including, without limitation, the availability of the game or any feature. The developer may cease to provide the game or any or all of the products and services offered in connection with the games, terminate the EULA, and cancel all of the rights granted to you under the EULA at any time for any reason without prior notice or liability. the publishers may, but is not obligated to, communicate such termination to you in any of the following manners: (i) in a notice in the game; (ii) via electronic mail; (iii) in this EULA, or (iv) in another manner that the publishers deem suitable to inform you of the termination.
Amendments to the EULA
The developer reserves the right to amend the EULA at any time. By using the game after any amendment to the EULA you agree to any amendments.
Seizure warning, motion sickness etc.
In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights in the game and/or advertising related to the game. Exposure to certain light patterns or backgrounds on a video monitor or virtual reality/augmented reality headset/glasses/equipment may induce an epileptic seizure or motion sickness even in persons who have no history of prior seizures or epilepsy. The developer takes no responsibility for such effects in the game and advertising related to the game and end results thereof and you are accessing and playing the game and seeing the advertising at your own risk. The developer takes no responsibility for motion sickness or balance problems etc. that may occur from the playing of the game or seeing the advertising etc.
Trademarks and game marks
The names, logos, characters, brands and product and service names appearing in the game and related services are trademarks/service marks or registered trademarks/service marks of the developer and/or third parties (the respective holders). The use of any such trademark or service mark without the expressed written consent of the respective holder is strictly prohibited.
Online interactions
You are responsible for any actions you take when using the game toward other players and for any actions taken against you by other players. Under no circumstances is the developer to be held liable or responsible for any harm, abuse, etc to occur during online interactions in the game. This includes but is not limited to any text, voice, images, video interactions.
Forbidden use
By using the game you agree to abide by the vendor’s (Steam or any other vendor's) community guidelines. You also agree to abide by the following:
No harassment
No doxing
No solicitation
No cheating or hacking
No abuse of other players or yourself
No spam
No distribution of malicious software
No impersonation of the developer staff
Governing law
This Agreement shall be governed by and construed in accordance with the laws of the United States and the state of Florida, without giving effect to any principles of conflicts of law. You agree that any action arising out of or relating to this EULA shall be filed only in the state or federal courts in and for Florida and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
