END USER LICENSE AGREEMENT (EULA) FOR SHORETILES

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT" OR "EULA") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR PLAYING SHORETILES (THE "GAME").
THIS AGREEMENT IS A LEGAL CONTRACT BETWEEN YOU (THE "USER" OR "YOU") AND Voxel S.r.l ("DEVELOPER", "WE", "US", OR "OUR") REGARDING YOUR USE OF SHORETILES.
BY DOWNLOADING, INSTALLING, OR USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL, COPY, OR PLAY THE GAME.
1. GRANT OF LICENSE
Subject to your compliance with this Agreement, Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and play one copy of the Game solely for your personal, non-commercial entertainment purposes on a compatible device.
2. OWNERSHIP AND INTELLECTUAL PROPERTY
The Game, including all code, graphics, audio, user interfaces, visual assets, storylines, characters, artwork, and documentation, is the intellectual property of Developer or its licensors and is protected by international copyright, trademark, and other intellectual property laws. All rights not expressly granted to you under this Agreement are strictly reserved by Developer.
3. UNREAL® ENGINE MATERIALS & EPIC GAMES DISCLAIMER
ShoreTiles includes Unreal® Engine code and other materials, technology, and information (collectively, the "Unreal® Engine Materials") licensed from Epic Games, Inc. ("Epic").
(a) "AS IS" AND "AS AVAILABLE" BASIS: ALL UNREAL® ENGINE MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, "WITH ALL FAULTS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
(b) DISCLAIMER OF REPRESENTATIONS, WARRANTIES, AND CONDITIONS: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER AND EPIC (TOGETHER WITH ITS AFFILIATES, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) EXPRESSLY DISCLAIM ALL REPRESENTATIONS, WARRANTIES, CONDITIONS, AND DUTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SATISFACTORY QUALITY, SYSTEM INTEGRATION, ACCURACY, TIMELINESS, AND ERROR-FREE OR UNINTERRUPTED OPERATION RELATED TO THE UNREAL® ENGINE MATERIALS OR THE GAME.
(c) LIMITATION OF LIABILITIES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EPIC, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, COMPUTER FAILURE, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, THE GAME, OR THE UNREAL® ENGINE MATERIALS, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF EPIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(d) NO OBLIGATION OF SUPPORT: YOU ACKNOWLEDGE THAT EPIC HAS NO OBLIGATION TO PROVIDE ANY MAINTENANCE, SUPPORT, UPDATES, OR ASSISTANCE REGARDING THE UNREAL® ENGINE MATERIALS OR THE GAME.
(e) THIRD-PARTY BENEFICIARY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT EPIC GAMES, INC. AND ITS AFFILIATES ARE INTENDED THIRD-PARTY BENEFICIARIES OF THIS AGREEMENT AND SHALL HAVE THE RIGHT TO ENFORCE THE DISCLAIMERS, LIMITATIONS OF LIABILITY, AND RESTRICTIONS CONTAINED HEREIN DIRECTLY AGAINST YOU.
4. RESTRICTIONS
You agree that you will not, directly or indirectly:
- Copy, reproduce, distribute, rent, lease, sell, broadcast, or commercially exploit the Game or any part thereof;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying assets of the Game or Unreal® Engine Materials, except as permitted by applicable law;
- Modify, adapt, translate, or create derivative works based on the Game;
- Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party software designed to modify or interfere with the Game experience or integrity;
- Remove, alter, or obscure any copyright, trademark, or legal notices embedded in or displayed by the Game.
5. STEAM PLATFORM TERMS, PRECEDENCE, AND REFUND POLICY
(a) Steam Refund Policy: Nothing in this Agreement is intended to affect, limit, or exclude your statutory rights as a consumer or your right to request a refund for the Game through the Steam platform in accordance with Valve Corporation’s official Steam Refund Policy.
(b) Order of Precedence: In the event of any direct conflict, inconsistency, or contradiction between any provision of this Agreement and the Steam Subscriber Agreement ("SSA"), the terms of the Steam Subscriber Agreement shall strictly prevail and control to the extent of such conflict.
6. DISCLAIMER OF WARRANTIES (GAME)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. LIMITATION OF LIABILITY AND CONSUMER SAVINGS CLAUSE
(a) LIMITATION: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE GAME. DEVELOPER’S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE GAME.
(b) CONSUMER SAVINGS CLAUSE: SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON IMPLIED WARRANTIES OR THE LIMITATION OF STATUTORY RIGHTS OF A CONSUMER, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, DEVELOPER'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
8. TERMINATION
This Agreement is effective until terminated. Your rights under this License will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Game and permanently delete all copies of the Game from your devices.
9. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to this Agreement shall be instituted exclusively in the competent courts located in Ascoli Piceno, Italy.
