End User License Agreement & Terms of Use — Bird Brigade

Please read this Agreement carefully before playing.
1. Acceptance. By clicking "Accept" you confirm that you have read this Agreement and agree to it. If you do not agree, click "Decline" and the game will close; you may not use the game without accepting. If you are below the age of majority or digital consent in your country, a parent or legal guardian must accept on your behalf.
2. License. Merkel Games grants you a limited, non-exclusive, revocable and non-transferable license to install and use the game for personal, non-commercial purposes. The game is licensed, not sold; all rights not expressly granted to you are reserved.
3. Intellectual property & trademark. Bird Brigade and its source code, graphics, music, characters, text and other materials are protected by copyright © Ernest Merkel / Merkel Games. "Bird Brigade" is a trademark registered with the German Patent and Trade Mark Office (DPMA). Copying, distribution, decompilation, modification and the creation of derivative works are prohibited without written permission, except where the law expressly allows.
4. Account & online services. Online play uses your account and the game servers. You are responsible for keeping your credentials safe and for activity carried out through your account. Online services may be temporarily unavailable (maintenance, updates, outages); uninterrupted availability is not guaranteed.
5. Data & privacy. To provide online features we process: account data, game progress and statistics, play time, your friends list and technical connection data (such as your IP address). This data is used to provide the game, multiplayer, leaderboards and protection against abuse. You may request access to or deletion of your data. See the Privacy Policy at https://merkel.games/#privacy for details. This Agreement does not replace the Privacy Policy.
6. Conduct, voice chat & fair play. In multiplayer, conduct that breaks applicable law, cheating (cheats, exploits, third-party software) and any disruption of the service are prohibited. If you use voice chat, your speech is transmitted to other players in real time. We may restrict access for violations.
7. User content. When you set names, nicknames or other content, you warrant that it does not infringe third-party rights and is not unlawful. You grant us the right to use such content to the extent necessary to operate the game. We may remove unlawful content.
8. Virtual items & purchases. In-game currency, cosmetics and other virtual items are licensed for in-game use, have no monetary value outside the game and cannot be exchanged for real money. Where paid purchases are offered, they are made under the terms of the relevant platform (e.g. Steam); your statutory consumer rights remain unaffected.
9. Early access. The game may be distributed in early access and under active development. This means bugs and errors may occur, and that features, balance, content and progress may change or be reset without prior notice.
10. Age. The game is not intended for children under 13. If a higher age of consent for data processing applies in your country, use is only permitted with the consent of a parent or legal guardian.
11. Disclaimer & limitation of liability. The game is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, Merkel Games and the author are not liable for indirect or incidental damages. Nothing in this Agreement limits liability that cannot be excluded by law (including intent and gross negligence, and injury to life or health) or affects mandatory consumer rights.
12. Termination. We may suspend or terminate your access to the game and online services if you breach this Agreement. You may stop using the game at any time by uninstalling it.
13. Changes to the terms. We may update this Agreement. For material changes you will be asked to accept the new version. Continuing to use the game after the changes take effect means you accept them.
14. Governing law. This Agreement is governed by the law of the Federal Republic of Germany, without prejudice to the mandatory consumer-protection rules of your country of habitual residence.
