PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE
INSTALLING OR USING MATCHBUZZ ("SOFTWARE"). BY INSTALLING, COPYING, OR
OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS
AGREEMENT.
1. LICENSE GRANT
Subject to the terms and conditions of this Agreement, we grant you a
non-exclusive, non-transferable, revocable license to install and use the
Software solely for your personal, non-commercial purposes.
2. RESTRICTIONS
You may NOT:
- Modify, reverse engineer, decompile, or disassemble the Software
- Remove any copyright, trademark, or other proprietary notices
- Use the Software for any commercial purpose
- Distribute, sublicense, rent, lease, or lend the Software
- Use the Software in violation of any applicable laws or regulations
- Use the Software to gain unfair advantages in competitive gaming
- Use the Software in any manner that violates game publishers' Terms of Service
3. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY
DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT.
4. GAME COMPATIBILITY AND THIRD-PARTY TERMS
The Software is designed to work with third-party games including but not
limited to:
- Overwatch 2 (Blizzard Entertainment)
- Apex Legends (Electronic Arts/Respawn Entertainment)
YOU ACKNOWLEDGE AND AGREE THAT:
- You are solely responsible for complying with the Terms of Service of any
games you use with this Software
- We are not affiliated with, endorsed by, or sponsored by any game publisher
- Game publishers may prohibit the use of third-party software
- Your use of this Software with any game is at your own risk
- We are not responsible for any account suspensions, bans, or other actions
taken by game publishers
5. SCREEN CAPTURE AND OCR FUNCTIONALITY
The Software uses screen capture and Optical Character Recognition (OCR)
technology to detect game events. YOU ACKNOWLEDGE THAT:
- The Software captures screenshots of your display
- Screenshots are processed locally and are not transmitted to external servers
- You are responsible for ensuring that captured content complies with
applicable privacy laws
- You should not use the Software in situations where screen capture may
violate privacy or confidentiality obligations
6. DISCORD INTEGRATION
If you choose to use Discord webhook functionality:
- You are responsible for the security of your webhook URL
- You must comply with Discord's Terms of Service and Community Guidelines
- We are not responsible for any Discord account actions resulting from your
use of this feature
7. AUDIO FEATURES
The Software may play notification sounds through your audio output devices.
- Volume levels and device selection are your responsibility
- We are not liable for any hearing damage or disturbances
8. AUTOMATIC UPDATES
The Software may automatically check for and install updates. You agree to
receive such updates as part of your use of the Software.
9. DATA COLLECTION AND PRIVACY
- The Software stores settings and preferences locally on your device
- No personal information is collected or transmitted without your consent
- If you use Discord integration, webhook URLs are stored locally
- We do not collect, store, or transmit gameplay data or screenshots
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY
LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY
LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Software
- Any unauthorized access to or use of your data
- Any bugs, viruses, or other harmful code
- Game account suspensions or bans
- Any other matter relating to the Software
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless us and our affiliates from
any claims, damages, losses, liabilities, and expenses (including attorney's
fees) arising from:
- Your use of the Software
- Your violation of this Agreement
- Your violation of any third-party terms of service
- Your violation of any applicable laws or regulations
12. TERMINATION
This license is effective until terminated. Your rights under this license
will terminate automatically without notice if you fail to comply with any
term of this Agreement. Upon termination, you must cease all use of the
Software and destroy all copies.
13. CHANGES TO THIS AGREEMENT
We reserve the right to modify this Agreement at any time. Continued use of
the Software after changes constitutes acceptance of the modified terms.
14. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws
of Japan, without regard to its conflict of law provisions.
15. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid,
that provision shall be limited or eliminated to the minimum extent necessary
so that this Agreement shall otherwise remain in full force and effect.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and us regarding
the Software and supersedes all prior agreements and understandings.
