TERMS AND CONDITIONS OF USE
BY INSTALLING, DOWNLOADING, ACCESSING OR OTHERWISE USING THE SERVICE, YOU DECLARE THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS OF USE. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST NOT INSTALL, ACCESS OR USE THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED BY APPLICABLE LAW.
These Terms and Conditions of Use (the "Terms") govern access to and use of the video games, websites, online services, digital content and related functionalities (collectively, the "Service") offered by Zelcar Games LLC, a limited liability company organized under the laws of the State of New Mexico, United States, with its principal place of business in Albuquerque, New Mexico, USA (hereinafter, the "Company," "we," or "our").
Use of the Service is also subject to the current Privacy Policy and any other supplementary policies or rules published by the Company, which form an integral part of these Terms.
The Company reserves the right to modify, update or replace these Terms, the Privacy Policy and/or any other applicable policy at any time and at its sole discretion. Such modifications shall become effective upon publication unless a different date is expressly indicated. Continued use of the Service after publication of modifications constitutes acceptance of the changes. If the user does not agree with the current version, they must immediately cease using the Service, and their right to access and use the Service will automatically terminate.
1. ACCESS TO THE SERVICE AND USER ACCOUNTS
1.1 License to Use the Service
Subject to continued acceptance of and compliance with these Terms, the Privacy Policy and any other applicable policies, Zelcar Games LLC grants the user a limited, personal, non-exclusive, non-transferable, revocable and non-sublicensable license to access and use the Service solely for personal entertainment purposes and not for commercial use.
The user agrees to use the Service strictly as permitted under these Terms and for no other purpose.
The user is responsible for all activities conducted through their account, including use of the Service by minors under their supervision and any use of payment methods associated with their account.
The Company may suspend or revoke access to the Service in the event of a breach of these Terms or applicable law.
1.2 User Account and Login Information (Zelcar ID)
To access certain features, the user may create a Zelcar ID account. During registration, the user may be required to create login credentials or other authentication methods ("Login Information"). The user agrees to:
- Maintain the confidentiality of their Login Information.
- Not share their account or allow access to third parties.
- Immediately notify the Company of any unauthorized use or suspected security breach.
- Be responsible for all activities conducted through their account, including purchases.
The Company may modify, suspend, reclaim or delete usernames when necessary for technical, legal or third-party claim reasons. Zelcar ID accounts are personal and non-transferable. Buying, selling, renting, transferring or assigning accounts is prohibited, as is creating accounts using false information or impersonating others. Individuals previously suspended or banned may not use the Service. For security and system integrity reasons, certain account unlinking or deletion features may be limited after registration.
2. RULES OF USE AND RESTRICTIONS
2.1 Restrictions
Use of the Service must comply with these Terms. Violation may result in immediate suspension or termination. The user agrees not to:
- Use the Service contrary to its intended purpose or spirit.
- Use, develop or distribute cheats, bots, unauthorized modifications, exploits, emulators or automation tools.
- Modify Service files without written authorization.
Disrupt or interfere with normal Service operation. Overload or attack servers or infrastructure. Attempt unauthorized access to accounts or systems. Publish offensive, discriminatory, obscene, defamatory or illegal content. Harass or threaten other users or Company representatives. Infringe intellectual property rights. Reverse engineer or attempt to extract source code except where legally permitted. Collect personal data of other users. Publish private information without authorization. Use the Service for gambling involving real-world rewards. Violate applicable laws, including export control or sanctions laws.
The Company may determine violations at its sole discretion and take appropriate action, including account termination.
2.2 Suspension and Termination
Zelcar Games LLC may, at its sole discretion and WITH OR WITHOUT PRIOR NOTICE, suspend, restrict, modify or terminate accounts or access to the Service if: i) the user breaches or is reasonably suspected of breaching these Terms; ii) illegal, fraudulent or abusive use is detected; iii) the conduct poses technical, legal or security risks. The user may lose usernames, progress, virtual items or benefits. THE COMPANY HAS NO OBLIGATION TO COMPENSATE FOR SUCH LOSSES. The Company may also discontinue the Service entirely at any time without compensation. Users may request account cancellation through official support channels.
3. OWNERSHIP AND INTELLECTUAL PROPERTY
All rights, title and interest in the Service remain exclusively with Zelcar Games LLC or its licensors. This includes software, source code, gameplay mechanics, characters, designs, audiovisual content, databases and all related elements. Users do not acquire ownership of their accounts or virtual items. Accounts constitute a revocable access right only. Virtual content has no real-world monetary value and does not grant ownership rights.
4. USER CONTENT
"User Content" means any content submitted or shared through the Service. By submitting User Content, the user represents that:
- They have necessary rights to publish it.
- It does not infringe third-party rights.
- It does not contain malicious code.
The Company may monitor, record, edit or remove User Content at its discretion. By posting User Content, the user grants the Company a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, distribute and display such content in connection with the Service.
5. PURCHASES, FEES AND VIRTUAL ITEMS
Virtual items may be purchased for real money and are licensed, not sold. ALL PURCHASES ARE FINAL AND NON-REFUNDABLE UNLESS REQUIRED BY LAW. Virtual rewards based on random mechanics (e.g., Magic Fruits) are random rewards based on probability. The probabilities for each outcome are published in-game. No specific outcome is guaranteed.
6. SERVICE OPERATION AND UPDATES
The Service may be updated, modified or discontinued at any time.
Users may be required to install updates to continue using certain features.
7. WARRANTIES AND LIMITATION OF LIABILITY
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, Zelcar Games LLC disclaims all warranties. Liability is limited to the total amount paid by the user in the six (6) months preceding the claim. If no payments were made, the sole remedy is to stop using the Service.
8. GOVERNING LAW AND DISPUTE RESOLUTION
Disputes shall first be attempted to be resolved informally. These Terms are governed by the laws of the State of New Mexico, United States. Any legal action shall be brought before courts located in New Mexico, unless consumer protection laws provide otherwise.
9. FINAL PROVISIONS
- If any provision is invalid, the remainder remains in effect.
- The Company may assign these Terms without user consent.
- These Terms constitute the entire agreement.
- Failure to enforce any right does not constitute waiver.
- Notices may be delivered via email or in-Service communications.
- The Company may seek injunctive relief when necessary.
- The Company is not liable for force majeure events beyond its reasonable control.
