END USER LICENSE AGREEMENT (EULA)

INCLUDING ONLINE FEATURES, PRIVACY POLICY, AND HEALTH WARNING

This End User License Agreement (“Agreement”) is a legally binding agreement between you (“User”, “you”) and the developer and/or publisher (“Developer”, “we”, “us”) regarding the software product known as Beltix (“Software”).

By downloading, installing, launching, or otherwise using the Software via Steam or any other authorized distribution channel, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not install or use the Software.

1. Relationship to Steam

This Agreement supplements the Steam Subscriber Agreement.
In the event of any conflict, the Steam Subscriber Agreement shall prevail.
Valve Corporation is not a party to this Agreement and assumes no responsibility or liability for the Software.

2. License Grant

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software solely for personal, educational, and non-commercial entertainment purposes, subject to this Agreement and the Steam Subscriber Agreement.

The Software is licensed, not sold.

3. Educational Use

The Developer expressly permits use of the Software for educational purposes, including but not limited to:

use in schools, universities, and educational institutions;

use by teachers, educators, trainers, and students;

use in classrooms, workshops, courses, and learning environments;

non-commercial teaching, learning, research, and demonstration purposes.

Educational use does not grant ownership rights, does not imply free access or free licenses, and does not permit resale, sublicensing, or other commercial exploitation unless expressly authorized in writing by the Developer.

4. Intellectual Property

All rights, title, and interest in and to the Software, including but not limited to source code, binaries, artwork, audio, music, text, designs, trademarks, and logos, are owned exclusively by the Developer or its licensors.

No ownership rights are transferred to you under this Agreement.

5. Modding Permissions
5.1 Permitted Uses

You may:

create, use, and share mods for personal, educational, and non-commercial purposes;

distribute mods free of charge;

use official modding tools or documented interfaces, if provided.

5.2 Prohibited Uses

You may not:

sell, license, rent, or otherwise monetize mods without prior written consent;

include copyrighted or proprietary third-party material without authorization;

use mods to cheat, exploit, or bypass security, DRM, online systems, or gameplay restrictions;

distribute mods containing malware, illegal, hateful, or harmful content.

The Developer retains all rights to the original Software.
Mods may be rendered incompatible or unusable by updates without notice.

6. Streaming, Video, and Monetization Rights

The Developer expressly permits you to:

stream gameplay on platforms such as Twitch, YouTube, or similar services;

create, upload, and share gameplay videos, screenshots, and clips;

monetize such content through advertising, donations, or subscriptions.

Provided that:

the Software is lawfully acquired and used;

no false claim of ownership of the Software is made;

the content does not violate applicable law or third-party rights.

No additional license or permission is required.

7. Restrictions

Except where expressly permitted by mandatory applicable law, you may not:

reverse engineer, decompile, or disassemble the Software;

circumvent DRM, anti-cheat, security, or integrity mechanisms;

use cheats, bots, automation, exploits, or manipulated clients;

interfere with online challenges, leaderboards, or result submission;

use the Software for commercial purposes beyond permitted streaming;

copy, rent, lease, sublicense, or redistribute the Software;

remove or alter proprietary notices.

Educational use as permitted under Section 3 shall not be considered commercial use.
Mandatory statutory consumer rights remain unaffected.

8. Early Access Notice

The Software may be provided in Early Access or an unfinished state.

You acknowledge that:

the Software may be incomplete, unstable, or contain bugs;

features, mechanics, progression, online challenges, or scores may change or be reset;

no guarantees are made regarding final features, content, balance, or release dates.

Use of Early Access versions is at your own risk.

9. Online Features and Online Challenges
9.1 Online Services

The Software may include online features such as online challenges, leaderboards, score submissions, events, or other network-based functionality (“Online Features”).

Online Features are provided on an “as available” basis.
The Developer does not guarantee availability, uptime, continuity, or compatibility.

9.2 Fair Play and Integrity

You agree to participate in Online Features fairly and honestly.

The Developer reserves the right, at its sole discretion, to:

invalidate, reset, or remove scores, rankings, or challenge results;

suspend or restrict access to Online Features;

take action against cheating, exploiting, manipulation, or abuse.

The Developer is not obligated to provide explanations or restore removed data.

9.3 Changes and Discontinuation

The Developer may modify, suspend, or permanently discontinue Online Features at any time, with or without notice.

No compensation, refund, or replacement is owed for discontinued Online Features, challenges, or rankings.

10. Updates

The Developer may update, patch, or modify the Software at any time.
Updates may change gameplay, features, balance, progression, or Online Features.

Backward compatibility is not guaranteed.

11. Termination

This Agreement remains effective until terminated.

The Developer may terminate this Agreement if you materially breach its terms.
Upon termination, you must cease all use of the Software.

Mandatory statutory consumer rights remain unaffected.

12. Warranty Disclaimer

To the maximum extent permitted by applicable law, the Software is provided “AS IS” and “AS AVAILABLE”.

Except for mandatory statutory warranties that cannot be excluded, the Developer disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Health and Safety Warning

Some individuals may experience adverse physical effects when playing video games, including dizziness, nausea, eye strain, headaches, fatigue, motion sickness, or seizures triggered by visual stimuli such as flashing lights or patterns.

If you experience symptoms such as dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, involuntary movements, or convulsions, stop using the Software immediately and consult a qualified medical professional.

The Software is not a medical device. No medical or health claims are made.

14. Limitation of Liability

Nothing in this Agreement excludes or limits liability that cannot be excluded under applicable law, including liability for intent, gross negligence, death, or personal injury.

To the maximum extent permitted by law, the Developer shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Where liability is permitted, it shall be limited to the amount paid for the Software.

15. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the Republic of Austria, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.

PRIVACY POLICY (GDPR)
16. General

The Developer processes personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

This Privacy Policy forms an integral part of this Agreement.

18. Categories of Data Collected
18.1 Technical and Telemetry Data

game version, platform, operating system;

hardware class information;

performance metrics;

crash logs and diagnostics;

gameplay telemetry, including interaction with Online Features.

18.2 Network and Identifier Data

IP address (processed transiently and minimized);

session identifiers;

SteamID or equivalent platform identifier, where required for Online Features.

18.3 User-Provided Data

support requests, feedback, or communications voluntarily submitted.

No special categories of personal data are intentionally processed.

19. Purpose and Legal Basis

Personal data is processed for:

operation, stability, and security of the Software and Online Features;

fair operation of online challenges and leaderboards;

bug fixing and crash analysis;

gameplay balancing and improvement;

customer support and abuse prevention.

Processing is based on contract performance, legitimate interest, or consent, as required by law.

20. Children and Educational Use

The Software is intended to be suitable for educational and family-friendly use.

Where required by law, children may use the Software only with parental or guardian consent.
Data processing relating to children is limited to what is strictly necessary.
No profiling or targeted advertising of children is performed.

21. Data Retention

Personal data is retained only as long as necessary:

diagnostic and telemetry data: typically up to 24 months;

aggregated or anonymized data: may be retained longer.

22. Data Sharing

Personal data may be shared with:

Valve Corporation (Steamworks services);

infrastructure, hosting, analytics, or crash-reporting providers acting as data processors.

No personal data is sold.

23. International Transfers

Personal data may be transferred internationally where required for operation, subject to appropriate safeguards.

24. User Rights

You have rights under applicable data protection laws, including access, rectification, erasure, restriction, objection, data portability, and withdrawal of consent.

25. Data Security

Appropriate technical and organizational measures are implemented to protect personal data.

26. Changes to This Agreement

The Developer may update this Agreement to reflect legal, technical, or operational changes.
Material changes will be communicated where required by law.
