General Terms and Conditions (GTC) and End User License Agreement
for the online game “Isekai Guardians” (Browser & App) by Aikasy GmbH

1. Scope
These General Terms and Conditions (GTC) govern the use of the online game “Isekai Guardians”, as well as all associated digital services provided by Aikasy GmbH, regardless of whether access is via the official website, subdomains (e.g., `app.isekaiguardians.com`, `api.isekaiguardians.com`), the mobile Android app, the web platform, or other services.
They apply to all users (“players”) who use the game, register, or access content – regardless of whether they use paid or free services.
By first accessing, registering for, or actively using the game, players acknowledge these GTC in their current version as legally binding.
Deviating terms from players shall not apply unless the provider has explicitly agreed to them in writing.

3. Subject of the Agreement
The provider makes the online game “Isekai Guardians” available to players as a multiplayer role-playing game. Access is provided via the official website, subdomains, or the mobile Android app.
The basic version of the game is free to play. It includes core game features that allow for gameplay without payment.
In addition, the provider offers optional paid features (“premium services”). These may include virtual currencies, cosmetic items, gameplay advantages, or expansions. The specific scope, price, and functionality of these premium features are clearly presented in the game.
There is no entitlement to the constant availability or functionality of specific game components. The game is in ongoing development. Therefore, the provider reserves the right to modify, expand, or discontinue individual content, features, or mechanics – as long as this is reasonable for the player.
4. Registration and User Account
To use certain features of “Isekai Guardians,” prior registration by the player is required.
By registering, users confirm that all provided information (especially email address, username) is accurate, complete, and up to date.
Creating an account using false or misleading information is not permitted.
Each player is generally allowed to create only one user account, unless the provider explicitly permits multiple accounts. Sharing, transferring, or jointly using user accounts is prohibited.
Access credentials (e.g., password) must be kept confidential and may not be shared with third parties.
Players are obligated to immediately inform the provider if they suspect unauthorized use of their account.
The provider reserves the right to block, restrict, or permanently delete user accounts at any time if:
these GTC or the game rules are violated,
the account has been inactive for an extended period,
technical or security-related reasons make it necessary,
there is a justified suspicion of abuse, manipulation, or unauthorized multiple account usage.
Account deletion or suspension can also occur without prior notice if there is a significant breach or serious violation of the rules.
5. Age Restrictions (Eligibility)
The use of the game “Isekai Guardians” is permitted only for natural persons who are at least 16 years old.
By registering or using the game, players affirm that they are at least 16 years of age.
Use by children under the age of 16 is not permitted. The provider does not conduct active age verification but reserves the right to request proof of age in individual cases and to block access if there is doubt about eligibility.
For underage users (between 16 and 18 years), compliance with any additional legal requirements — particularly obtaining the necessary consent of parents or legal guardians — is the sole responsibility of those guardians.
The provider assumes no liability for this.
If it is found that an account was created in violation of these provisions (e.g., with a false age), the provider reserves the right to block or delete the account without prior notice.
6. Usage Rights and License
By registering or using the game, Aikasy GmbH grants the player a simple, non-exclusive, non-transferable, non-sublicensable, and revocable license to participate in “Isekai Guardians.”
This license is granted strictly for private, non-commercial use and includes access via supported platforms such as web browsers and the official app.
In particular, it is prohibited to:
copy, publicly share, or distribute the game or parts thereof,
decompile, reverse-engineer, or otherwise analyze content or source code,
circumvent technical protection measures,
use the game in ways not intended (e.g., via bots, mods, or automation tools),
sell, rent, or otherwise commercially exploit game content.
All content, software components, source code, graphics, audio materials, text, and trademarks are protected by copyright and/or other intellectual property rights of Aikasy GmbH or its licensors.
Any use beyond this requires prior explicit written consent.
7. Technical Availability and Liability
The provider strives to offer the game “Isekai Guardians” continuously and with as few disruptions as possible. However, temporary restrictions, maintenance, or technical issues may occur. There is no entitlement to uninterrupted, constant, or entirely error-free availability of the game.
The provider gives no guarantees for:
the uninterrupted accessibility of servers or services,
full functionality of the game on all devices or operating system versions,
flawless rendering or performance of the game in all use cases.
Use of the game is at the user’s own risk.
DISCLAIMER OF LIABILITY:
THE PROVIDER IS LIABLE ONLY FOR INTENTIONAL OR GROSSLY NEGLIGENT BREACHES OF DUTY. IN CASES OF SIMPLE NEGLIGENCE, THE PROVIDER IS LIABLE ONLY FOR DAMAGES RESULTING FROM INJURY TO LIFE, BODY, OR HEALTH, OR FOR BREACHES OF ESSENTIAL CONTRACTUAL OBLIGATIONS (CARDINAL DUTIES), AND ONLY TO THE EXTENT OF THE TYPICALLY FORESEEABLE DAMAGE.
LIABILITY FOR INDIRECT DAMAGES, DATA LOSS, OR DAMAGES CAUSED BY THIRD PARTIES (E.G., THROUGH UNAUTHORIZED ACCESS, HACKING, MALWARE) IS EXCLUDED UNLESS THE PROVIDER CAN BE PROVEN TO HAVE ACTED WITH GROSS NEGLIGENCE.
MANDATORY LEGAL LIABILITY PROVISIONS (E.G., UNDER THE PRODUCT LIABILITY ACT) REMAIN UNAFFECTED.
8. In-Game Behavior / Player Responsibilities
All players agree to conduct themselves in a respectful, fair, and lawful manner toward other users and the provider. The game “Isekai Guardians” aims to provide a safe and enjoyable environment for all participants.
In particular, the following is prohibited:
Insulting, harassing, threatening, or discriminating against other players (e.g., based on origin, gender, religion, sexual orientation, or other characteristics),
Distributing or making publicly accessible any unlawful, obscene, extremist, or youth-endangering content,
Using automated tools, bots, scripts, cheats, or other software to manipulate or automate gameplay,
Circumventing or interfering with security mechanisms, access controls, or technical protections,
Intentionally attacking or overloading server infrastructure, APIs, or game functions (e.g., Denial of Service attacks, exploits),
Impersonating another person or an official representative of the provider.
Sanctions for Violations:
The provider reserves the right to take the following actions in the event of violations of these behavior rules – especially in cases of repeated or serious misconduct:
Warning or temporary suspension of the account,
Permanent ban of the user account,
Deletion of content or chats,
Permanent termination of the user contract.
There is no entitlement to restoration of a deleted account or refund of any payments made in such cases.
9. Premium Services and In-App Purchases
Players have the option to voluntarily purchase digital add-ons (“Premium Services”) within the game, including:
Virtual currency or in-game resources,
Cosmetic items (skins, avatars, etc.),
Premium status or other gameplay-related advantages.
9.1 Formation of Purchase Agreement
All available Premium Services, including their respective prices, durations, and features, are displayed clearly and transparently within the game or store.
A binding paid contract is concluded once the payment process is successfully completed.
Payments are processed depending on the platform used:
Google Play Store when using the Android app
Apple App Store when using the iOS app
Paddle for purchases made via the website
Steam / Valve Store for purchases made via the Steam app
Additionally, the terms of service and privacy policies of the respective payment providers apply.
9.2 Non-Transferability
Purchased digital content is personal and non-transferable. A refund of paid amounts will not be provided unless a statutory right to reimbursement exists.
10. Support, Moderation, and Measures
The provider operates an internal moderation and support system to ensure compliance with these Terms and Conditions and the game rules, and to maintain a fair gameplay environment for all users.
10.1 Possible Measures in Case of Violations
If there is reasonable suspicion of rule violations, abuse, or other misconduct, the provider reserves the right to take one or more of the following actions:
Temporary or permanent suspension of the user account
Resetting or removal of in-game content, progress, or advantages gained through violations
Restriction of communication functions, such as chat or forum access
Warnings or other administrative sanctions
In severe cases: permanent deletion of the account
10.2 Review Procedures
Assessment is conducted manually by the moderation team based on internal review standards and documented evidence (e.g., reported content, chat logs, user reports).
There are no automated decisions with legal effect within the meaning of Art. 22 GDPR.
Players have the right to appeal any measures taken or to request a review.

The provider reserves the right to take further action in cases of abuse of the support system.
11. Termination and Account Deletion
11.1 Termination by the Player
Players can terminate their user relationship at any time without providing a reason by deleting their account via the in-game features or by emailing privacy@isekaiguardians.com.
Deleting the account ends the contractual relationship. Payments already made for premium services will not be refunded unless a statutory right to a refund exists.
11.2 Termination by the Provider
The provider may terminate the agreement at any time with 14 days’ notice.
In the case of serious or repeated violations of these Terms, applicable law, or the game rules, the provider reserves the right to terminate the contract without notice.
This may include immediate suspension or deletion of the account.
11.3 Data Deletion
After termination of the contractual relationship, all personal data associated with the user account will be deleted or anonymized in accordance with the [Privacy Policy](./privacy.md) and the GDPR, unless legal retention requirements prevent deletion.
Deletion may be subject to a technical delay, particularly in the case of backups or archived logs.
12. Changes to the Terms and Conditions
The provider reserves the right to modify these Terms and Conditions at any time with future effect, provided there is a valid reason. This may be necessary in particular due to:
Legal or regulatory changes,
Extensions or adjustments to the game,
Introduction of new features or services,
Changes in technical requirements.
12.1 Notification of Changes
The provider will inform players in a timely and transparent manner about planned changes to the Terms, either:
Directly in the game or app (e.g., via a pop-up message on login), or
By email to the address registered in the user account.
12.2 Right to Object
Changes are considered accepted if the player does not object within 14 days of receiving the notice, either in writing or by email.
In the event of a timely objection, both parties reserve the right to terminate the contract.
13. Data Protection
The protection of your personal data is very important to us.
All processing is carried out in accordance with applicable data protection laws, especially the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

14. Governing Law and Jurisdiction
The laws of the Federal Republic of Germany shall apply.
The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Where legally permitted, the place of jurisdiction is the provider’s registered office (Haiterbach, Germany).
This applies in particular to users who are not consumers as defined by § 13 of the German Civil Code (BGB).
15. Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
In place of the invalid or unenforceable provision, a rule shall apply – to the extent legally permitted – that comes closest to the intended economic purpose and the presumed will of the parties.
The same applies to any unforeseen gaps in these Terms.
