END USER LICENSE AGREEMENT (EULA)
for “Word Charades” and other Zabutan Games titles

IMPORTANT – READ CAREFULLY BEFORE PLAYING
By installing, launching, or otherwise using this software (“Software”), you agree to be bound by this End User License Agreement (“EULA”).
If you do not agree, do not install or use the Software.
1. LICENSE GRANT
Zabutan LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Software for personal entertainment purposes only, subject to this EULA and the Steam Subscriber Agreement.
You may install and use it on computers you own or control.
2. OWNERSHIP AND INTELLECTUAL PROPERTY
All rights, title, and interest in and to the Software—including all code, artwork, music, text, and design elements—are owned by Zabutan LLC or its licensors.
Certain third-party components (for example, Steamworks API and Unity Engine) are licensed separately and remain the property of their respective owners.
This EULA does not grant you any ownership rights.
3. USER RESTRICTIONS
You agree NOT to:
Decompile, reverse-engineer, or disassemble the Software;
Bypass or modify any license or DRM protection;
Use the Software for any illegal, harmful, or exploitative purpose;
Reproduce, distribute, sell, or sublicense the Software without written permission from Zabutan LLC.
4. IN-APP PURCHASES & VIRTUAL CURRENCY
At present, this Software contains no in-app purchases.
If future versions introduce optional items or virtual currency, those items will be non-refundable, non-transferable, and hold no real-world monetary value.
Zabutan LLC reserves the right to change such features or pricing at any time.
5. ONLINE & MULTIPLAYER CONTENT
This Software is primarily single-player.
If future updates add online or multiplayer functions, Zabutan LLC is not responsible for user-generated content, connectivity issues, or network interruptions.
You agree not to transmit any offensive, illegal, or infringing materials.
6. PRIVACY & DATA
Zabutan LLC may collect minimal technical data (e.g., device type, crash logs, gameplay metrics) solely to improve performance and gameplay.
No personally identifiable information is sold or shared.
For EU/UK users: Zabutan LLC acts as data controller under GDPR and processes data on the lawful basis of legitimate interest for game functionality.

7. MINORS & PARENTAL CONSENT
Users under 13 may not use this Software without parental or guardian consent.
Steam accounts are restricted to users 13 and older.
Zabutan LLC assumes no liability for false declarations of age or unauthorized use by minors.
8. TERMINATION
This license remains effective until terminated.
You may terminate it at any time by deleting the Software.
Zabutan LLC may terminate it without notice if you breach any terms.
Upon termination, you must delete all copies of the Software.
9. WARRANTY DISCLAIMER
THE SOFTWARE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
USE AT YOUR OWN RISK. ZABUTAN LLC MAKES NO WARRANTIES REGARDING AVAILABILITY, SECURITY, OR PERFORMANCE.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, ZABUTAN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS SOFTWARE.
ZABUTAN LLC’S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SOFTWARE.
11. MANDATORY ARBITRATION & CLASS ACTION WAIVER
Any dispute arising from this EULA shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Rules.
You and Zabutan LLC waive the right to a jury trial or class-action lawsuit.
You may bring an individual claim in small-claims court if it qualifies.
12. GOVERNING LAW & JURISDICTION
This agreement is governed by the laws of the State of California, United States, without regard to conflict-of-law rules.
Arbitration shall take place in San Diego County, California.
13. ENTIRE AGREEMENT & ACCEPTANCE
This EULA constitutes the entire agreement between you and Zabutan LLC regarding the Software and supersedes any prior understandings.
By installing or launching the Software, you acknowledge that you have read, understood, and agree to be bound by this EULA.
