This End User License Agreement ("Agreement") is a legal agreement between you ("User", "You", or "Your") and Elementum Software Development Services ("Developer", "We", "Us", or "Our") for the video game Decimation ("Game") in its Early Access state.

BY PURCHASING, DOWNLOADING, INSTALLING, OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE, DOWNLOAD, INSTALL, OR PLAY THE GAME.

1.1 Development Status
This Game is currently in **Early Access** and is **not a finished product**. The Game is under active development and may contain bugs, errors, incomplete features, performance issues, and other problems that would not be present in a final release.

1.2 Changes During Development
We reserve the right to:
- Add, modify, or remove features, content, and gameplay elements
- Change game mechanics, balancing, and systems
- Modify the story, characters, levels, and other creative elements
- Alter technical requirements and supported platforms
- Change the Game in any way we deem necessary during development

1.3 No Guarantee of Completion
While we intend to complete the Game's development, we cannot guarantee:
- That the Game will be completed
- A specific completion date or release timeline
- That any particular features shown or promised will be included in the final version
- Continued support or updates after Early Access ends

1.4 Your Participation
By purchasing Early Access, you acknowledge that you are choosing to play an unfinished game and participate in the development process. Your purchase supports ongoing development but does not guarantee specific outcomes.

2.1 Limited License
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for your personal, non-commercial entertainment purposes only.

2.2 License Restrictions
You may NOT:
- Copy, reproduce, or distribute the Game (except as Steam's terms allow for backup purposes)
- Modify, adapt, translate, reverse engineer, decompile, or disassemble the Game
- Create derivative works based on the Game
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Rent, lease, lend, sell, redistribute, or sublicense the Game
- Use the Game for any commercial purposes
- Use the Game to create competing products
- Circumvent any technical protection measures or security features
- Use cheats, automation software, bots, hacks, mods, or unauthorized third-party software
- Exploit bugs or glitches for personal gain or to disrupt other players' experience

3.1 Our Ownership
The Game, including all content, features, functionality, code, graphics, audio, text, and design, is owned by Elementum Software Development Services and is protected by copyright, trademark, and other intellectual property laws. This Agreement grants you a license to use the Game but does not transfer any ownership rights to you.

3.2 User-Generated Content
If the Game allows you to create or upload content ("User Content"), you retain ownership of your User Content, but you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content for purposes related to operating, promoting, and improving the Game.

You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not infringe on third-party rights
- Your User Content does not contain illegal, harmful, or offensive material

3.3 Feedback
If you provide feedback, suggestions, or ideas about the Game ("Feedback"), you grant us the right to use such Feedback without compensation or obligation to you.

4.1 Updates
During Early Access, we will provide updates to the Game. Updates may:
- Be required to continue playing
- Change or remove features you previously enjoyed
- Cause temporary disruptions to gameplay
- Require additional hard drive space

4.2 Support
We will make reasonable efforts to provide support for the Game but do not guarantee:
- Specific response times
- Resolution of all issues
- Continued support after Early Access ends

5.1 "AS-IS" Provision
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

5.2 Early Access Risks
You acknowledge and agree that:
- The Game may crash, freeze, or fail to function properly
- Game progress, saves, or data may be lost or corrupted
- Features may be added, changed, or removed without notice
- Performance may vary significantly during development
- The Game may never reach a finished state

5.3 No Warranty
We do not warrant that:
- The Game will be uninterrupted or error-free
- Defects will be corrected
- The Game is free of viruses or harmful components
- The Game will meet your expectations or requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEMENTUM SOFTWARE DEVELOPMENT SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO THE GAME OR THIS AGREEMENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE GAME SHALL NOT EXCEED THE AMOUNT YOU PAID TO PURCHASE THE GAME.

Some jurisdictions do not allow the limitation of certain warranties or liabilities, so the above limitations may not fully apply to you.

7.1 Steam Refund Policy
Refunds for the Game are subject to Steam's standard refund policy. Generally, you may request a refund if:
- You request the refund within 14 days of purchase
- You have played the Game for less than 2 hours

7.2 Early Access Consideration
Given the nature of Early Access, we encourage you to carefully consider whether you want to purchase the Game in its current state. Read reviews, watch gameplay videos, and understand that the Game is unfinished before making your purchase.

8.1 Data Collection
We may collect certain information about your use of the Game, including:
- Technical information (hardware specs, performance data, crash reports)
- Gameplay data (progress, statistics, in-game actions)
- Account information (if applicable)

8.2 Use of Data
We use collected data to:
- Improve the Game and fix bugs
- Analyze gameplay and balance
- Provide support
- Prevent cheating and abuse

8.3 Third-Party Services
The Game uses Steam's platform, and your use is also subject to Steam's Privacy Policy and Subscriber Agreement.

9.1 Termination by You
You may terminate this Agreement by uninstalling the Game and ceasing all use.

9.2 Termination by Us
We may terminate this Agreement and your access to the Game immediately if:
- You breach any terms of this Agreement
- We discontinue the Game or Early Access program
- Required by law

9.3 Effect of Termination
Upon termination:
- Your license to use the Game ends immediately
- You must uninstall and cease using the Game
- Provisions that by their nature should survive will continue (including ownership, disclaimers, and limitations of liability)

10.1 Entire Agreement
This Agreement constitutes the entire agreement between you and Elementum Software Development Services regarding the Game and supersedes any prior agreements.

10.2 Changes to Agreement
We reserve the right to modify this Agreement at any time. We will provide notice of material changes through the Game or Steam. Your continued use of the Game after changes constitutes acceptance of the modified Agreement.

10.3 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Republic of the Philippines, without regard to conflict of law principles.

10.4 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.5 No Waiver
Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.

10.6 Assignment
You may not assign or transfer this Agreement or your rights under it. We may assign this Agreement without restriction.

10.7 Age Requirement
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Game. If you are under 18, you represent that you have parental or guardian consent.
