AVATAR SENTINEL END USER LICENSE AGREEMENT

1. AGREEMENT TO TERMS
By downloading, installing, or using Avatar Sentinel ("Software"), you agree to be bound by the terms and conditions of this End User License Agreement ("Agreement"). If you do not agree to these terms, do not download, install, or use the Software.
This Agreement is a legal contract between you ("User," "you," or "your") and the Avatar Sentinel Team ("Company," "we," "us," or "our").
2. ELIGIBILITY
To use the Software, you must:
- Be at least 13 years of age
- If under 18 years of age, have obtained parental or legal guardian consent to use the Software and agree to this Agreement
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Software under applicable laws
- Not have been previously suspended or removed from using our services
By using the Software, you represent and warrant that you meet all eligibility requirements.
3. LICENSE GRANT
Subject to the terms of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the Software on compatible devices you own or control
- Use the Software for personal and commercial purposes related to avatar protection
- Access avatar protection, encryption, and license management services
- Create and manage licenses for your protected avatar content
- Integrate with supported e-commerce platforms for automated license delivery
- Use the Software's application programming interfaces (APIs) in accordance with our documentation
This license is granted on a per-user basis. You may not share your account credentials or allow others to access your account.
4. SUBSCRIPTION AND FEES
4.1 Distribution
The Software is distributed through Steam. All purchases, payments, and refunds are processed by Steam in accordance with Steam's terms of service and refund policies.
4.2 Payment Processing
We do not directly process any payment or billing information. All financial transactions are handled by Steam or other authorized payment processors.
4.3 Refunds
Refund eligibility and processing are governed by Steam's refund policy. We defer to Steam's policies regarding all refund requests for the Software.
4.4 Service Features
Certain features of the Software may require an active subscription or additional purchases. Feature availability may vary based on your subscription tier.
5. PERMITTED USES
You are permitted to:
- Protect and encrypt your VRChat avatar creations
- Generate and manage license keys for your customers
- Use fingerprinting and security features to protect your work
- Integrate with supported store platforms including, but not limited to, Gumroad, Payhip, Jinxxy, and Shopify
- Enable Blender Secure Mode for your protected avatars
- Access usage analytics and license management dashboards
- Use forensic analysis features to investigate potential unauthorized use
- Configure automated license delivery through supported integrations
6. RESTRICTIONS
You agree NOT to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
- Remove, alter, or obscure any proprietary notices or labels on the Software
- Use the Software to infringe upon the intellectual property rights of others
- Circumvent, disable, or interfere with security features of the Software
- Redistribute, resell, or sublicense the Software itself
- Use the Software for any unlawful purpose
- Attempt to bypass or defeat encryption or protection mechanisms
- Use the Software to protect content you do not have rights to distribute
- Use automated scripts, bots, or other automated means to access the Software in a manner that exceeds reasonable use
- Attempt to probe, scan, or test the vulnerability of our systems
- Interfere with or disrupt the integrity or performance of the Software or related systems
- Share, sell, or transfer your account credentials to any third party
- Create multiple accounts to circumvent restrictions or abuse our services
- Use the Software in any manner that could damage, disable, or impair our servers or networks
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Our Intellectual Property
The Software, including but not limited to all code, graphics, user interface, logos, trademarks, and documentation, is owned by the Avatar Sentinel Team and is protected by copyright, trademark, and other intellectual property laws.
7.2 Your Content
You retain all rights to the avatars and content you protect using the Software. The Software provides protection services only and does not claim ownership of your creations.
7.3 License to Your Content
By using the Software, you grant us a limited license to process your content solely for the purpose of providing our protection and encryption services. This license terminates when you remove your content from our services.
8. PRIVACY AND DATA COLLECTION
8.1 Information We Collect
Avatar Sentinel collects the following information to provide our services:
- Account Information: Username, email address, and securely hashed password
- License Information: License keys and product information for your protected content
- Customer Data: VRChat usernames and user IDs of your customers (for license verification)
- Avatar IDs: For identifying and managing protected avatars
- Security Logs: Activity logs for security purposes (IP addresses are NEVER logged or stored)
- Store Integration Credentials: API keys and tokens for connected platforms (securely encrypted)
- Blender Secure Mode Data: Encrypted mesh data stored on our servers when this feature is enabled
8.2 Information We Do NOT Collect
- IP addresses
- VRChat login credentials or passwords
- Payment or billing information (handled by Steam and payment processors)
- Personal files or computer data unrelated to our services
- Cookies or tracking data (we do not use cookies or similar tracking technologies)
8.3 How We Use Your Information
We use collected information to:
- Provide avatar protection and license management services
- Authenticate and secure your Avatar Sentinel account
- Process license verifications for your customers
- Send important service notifications
- Improve our services and user experience
- Detect and prevent fraud, abuse, and security incidents
8.4 Data Security
- All avatars are encrypted using industry-standard encryption
- Passwords are securely hashed and never stored in plain text
- Store integration credentials are securely protected
- All data transmission is encrypted and secure
- Each creator account has unique security credentials
- Avatar files remain encrypted on YOUR device only (exception: Blender Secure Mode data is encrypted on our servers)
8.5 Data Storage and Location
Your data may be stored and processed on servers located in various jurisdictions. By using the Software, you consent to the transfer and processing of your data in these locations.
8.6 Data Retention
- Security and activity logs: Automatically deleted after 30 days
- Account data: Deleted immediately upon account deletion request
- Products, licenses, and files: Deleted immediately when you remove them
8.7 Data Sharing
We do NOT sell, trade, or share your personal data with third parties for marketing purposes. Your data is only accessible to:
- The Avatar Sentinel team for service operation and support
- Third-party platforms you choose to integrate with (only the data necessary for the integration)
- Law enforcement when required by valid legal process
8.8 Data Breach Notification
In the event of a data breach, we will notify affected users within 72 hours as required by GDPR. We will provide details about what data was affected and steps being taken to address the breach.
8.9 Your Privacy Rights
You have the right to:
- Access your personal data
- Request data deletion
- Export your data
- Opt-out of non-essential communications
- Correct inaccurate personal data
- Opt-out of the sale of personal information (we do not sell personal information)
- Not be discriminated against for exercising your privacy rights

9. THIRD-PARTY SERVICES
9.1 Integrated Services
The Software may integrate with third-party services including, but not limited to:
- VRChat (for avatar verification and user identification)
- Unity (for avatar package processing)
- Blender (for mesh editing via our addon)
- E-commerce platforms: Gumroad, Shopify, Payhip, Jinxxy, and others
- Steam (for software distribution and licensing)
9.2 Third-Party Terms
These third-party services are subject to their own terms of service and privacy policies. We are not responsible for the practices, policies, or content of third-party services.
9.3 Your Responsibility
You are responsible for:
- Maintaining your accounts with third-party services
- Ensuring your use of integrations complies with third-party terms
- Securing your API keys and credentials for third-party services
- Any fees charged by third-party services
10. SERVICE AVAILABILITY
10.1 Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. The Software and related services are provided on an "as available" basis.
10.2 Maintenance
We may perform scheduled or emergency maintenance that temporarily affects service availability. When possible, we will provide advance notice of scheduled maintenance.
10.3 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, labor disputes, government actions, internet or telecommunications failures, or third-party service outages.
11. ELECTRONIC COMMUNICATIONS
11.1 Consent
By using the Software, you consent to receive electronic communications from us, including service announcements, administrative messages, and other information related to the Software.
11.2 Communication Methods
We may communicate with you via email, in-app notifications, or announcements on our website or Discord server.
11.3 Opting Out
You may opt out of non-essential communications but cannot opt out of critical service-related communications.
12. FEEDBACK AND SUBMISSIONS
12.1 Feedback License
If you provide feedback, suggestions, ideas, or other submissions regarding the Software ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate such Feedback into our products and services.
12.2 No Obligation
We have no obligation to use any Feedback and may choose whether to implement suggestions at our sole discretion.
12.3 No Compensation
You acknowledge that you will not receive any compensation for Feedback, even if we implement your suggestions.
13. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS
- UNINTERRUPTED OR ERROR-FREE OPERATION
- SECURITY OR PROTECTION EFFECTIVENESS
We do not warrant that the Software will meet your requirements, that protection methods are impenetrable, or that defects will be corrected. No advice or information obtained from us shall create any warranty not expressly stated in this Agreement. Use of the Software is at your own risk.
14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AVATAR SENTINEL TEAM BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to or alteration of your data
- Damages resulting from circumvention of protection by third parties
- Damages arising from your use of or inability to use the Software
- Damages arising from any third-party services or integrations
- Any damages exceeding the amount you paid for the Software in the twelve (12) months preceding the claim
These limitations apply regardless of the legal theory upon which damages may be claimed, including contract, tort, negligence, strict liability, or any other basis.
15. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Avatar Sentinel Team and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
- Your use of the Software
- Your violation of this Agreement
- Your violation of any third-party rights, including intellectual property rights
- Content you protect or distribute using the Software
- Your violation of any applicable laws or regulations
- Your negligence or willful misconduct
16. TERMINATION
16.1 Termination by You
You may terminate this Agreement at any time by uninstalling the Software and discontinuing its use. You may also request deletion of your account and associated data.
16.2 Termination by Us
We may terminate or suspend your access to the Software immediately, without prior notice, if you:
- Breach this Agreement
- Engage in conduct that we determine, in our sole discretion, is harmful to our services, other users, or third parties
- Use the Software for illegal purposes
- Attempt to circumvent security measures
16.3 Effect of Termination
Upon termination:
- All licenses granted to you under this Agreement will immediately cease
- You must uninstall and destroy all copies of the Software
- Previously issued customer licenses may continue to function for your customers
- Provisions that by their nature should survive termination will survive, including Sections 7, 8, 13, 14, 15, and 19
17. UPDATES AND MODIFICATIONS
17.1 Software Updates
We may update, modify, or discontinue the Software at any time without prior notice. Updates may be required for continued use of the Software and may be downloaded and installed automatically through Steam.
17.2 Agreement Modifications
We reserve the right to modify this Agreement at any time. We will notify you of material changes through email or in-app notifications. Continued use of the Software after any changes signifies your acceptance of the updated Agreement.
17.3 Feature Changes
We may add, modify, or remove features of the Software at our discretion. We will endeavor to provide notice of significant feature changes.
18. EXPORT CONTROLS
The Software contains encryption technology and may be subject to export control laws and regulations. By using the Software, you represent and warrant that:
- You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
- You will comply with all applicable export and re-export restrictions
- You will not use the Software for any purposes prohibited by applicable laws
19. GOVERNING LAW AND DISPUTE RESOLUTION
19.1 Governing Law
This Agreement shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
19.2 Dispute Resolution
Any disputes arising from this Agreement shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within thirty (30) days, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
19.3 Class Action Waiver
You agree to resolve any disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
20. GENERAL PROVISIONS
Entire Agreement: This Agreement constitutes the entire agreement between you and the Avatar Sentinel Team regarding the Software and supersedes all prior agreements, understandings, and communications.
Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Waiver: Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
Assignment: You may not assign or transfer this Agreement or any rights or obligations hereunder without our prior written consent. We may assign this Agreement without restriction.
Headings: Section headings are for convenience only and shall not affect the interpretation of this Agreement.
Notices: Notices to you may be made via email to the address associated with your account. Notices to us should be sent to support@avatarsentinel.com.

22. ACKNOWLEDGMENT
BY INSTALLING OR USING AVATAR SENTINEL, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SOFTWARE.
