Preamble
This End User License Agreement (hereinafter "this Agreement") is a legally binding contract between you (hereinafter "User") and KindHero Co., Ltd. (hereinafter "we," "us," or "KindHero").
This Agreement governs the terms of use for the "BattleSiege" software product and related services (collectively, the "Game"). By installing, copying, downloading, or otherwise using the Game, you are deemed to have agreed to all terms of this Agreement.
If you do not agree to the terms of this Agreement, do not install or use the Game. We may modify this Agreement within the scope permitted by applicable law and will notify you of any changes via the official website, the game client, or other reasonable means. Your continued use of the Game after such changes constitutes your acceptance of the modified Agreement.

I. License Grant
Subject to your compliance with the terms of this Agreement, KindHero grants you a limited, non-exclusive, non-transferable, non-sublicensable license (hereinafter "License") to install and use the Game solely for your personal, non-commercial entertainment purposes.
You may not:
Copy, modify, distribute, sell, lease, rent, reverse engineer, decompile, or attempt to extract the source code of the Game or any part thereof.
Use the Game for any purpose not expressly permitted by this Agreement.
II. Intellectual Property Rights and Secondary Creations
All content included in the Game (including but not limited to code, graphics, music, audio, characters, logos, text, UI, and artwork) is the exclusive property of KindHero or its licensors. This Agreement does not signify a transfer of ownership, but only grants a right to use.
We respect the creation of non-commercial secondary creations (e.g., fan art, videos). However:
All ownership and rights to the original materials (characters, logos, sounds, etc.) remain vested in KindHero.
You may not use secondary creations commercially or distribute them in a manner that could be mistaken for official content.
Any commercial use requires a prior written approval process from KindHero.
III. Code of Conduct
You agree not to engage in any of the following actions:
Any act that is illegal, fraudulent, threatening, or defamatory.
Transmitting content that is obscene, hateful, violent, or otherwise offensive.
Using malicious code, viruses, hacking tools, cheats, bots, or macros.
Exploiting bugs or glitches for an unfair advantage.
Placing an excessive load on the servers or disrupting the operation of the Game.
Unauthorized collection or use of other users' accounts or personal information.
If you violate any of the above, we may take action, including but not limited to account limitation, suspension, or termination, without prior notice. If necessary, we may also pursue legal action for such violations.
IV. Third-Party Services
The Game may be provided through third-party platforms, such as Steam. Your use of such platforms is subject to their separate terms of service and privacy policies. KindHero is not responsible for any damages arising from the policies, errors, failures, or service interruptions of these third-party platforms.
Steam Refund Policy: For Games purchased or registered through Steam, Valve's refund policy shall take precedence. KindHero assumes no obligation for refunds beyond what is permitted by the Steam Refund Policy.
V. Disclaimer of Warranties
The Game is provided free of charge on an "AS IS" and "AS AVAILABLE" basis. KindHero makes no warranties, express or implied, regarding the following:
The integrity, stability, security, or absence of errors or bugs in the Game.
Fitness for a particular purpose, merchantability, or non-infringement.
The continuous or uninterrupted operation of the service.
Some jurisdictions do not allow the exclusion of implied warranties. In such cases, this provision will be applied only to the extent limited by relevant consumer protection laws.
VI. Limitation of Liability (Developer Protection Enhanced Version)
The Game is provided free of charge, and the User assumes all risks associated with its use or inability to use.
To the maximum extent permitted by applicable law, KindHero and its employees, agents, and partners shall not be liable for:
Any indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use the Game (including but not limited to loss of data, account damage, loss of profits, business interruption, or loss of goodwill).
Damages resulting from game errors, bugs, server maintenance, network failures, or security vulnerabilities.
Damages resulting from the failures, interruptions, or policy changes of third-party services (such as Steam).
Damages resulting from the User's negligence in managing their device, environment, or security.
KindHero shall not be liable for any form of damages unless such damages arise from KindHero's willful misconduct or gross negligence. In any case, KindHero's liability will only be recognized to the extent permitted by applicable law and shall not exceed the disclaimers and limitations set forth in this Agreement.
VII. Termination
This Agreement is effective until terminated by you or KindHero.
KindHero may immediately terminate or restrict your access to the Game without prior notice if:
You are in material breach of this Agreement.
A security threat, fraudulent activity, or illegal act is detected.
However, for non-urgent matters, we may notify you of the reason after the termination or restriction.
Upon termination, the License granted in Section I will immediately end, and you must cease all use of the Game and delete all copies.
VIII. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Korea.
You agree that the Seoul Central District Court shall have exclusive first-instance jurisdiction over any disputes arising in connection with this Agreement or the Game.
IX. Miscellaneous
Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: This Agreement constitutes the entire agreement between you and KindHero regarding the Game and supersedes all prior oral or written agreements.
Waiver: The failure of KindHero to exercise any right under this Agreement shall not be deemed a waiver of that right.
