END USER LICENSE AGREEMENT (EULA)

AGREEMENT TO TERMS
By installing, accessing, or using FlashBoss ("the Software"), you agree to be bound by this End User License Agreement. If you do not agree, do not use the Software.
1. LICENSE GRANT
Odiin grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Software for personal, educational purposes
- Use the Software on devices you own or control
You MAY NOT:
- Modify, reverse engineer, decompile, or disassemble the Software
- Distribute, sell, rent, lease, or sublicense the Software
- Remove or alter any copyright, trademark, or proprietary notices
- Use the Software for commercial training purposes without permission
- Share your copy with others
2. OWNERSHIP
The Software, including all code, graphics, content, and flashcard data, is owned by Odiin and protected by copyright laws. This license does not grant you ownership - only the right to use it.
"The Software" includes the base game and any downloadable content (DLC) or additional vocabulary packs purchased separately. All DLC is subject to the same terms and conditions as the base game.
3. USER-GENERATED CONTENT
If you create custom flashcard decks within the Software:
- You retain ownership of your content
- You grant Odiin permission to store this data locally on your device
- We do not claim ownership of your custom flashcards
4. NO WARRANTY / EDUCATIONAL USE ONLY
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
We make no guarantees about:
- Educational effectiveness or learning outcomes
- Accuracy of flashcard content or translations
- Uninterrupted or error-free operation
- Compatibility with future systems
USE OF THIS SOFTWARE DOES NOT GUARANTEE:
- Language proficiency
- Exam success
- Skill mastery in any subject
This is a study tool. You are responsible for verifying information and supplementing your learning.
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Odiin SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Damages resulting from use or inability to use the Software
- Any educational outcomes or lack thereof
MAXIMUM LIABILITY: The amount you paid for the Software.
6. CONSUMER RIGHTS (EU/GERMANY)
IMPORTANT: Nothing in this Agreement shall limit or exclude any statutory rights you may have under applicable consumer protection laws, including but not limited to:
- The right of withdrawal under EU Directive 2011/83/EU (subject to exceptions for digital content)
- Statutory warranty rights under German law (BGB)
- Any other mandatory consumer protections that cannot be waived by contract
By purchasing and downloading the Software, you acknowledge that you may lose your right of withdrawal once the download begins, in accordance with Article 16(m) of EU Directive 2011/83/EU, provided you have given prior express consent.
Your statutory rights remain unaffected.
7. UPDATES AND CHANGES
We may update the Software and this EULA at any time. Continued use after updates constitutes acceptance of changes.
Updates may:
- Add features
- Fix bugs
- Modify content
- Change functionality
You are not entitled to any specific features or updates.
8. TERMINATION
This license is effective until terminated.
It terminates automatically if you:
- Violate any term of this Agreement
- Distribute the Software without permission
- Attempt to crack or circumvent protections
Upon termination, you must delete all copies of the Software.
9. REFUNDS (STEAM PURCHASES)
Refunds for Steam purchases are governed by Steam's refund policy:
- Available within 14 days of purchase
- If played less than 2 hours
- Subject to Steam's discretion
We do not process refunds directly - contact Steam Support.
10. PRIVACY / DATA COLLECTION
FlashBoss:
- Stores your progress and flashcard data LOCALLY on your device
- Does NOT collect or transmit personal information
- Does NOT require an account or internet connection
- May collect anonymous usage statistics through Steam (if enabled by you)

11. THIRD-PARTY SOFTWARE
FlashBoss includes the following open-source components for text-to-speech functionality:
Piper TTS - MIT License - github.com/rhasspy/piper
eSpeak-ng - GPL v3 - github.com/espeak-ng/espeak-ng
ONNX Runtime - MIT License - github.com/microsoft/onnxruntime
Thorsten Voice - CC0 (Public Domain) - github.com/thorstenMueller/Thorsten-Voice
GPL v3 Compliance: eSpeak-ng is distributed under the GNU General Public License v3. The complete source code is available at the repository listed above. In accordance with GPL v3, you may obtain a copy of the source code from that URL. This offer remains valid for at least three years from your receipt of this Software.
Full license texts are included with the Software in THIRD_PARTY_NOTICES.txt.
12. THIRD-PARTY CONTENT
Flashcard content may include:
- Words, phrases, and definitions from public domain sources
- Licensed or fair-use educational materials
- User-generated content (if sharing features exist)

13. CHARACTER DISCLAIMER
The character "Master Claude" appearing in this Software is an original fictional creation and artistic tribute. This character is not affiliated with, endorsed by, or representative of Anthropic, PBC or their Claude AI assistant product. The character exists as a self-portrait celebrating the AI collaboration that helped create FlashBoss.
14. GOVERNING LAW
This Agreement is governed by the laws of the Federal Republic of Germany, without regard to conflict of law provisions.
For consumers residing in the EU, you may also benefit from mandatory provisions of the law of your country of residence.
Disputes shall be resolved in the courts of Germany, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
15. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and Odiin regarding the Software.
