This End User License Agreement and Terms of Service ("Agreement") is a legal agreement between you ("User", "you") and Wizirdi ("Developer", "we", "our", or "us") governing your use of Heartlands, including the game software, online services, account features, creation tools, websites, and any related services (collectively, the "Software").

By installing, accessing, playing, or using the Software, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install, access, play, or use the Software.

Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Software for personal entertainment and creative purposes.

Purchasing, downloading, or accessing Heartlands gives you a license to install and play the Software as allowed by this Agreement. It does not transfer ownership of the Software, source code, artwork, music, branding, characters, systems, or other intellectual property to you.

You agree that you will not:

• Copy, modify, distribute, sell, lease, sublicense, or transfer the Software except as allowed by law or expressly permitted by us.
  
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Software except where allowed by law.
  
• Use the Software for unlawful, harmful, abusive, or fraudulent purposes.
  
• Circumvent, disable, or interfere with security features of the Software.
  
• Use bots, automation tools, scripts, cheats, hacks, exploits, or unauthorized third-party software.
  
• Use automated systems to interfere with the operation of the Software, servers, accounts, or online features.
  
• Exploit bugs, glitches, or unintended systems in a way that harms the Software, other users, or the online experience.
  
• Impersonate another user, staff member, moderator, developer, or any other person or entity.

Heartlands may create, use, or link an account for online features, including by using your Steam account information or SteamID where supported.

You are responsible for your account and for activity that occurs through your account. You agree not to share your login details, attempt to access another user's account, impersonate others, or use account features in a misleading or abusive way.

The Software may rely on Steam or other third-party platforms for authentication, account linking, purchases, networking, or online services. Your use of those platforms is subject to their own terms and agreements.

All rights, title, and interest in and to the Software, including all copyrights, trademarks, trade secrets, artwork, music, sound effects, characters, branding, source code, game systems, and other intellectual property rights, are owned by us or our licensors.

This Agreement does not grant you any ownership rights in the Software or any part of the Software.

Heartlands allows users to create, upload, draw, import, edit, or share custom content including artwork, characters, images, audio, music, sound effects, text, designs, and other media ("User Content").

You retain ownership of any original User Content you create.

By creating, editing, uploading, importing, or sharing User Content through the Software, you represent and warrant that:

• The content is your original work, or you have the legal right to use and upload it.
  
• Your content does not violate the copyrights, trademarks, intellectual property rights, privacy rights, publicity rights, or other rights of any third party.
  
• Your content does not contain illegal, harmful, hateful, sexually explicit, abusive, threatening, or otherwise inappropriate material.
  
• Your content does not contain copyrighted material, trademarks, logos, characters, music, artwork, or other third-party content unless you have permission to use it.

By uploading, creating, importing, or sharing User Content through the Software, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, display, distribute, transmit, and make your User Content available for the purpose of operating, providing, improving, promoting, and supporting the Software and its online features.

We do not claim ownership of your original User Content. Users are solely responsible for the content they create, upload, import, or share.

We do not review all User Content. We reserve the right, but are not obligated, to remove, hide, restrict, or disable access to any User Content that violates this Agreement, violates applicable law, or is otherwise harmful to the Software or its community.

Access to Heartlands' online multiplayer servers, account systems, creation tools, and community features is a privilege, not a right.

You agree that you will not:

• Harass, bully, threaten, abuse, target, or attack other users.
  
• Use hate speech, hateful symbols, slurs, or discriminatory content.
  
• Troll, grief, spam, or intentionally disrupt gameplay or online spaces.
  
• Upload or share NSFW, sexually explicit, illegal, harmful, hateful, or offensive content.
  
• Upload or share copyrighted material, trademarks, logos, characters, music, artwork, or other third-party content without permission.
  
• Cheat, hack, exploit bugs, manipulate the network, or use unauthorized third-party software.
  
• Use bots, automation tools, or scripts to interact with the Software in an unfair or disruptive way.
  
• Attempt to damage, overload, disrupt, or gain unauthorized access to the Software, servers, accounts, or systems.

We may remove User Content, restrict access to online features, suspend accounts, permanently ban accounts, or take other enforcement action if we believe this Agreement has been violated.

Enforcement may occur with or without prior notice. Where permitted by law, account suspensions, bans, content removals, or loss of online access may occur without refund.

The Software may integrate with and rely on third-party platforms, including Steam, for authentication, account linking, distribution, purchases, networking, and online services.

Your use of third-party platforms is subject to their respective terms, policies, and agreements. We are not responsible or liable for third-party platform downtime, account suspensions, data practices, service changes, or other issues arising from your use of third-party services.

We may release updates, patches, hotfixes, or new versions of the Software at any time. These updates may be required to continue using the Software or its online features.

We reserve the right to modify, suspend, limit, or discontinue the Software, servers, online features, account systems, user-created content features, or any part of the Software at any time.

Your use of the Software may involve the collection of certain technical, account, gameplay, or online information necessary to operate and provide the Software and its features.

This Agreement remains in effect until terminated.

We may terminate or suspend your license, account access, or access to online features if you violate this Agreement or misuse the Software.

Upon termination, you must stop using the Software.

The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We do not guarantee that the Software, servers, account features, online features, or user-created content features will be uninterrupted, error-free, secure, or available at all times.

To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of or inability to use the Software.

This includes damages related to loss of data, loss of account access, loss of user-created content, service interruptions, online access restrictions, or enforcement actions, except where liability cannot be excluded under applicable law.

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles.

We may update this Agreement from time to time. Continued use of the Software after changes are posted or made available constitutes acceptance of the revised Agreement.
