YOU SHOULD CAREFULLY READ THIS END USER LICENSE AGREEMENT (“AGREEMENT”) BEFORE DOWNLOADING, INSTALLING, ACCESSING, OR PLAYING ALMANAC: AI DETECTIVE SIMULATION OR ANY RELATED SOFTWARE, CONTENT, OR SERVICES (COLLECTIVELY, THE “GAME”). THIS AGREEMENT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS. BY DOWNLOADING, INSTALLING, ACCESSING, OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY ALL TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT (AND YOU ARE NOT PERMITTED TO) DOWNLOAD, INSTALL, ACCESS, OR PLAY THE GAME.
This Agreement is between you and Bergamot Games Inc., a company organized under the laws of British Columbia, Canada (“Bergamot Games,” “Company,” “we,” or “us”).

By installing, accessing, or using the Game, you confirm you have read this Agreement, the Terms of Service, and the Privacy Policy and agree to all of them. If you do not accept the Terms of Service and Privacy Policy, do not install or use the Game.
STATUTORY RIGHTS PRESERVED
Nothing in this Agreement is intended to exclude, restrict, or modify rights that cannot be excluded, restricted, or modified under applicable law (including consumer protection laws in the EEA, United Kingdom, Switzerland, Australia, New Zealand, and other jurisdictions). To the extent of any conflict between this Agreement and such non-excludable rights, those rights prevail.
PHOTO-SENSITIVITY WARNING (EPILEPSY/FLASHING LIGHTS)
A small percentage of individuals may experience seizures, blackouts, or other symptoms when exposed to certain visual images, including flashing lights or patterns. If you experience blackouts, seizures, dizziness, altered vision, eye or muscle twitches, jerking or shaking, loss of awareness, disorientation, confusion, involuntary movements, or convulsions, stop playing immediately and consult a physician before resuming. Parents should monitor children and stop use if any symptoms occur.
HEALTH AND SAFETY GUIDANCE
Take frequent breaks (every 10–15 minutes recommended during intensive sessions). Stop playing if you feel nausea, dizziness, fatigue, headache, eye strain, or disorientation. Do not play when overly tired, under the influence of drugs or alcohol, or while using medications that may affect perception or coordination. Adjust screen brightness and volume to comfortable levels and be mindful of your surroundings.
LIMITED LICENSE; OWNERSHIP
1.1 License Grant. Subject to your compliance with this Agreement, Bergamot Games grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game for your personal, non-commercial entertainment use on a compatible device you own or control.
1.2 No Sale. The Game is licensed, not sold. This Agreement does not convey any ownership interest in the Game.
1.3 Ownership. Bergamot Games and its licensors own all right, title, and interest in and to the Game and all related intellectual property, including code, art, audio, dialogue, stories, characters, locations, UI, visual effects, music, text, documentation, and all updates and patches. Almanac: AI Detective Simulation™ and Bergamot Games™ are trademarks of Bergamot Games Inc. All other trademarks are the property of their respective owners.
ACCOUNTS, PLATFORMS, AND THIRD-PARTY SERVICES
2.1 Platform Accounts. Access to or use of the Game may require an account with a third-party platform (e.g., Steam) and your compliance with that platform’s terms, policies, and community guidelines. Bergamot Games is not responsible for platform services, networks, or outages. Refunds are governed by the platform’s policies where applicable.
2.2 Third-Party Technology. The Game may include or interoperate with third-party software, middleware, engines, or online services. Your use of third-party components may be subject to additional licenses and terms.
CONTENT, USER CONDUCT, AND COMMUNITY STANDARDS
3.1 Prohibited Conduct. You will not, and will not help others to:
(a) copy, reproduce, distribute, publicly display, sell, rent, lease, sublicense, or otherwise transfer the Game except as expressly permitted;
(b) modify, translate, adapt, reverse engineer, decompile, disassemble, or create derivative works of the Game, except to the extent such restriction is prohibited by applicable law;
(c) remove, disable, bypass, or circumvent any security, rights-management, anti-cheat, or access-control measures;
(d) use cheats, hacks, bots, automation, exploits, or any unauthorized third-party tools that alter gameplay or give unfair advantage;
(e) use the Game for commercial, broadcast, public performance, or competitive events without express written permission from Bergamot Games;
(f) upload or distribute content that is illegal, infringing, defamatory, obscene, hateful, harassing, exploitative, or otherwise violates rights or laws;
(g) impersonate any person or entity or misrepresent your affiliation;
(h) interfere with or disrupt servers, networks, or services connected to the Game or impose an unreasonable load on infrastructure;
(i) buy, sell, trade, or transfer accounts, keys, or entitlements outside authorized channels.
3.2 Streaming and UGC Policy. You may capture, stream, or share gameplay footage, screenshots, and commentary for non-commercial purposes, provided you do not (a) redistribute game assets as a substitute for the Game; (b) use content to promote hate, illegal activity, or infringement; or (c) misrepresent affiliation or endorsement. Monetized content via typical creator-platform ad revenue and tips is generally permitted, subject to this Agreement and platform rules.
USER-GENERATED CONTENT AND LICENSE TO COMPANY
4.1 UGC. If the Game allows you to submit, post, record, or create content (including text, voice, images, or other materials) (“User Content”), you grant Bergamot Games a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, host, store, reproduce, modify, adapt, translate, create derivative works from, publish, perform, display, and distribute such User Content for operation, safety, moderation, analytics, and improvement of the Game and related services.
4.2 Responsibility. You are solely responsible for your User Content. Do not include personal data or confidential information you do not wish to be processed or disclosed as described in the Privacy Policy. We may remove or disable access to User Content that we deem violates this Agreement or applicable law.
AI-GENERATED CONTENT AND LIMITATIONS
5.1 AI Features. Some features may use artificial intelligence to generate or transform text, dialogue, or other content (“AI Output”). AI Output is automatically produced and may be inaccurate, incomplete, offensive, or otherwise unsuitable.
5.2 No Reliance. You agree not to rely on AI Output for real-world advice, safety, medical, legal, or financial decisions. To the fullest extent permitted by law, Bergamot Games disclaims liability for harms arising from reliance on AI Output.
DATA, TELEMETRY, AND PRIVACY
6.1 Privacy Policy. Your use of the Game is subject to our Privacy Policy (see URL above). By using the Game, you consent to data processing as described therein, including gameplay telemetry, crash/error logs, and in-game communications for safety and moderation purposes.
6.2 Cross-Border Transfers. Data may be processed in countries outside your residence. We take steps consistent with applicable law to protect personal data during such transfers.
6.3 Monitoring. You understand that in-game communications and User Content may be logged or monitored for safety, moderation, troubleshooting, and compliance.
UPDATES, PATCHES, AND SERVICE CHANGES
7.1 Updates. We may deploy updates, patches, fixes, or modifications (“Updates”). Updates may add, remove, or change features or content. Continued use after an Update constitutes acceptance of the updated Game.
7.2 Service Changes. Subject to non-excludable consumer rights, we may change, suspend, or discontinue all or part of the Game at any time without liability.
VIRTUAL CURRENCY AND IN-GAME ITEMS (IF PRESENT)
8.1 License Only. Any virtual currency or in-game items (collectively, “Virtual Items”) are licensed to you on a limited, revocable basis for use solely in the Game. Virtual Items have no real-world monetary value and are not redeemable for any sum of money or property.
8.2 No Transfers. You may not purchase, sell, trade, or transfer Virtual Items outside authorized channels. We do not recognize transfers outside the Game or platform settings.
FEEDBACK
If you provide suggestions, ideas, or feedback regarding the Game, you grant Bergamot Games an unrestricted, perpetual, irrevocable, worldwide, royalty-free license to use and exploit such feedback for any purpose without obligation to you.
MINORS
If you are a minor under applicable local law, you may use the Game only with consent and supervision of a parent or legal guardian who agrees to this Agreement on your behalf. Parents and guardians are responsible for a minor’s use.
TERMINATION
11.1 By You. You may terminate this Agreement at any time by uninstalling and deleting the Game and all related files from your devices.
11.2 By Company. We may terminate this Agreement and your license immediately if you breach this Agreement or engage in prohibited conduct. Upon termination, you must cease all use and delete all copies of the Game.
11.3 Survival. Sections 1.3, 3–5, 6, 7, 8, 9, 11.3, 12–17 survive termination.
WARRANTY DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, AND WITHOUT WARRANTY AS TO UNINTERRUPTED OR ERROR-FREE OPERATION OR COMPATIBILITY WITH ALL HARDWARE OR SOFTWARE.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERGAMOT GAMES INC. AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE GAME OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE GAME, IF ANY, IN THE 30 DAYS PRECEDING THE CLAIM. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
INDEMNITY
To the extent permitted by law, you agree to indemnify and hold harmless Bergamot Games Inc., its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of this Agreement; (b) your User Content; or (c) your misuse of the Game.
EXPORT CONTROL AND SANCTIONS
You represent that you are not located in, under the control of, or a national or resident of any country or jurisdiction subject to embargoes or sanctions and are not on any restricted party list. You agree to comply with all applicable export control and sanctions laws in connection with your use of the Game.
GOVERNING LAW; FORUM
This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree that the courts located in Vancouver, British Columbia, Canada, will have exclusive jurisdiction over any dispute arising out of or relating to this Agreement or the Game, and you consent to personal jurisdiction in those courts. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
MISCELLANEOUS
17.1 Entire Agreement. This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Bergamot Games regarding the Game and supersedes any prior agreements regarding the subject matter.
17.2 Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.
17.3 No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
17.4 Assignment. You may not assign this Agreement. We may assign this Agreement, in whole or in part, with or without notice.
17.5 Language. The parties have expressly requested that this Agreement and all related documents be drawn up in English. Les parties ont expressément exigé que le présent contrat et tous les documents qui s’y rattachent soient rédigés en anglais.
