End User License Agreement (EULA) for the Mittweida University of Applied Sciences project game

1. Contracting Parties

This End User License Agreement (“EULA”) is concluded between:
Mittweida University of Applied Sciences Technikumplatz 17, 09648 Mittweida (hereinafter referred to as “Licensor”)
and the person who installs, starts, or uses the game (hereinafter referred to as “Licensee”).
Note on minimum age: The game is approved for users aged 12 and above. Users under the age of 12 may only use the game with the consent of a parent or legal guardian. By using the game, the licensee or their legal representative confirms that these conditions are met.

2. Scope

This EULA governs the rights and obligations of the licensee when using the game and the online services, in particular the level editor.
Use of the game requires express acceptance of this EULA.

3. Grant of License

  • The Licensor grants the Licensee a non-exclusive, non-transferable, perpetual right to use the game for private, non-commercial purposes.
  • Any other use, in particular commercial exploitation, public performance, sale, or distribution, is prohibited unless expressly authorized in writing by the Licensor.
  • The game, all levels, graphics, sounds, and source code remain the property of the Licensor.

4. Use of the level editor / user-generated content

  • The licensee may create their own content (levels, maps, mods) and save or share it in the game.
  • By uploading, saving, or sharing user-generated content, the licensee grants the licensor a free, worldwide, non-exclusive license for the duration of storage to store, reproduce, adapt (to the extent technically necessary for display or compatibility) and make this content available to other users of the game within the game.
  • The licensee confirms that they have all necessary rights to the uploaded content and that this content does not infringe on the rights of third parties.
  • It is strictly prohibited to create or distribute content that:
    • violates applicable law
    • is anti-constitutional, extremist, racist, pornographic, or offensive
    • infringes on the rights of third parties
  • The licensor reserves the right to delete or block content that violates these rules without prior notice.
  • The licensee assumes sole responsibility for the legality of content created by users.

5. Copyright notice and reporting of infringements

Mittweida University of Applied Sciences respects the rights of third parties. Suspected copyright infringements or other legal violations by user-generated content can be reported at http://mailto:beta@hs-mittweida.de. Reports will be processed promptly in accordance with legal provisions (in particular §§ 512 ff. UrhG).

6. Obligations of the Licensee

  • The Licensee undertakes not to perform any actions that jeopardize the security, stability, or functionality of the game or the servers (e.g., hacking, exploits).
  • Any transfer of the user account or access data to third parties is prohibited.
  • The licensee is required to report illegal content or security issues immediately.

7. Liability and warranty

  • The licensor shall be liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, limb, or health.
  • In cases of slight negligence, the licensor shall only be liable for the breach of essential contractual obligations (cardinal obligations). Liability shall be limited to foreseeable damage typical for this type of contract.
  • Liability for indirect damage, loss of profit, loss of data, and loss of use is excluded to the extent permitted by law. This does not apply in cases of intent or gross negligence.
  • The game is provided as part of an educational project by the university, as is and in the condition in which it is available. There is no guarantee that it is free of errors, complete, or continuously available.

8. Data protection

Personal data is processed exclusively in accordance with the privacy policy. Use of the game requires acknowledgment of this privacy policy.

9. Relationship to Steam

This EULA supplements the terms of use of Valve Corporation (“Steam Subscriber Agreement” and “Steamworks Documentation”). In the event of any conflict between this EULA and the Steam terms, the provisions of the Steam Subscriber Agreement shall apply, unless mandatory German law provides otherwise.
Note: This EULA is displayed when the game is first launched and must be accepted in order to use the game.

10. Updates and Changes

  • The Licensor is entitled to update the game at any time, change or remove features.
  • Changes to this EULA that are not purely editorial in nature will be communicated to the licensee at least 4 weeks before they come into effect via a notice in the game or on the project website.
  • If the licensee does not object to the amended EULA by uninstalling the game or sending a written objection by email within the specified period, the amendment shall be deemed to have been accepted.
  • In the event of significant changes to this EULA to the detriment of the Licensee, the Licensee has the right to terminate the contract extraordinarily. Notice of termination must be given within the period specified in paragraph 2.

11. Term and Termination

  • The EULA shall become effective upon acceptance by the Licensee and shall remain in effect indefinitely.
  • The licensee may terminate the license at any time by uninstalling the game and deleting all local copies.
  • The licensor may revoke the license immediately in the event of a breach of this EULA.

12. Final provisions

  • Should individual provisions of this EULA be invalid, the validity of the remaining provisions shall remain unaffected.
  • German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the licensee is a consumer with habitual residence in another EU/EEA country, the mandatory consumer protection provisions of that country shall remain unaffected.
  • The place of jurisdiction for all disputes arising from or in connection with this contract is, to the extent permitted by law, the registered office of the licensor. The licensor is also entitled to sue the licensee at the licensee's general place of jurisdiction.
