TOMOJAM™ – END USER LICENSE AGREEMENT

By installing or playing TomoJam™ ("the Game"), you agree to the following terms with Restless Games ("the Developer"). If you do not agree, do not install or use the Game.
1. LICENSE
You are granted a personal, non-exclusive, non-transferable license to install and play the Game for your own entertainment. You do not own the Game or its contents; you are only licensed to use it.
2. RESTRICTIONS
You may not:
Reverse-engineer, decompile, or modify the Game.
Distribute, sell, or sublicense the Game or any of its files without written permission from the Developer.
Use cheats, hacks, or network tools to alter how the Game functions.
3. CUSTOM AND PEER-SHARED MIDI FILES
The Game allows players to import and use their own MIDI files for gameplay.
Users are solely responsible for any MIDI files they import, create, download, or use within the Game.
The Developer does not host, provide, or distribute any copyrighted MIDI content.
During online play, MIDI files may be shared directly between players via peer-to-peer (P2P) connections to enable synchronized gameplay. These transfers are temporary and are not hosted by the Developer.
MIDI files received through P2P gameplay may be stored locally on your device (for example, in a “Custom MIDIs” folder). You are responsible for ensuring that any files you keep or use comply with copyright law.
The Developer is not responsible or liable for any user-imported or peer-shared content, or for any legal claims arising from such content.
4. OWNERSHIP
All code, design, artwork, sound, and original content included with the Game are the exclusive property of Restless Games.
TomoJam™ and the TomoJam™ logo are trademarks of Restless Games.
You do not gain ownership of these materials by installing or playing the Game.
5. DISCLAIMER OF WARRANTIES
The Game is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Developer does not guarantee that the Game will be free of errors or compatible with all systems.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Developer shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the Game, including but not limited to data loss, performance issues, or claims related to user-generated or shared content.
7. TERMINATION
You may terminate this Agreement at any time by uninstalling and deleting all copies of the Game.
The Developer may terminate this Agreement if you violate its terms. Upon termination, your license to use the Game will immediately end.
8. GOVERNING LAW
This Agreement is governed by and construed in accordance with the laws of Canada and the Province of British Columbia, without regard to conflict-of-laws principles.
