Language Notice: The legally binding version of this Agreement is the German original (EULA – Deutsche Fassung). This English translation is provided for convenience only. In the event of any conflict or ambiguity between the English translation and the German original, the German version shall prevail.

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and the developer ("Licensor") regarding your use of the Tiltility™ software application ("Tiltility Application").

Tiltility is developed and maintained by a PhD-qualified computer scientist based in Germany, specializing in AI-supported multimodal human-computer interaction. The software is designed for entertainment purposes, primarily for gamers seeking immersive input experiences through body tilt and hand gesture recognition.

By installing, accessing, or using the Tiltility Application, you agree to be bound by the terms of this Agreement.

1. Grant of License

Subject to your compliance with this Agreement, Licensor grants you a non-exclusive, non-transferable, revocable license to install and use the Tiltility Application:

  • On supported versions of Windows 10 and Windows 11
  • For personal, non-commercial entertainment use only
  • On devices owned or controlled by you

This license is valid for the lifetime of the supported operating system (Windows 10/11) as defined by Microsoft. When a new Windows OS is released, a new version of Tiltility may be required and must be purchased separately.

This license applies regardless of whether the Tiltility Application was obtained via Steam, Microsoft Store, Paddle, or directly from the developer’s website.

2. Restrictions

You may not:

  • Use the Tiltility Application for professional, industrial, medical, or high-risk purposes
  • Use it in any context where failure could result in injury, environmental damage, or financial loss (e.g. gambling, trading, or other high-stakes activities)
  • Use the Tiltility Application for general-purpose computer control or automation
  • Copy, modify, or create derivative works of the Tiltility Application
  • Resell, rent, lease, sublicense, or distribute the Tiltility Application to third parties
  • Reverse engineer, decompile, disassemble, or attempt to access the source code, except as permitted by law
  • Use the Tiltility Application to train machine learning models or extract biometric data for profiling
  • Circumvent licensing, payment, or usage restrictions

3. Ownership

The Tiltility Application is licensed, not sold. All intellectual property rights remain with the Licensor. You may not claim ownership or authorship of any part of the software.

Tiltility includes third-party software components that are licensed by their respective copyright owners. Full third-party notices and license texts are available at Third-party Licenses .

In particular, when the user selects FFmpeg processing instead of OpenCV processing, the application uses FFmpeg libraries licensed under the GNU Lesser General Public License version 2.1 or later (LGPL v2.1+). The Licensor does not own FFmpeg. FFmpeg copyright ownership remains with the respective FFmpeg authors and contributors, as identified by the FFmpeg project and in the third-party notices.

4. Updates and Support

Licensor may provide updates, bug fixes, or enhancements at their discretion. Updates are provided only for Windows 10 and Windows 11 during their supported lifetimes. No guarantee is made for future compatibility with other operating systems.

5. Platform-Specific Terms

Purchases made via Steam or Microsoft Store are subject to the respective platform’s terms of service, refund policies, and activation mechanisms. The developer does not override or control these terms.

Platform-specific versions may include activation mechanisms, DRM, or usage restrictions governed by the respective store’s infrastructure.

Purchases made via Paddle are processed by Paddle.com Market Ltd, which acts as the Merchant of Record. Paddle’s privacy policy and terms apply to payment processing.

6. Emulated Input and User Responsibility

Tiltility may emulate keyboard input to translate detected body tilts and hand gestures into in-game actions. This emulated input may be treated by certain games, online services, or anti-cheat systems as third-party or automated input, and may be restricted or prohibited by the respective game publisher or service operator.

You are solely responsible for verifying that your use of Tiltility's input emulation features complies with the terms of service, end-user license agreement, and anti-cheat policies of any game or online service you use in conjunction with the Tiltility Application.

The Licensor makes no representation or warranty that emulated input will be accepted, tolerated, or permitted by any game, platform, or anti-cheat system. The Licensor shall not be liable for any bans, suspensions, account actions, loss of in-game progress, or other consequences arising from your use of the Tiltility Application's emulation features.

7. Disclaimer of Warranty

The Tiltility Application is provided "as is" without warranty of any kind. Licensor disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, non-infringement, and uninterrupted operation.

8. Limitation of Liability

To the extent permitted by law, Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or financial outcomes arising from your use of the Tiltility Application.

9. Termination

This Agreement is effective until terminated. It will terminate automatically if you breach any term. Upon termination, you must uninstall and cease all use of the Tiltility Application.

10. Governing Law

This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Appendix 1: Service Description

A. Purpose and Intended Use

Tiltility is a software application designed for entertainment purposes, primarily in gaming contexts. It enhances immersion by allowing users to control in-game actions through body movement and hand gestures.

Tiltility is not intended for general-purpose computer control, professional use, or high-risk environments. It must not be used in medical, industrial, financial, or safety-critical applications.

B. Core Features

Tiltility Standard

  • Detects subtle left/right body tilts using a webcam or depth camera
  • Maps tilt gestures to keyboard inputs (e.g. lean left/right in games)
  • Designed to simulate natural movement for immersive gameplay
  • Recognizes foundational hand gestures including a fist and finger-count gestures from one through five for custom mappings

Handy Edition DLC

  • Unlocks six additional expressive hand gestures for gaming and creative control
  • Adds the following gestures: Thumbs Up, Thumbs Down, I Love You, Rock 'n' Roll, Okay, Call Me
  • Each gesture can be mapped to keyboard or in-game actions

Middle Finger Unlock DLC

  • Adds the middle finger gesture for mature users who need an extra level of expression
  • Gesture can be mapped to any supported action

C. Supported Environments

D. Limitations

  • Tiltility does not guarantee compatibility with all games or input configurations
  • The software is not designed to replace accessibility tools or medical interfaces

E. Versioning and Updates

  • Updates are provided for Windows 10/11 during their supported lifetimes
  • New versions may be required for future operating systems and must be purchased separately

B. License Type

  • Tiltility Standard: Includes tilt detection, keyboard binding functionality, and baseline hand gestures (fist and counting gestures one through five).
  • Handy Edition DLC: Optional upgrade that unlocks six additional hand gestures (Thumbs Up, Thumbs Down, I Love You, Rock 'n' Roll, Okay, Call Me).
  • Middle Finger Unlock DLC: Optional upgrade that adds the middle finger gesture for mature users.

Each license is:

  • Single-purchase (no subscription)
  • Bound to the supported Windows OS generation
  • Non-transferable and non-commercial

C. Platform-Specific Terms

  • Steam and Microsoft Store: Licensing, activation, and refund policies are governed by the respective platform’s terms of service. The developer does not override these terms.
  • Paddle: Paddle.com Market Ltd acts as the Merchant of Record for direct purchases. Their privacy policy and terms apply to payment processing.

D. Technical Requirements

  • A compatible webcam or depth camera may be required for gesture recognition.
  • Internet access may be required for activation, updates, or platform-specific features.
  • Depending on user-selected processing mode, Tiltility may use either OpenCV or FFmpeg components.

E. End of Life and Upgrade Policy

  • Tiltility licenses are valid for the lifetime of Windows 10 or Windows 11, as defined by Microsoft.
  • When a new Windows OS is released, a new version of Tiltility may be required and must be purchased separately.
