END USER LICENSE AGREEMENT (EULA) FOR Between These Two
By installing or using Between These Two, you agree to the terms of this Agreement.
LICENSE GRANT
Mihai Calarasanu grants you a single, non-exclusive, non-transferable, and limited personal license to install and use Between These Two.
RESTRICTIONS
You may not copy, distribute, sell, rent, lease, sublicense, or otherwise transfer Between These Two without permission from Mihai Calarasanu.
You may not modify, decompile, disassemble, or reverse engineer Between These Two, except where expressly permitted by applicable law.
You may not create derivative works based on Between These Two or its content without permission from Mihai Calarasanu.
You may not remove or alter any copyright or proprietary notices contained within Between These Two.
You may not use Between These Two or its content to create a competing product or a copy of Between These Two, including but not limited to assets, designs, artwork, audio, characters, environments, gameplay systems, logos, or other original content.
You may not extract, rip, copy, redistribute, sell, sublicense, or separately use any assets, files, artwork, audio, music, characters, environments, logos, or other content from Between These Two without permission from Mihai Calarasanu.
OWNERSHIP
All rights to Between These Two and its original content, including but not limited to code, artwork, audio, characters, environments, gameplay systems, logos, and other original content, are owned by Mihai Calarasanu.
Between These Two may include third-party licensed assets, software, audio, visual content, fonts, or other materials used under valid licenses. All rights to such third-party content remain the property of their respective owners.
GAMEPLAY VIDEOS AND STREAMING
You are allowed to create, publish, livestream, and monetize gameplay videos, screenshots, reviews, commentary, and other similar content featuring Between These Two.
This permission does not allow you to extract, copy, redistribute, sell, sublicense, or separately use any assets, files, artwork, audio, music, characters, environments, logos, or other content from Between These Two.
UPDATES AND CHANGES
Mihai Calarasanu reserves the right to update, modify, suspend, or discontinue Between These Two or any part of it at any time without prior notice.
HEALTH AND SAFETY WARNING
Between These Two is a horror game and may contain flashing lights, sudden visual effects, loud sounds, jump scares, or other intense content. These elements may not be suitable for all players and may cause discomfort or other reactions in some individuals.
If you experience dizziness, eye strain, nausea, seizures, loss of awareness, or any other discomfort while playing Between These Two, you should stop playing immediately and seek medical advice if necessary.
You play Between These Two at your own risk, to the maximum extent permitted by applicable law.
DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Between These Two is provided “as is” and “as available,” with all faults and without warranty of any kind. Mihai Calarasanu does not warrant that Between These Two will function without errors, bugs, crashes, interruptions, loss of progress, compatibility issues, or other issues.
To the maximum extent permitted by applicable law, Mihai Calarasanu shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to data loss, loss of progress, system failure, device malfunction, or any other issues resulting from the use or inability to use Between These Two.
If, notwithstanding the above limitations, Mihai Calarasanu is found liable for any damages, losses, or causes of action, Mihai Calarasanu’s total liability shall not exceed the amount actually paid by you for the Product, and in no event shall it exceed the official price of the Product set by Mihai Calarasanu, to the maximum extent permitted by applicable law.
TERMINATION
This Agreement will terminate automatically if you violate its terms. Upon termination, you must stop using Between These Two and delete any copies in your possession.
GOVERNING LAW
This Agreement shall be governed by the laws of Romania, without regard to conflict of law rules, except where prohibited by applicable consumer protection laws.
SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
ENTIRE AGREEMENT
Mihai Calarasanu reserves the right to modify the terms of this EULA from time to time and will post notice of material changes through Between These Two, the official store page, or another official distribution channel.
This EULA constitutes the entire agreement between you and Mihai Calarasanu regarding the use of Between These Two.
UNREAL ENGINE DISCLAIMER AND LIMITATION OF LIABILITY
Between These Two includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Mihai Calarasanu, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Mihai Calarasanu, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Between These Two, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this Between These Two, or will not revoke approval of this Between These Two for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Mihai Calarasanu and Epic. Mihai Calarasanu, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Mihai Calarasanu, Epic, Epic’s licensors, nor its or their affiliates, nor any of Mihai Calarasanu's or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this Agreement, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Mihai Calarasanu, Epic, Epic’s licensors, nor its or their affiliates, nor any of Mihai Calarasanu's or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this Agreement or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Mihai Calarasanu's, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Mihai Calarasanu, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Mihai Calarasanu, Epic, Epic’s licensors, its and their affiliates, and any of Mihai Calarasanu's or Epic’s service providers shall be limited to the full extent permitted by law.
