1. General Provisions and Acceptance of Agreement
This End User License Agreement (“Agreement”) is entered into by and between the User (as defined below) and Alexander Zmeev, an individual entrepreneur (עוסק פטור) registered in Israel, operating under the trade name “Alexander Zmeev” (“Developer”).
This Agreement governs the use of the video game “Letsss Play” and all related updates, and content (“Game”).
By installing, copying, or otherwise using the Game, you (“User”) agree to be bound by all the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
2. Age Restriction and Confirmation
The Game is intended for persons 18 years of age or older.
By accepting this Agreement and installing the Game, the User expressly represents and warrants that they are at least 18 years of age.
Responsibility for compliance with this age restriction lies solely with the User and/or their legal guardians. The Developer bears no responsibility for access to the Game by persons under the age of 18 who have falsely confirmed their age.
3. Health and Safety Warning: Photosensitive Seizures
A very small percentage of individuals may experience epileptic seizures when exposed to certain light patterns or flashing lights. Exposure to certain patterns or backgrounds on a screen, or while playing video games, may induce an epileptic seizure in these individuals. The Game may contain such light patterns and flashing images.
Consult your physician before playing if you have an epileptic condition or have ever experienced seizures. Immediately discontinue use of the Game and consult your physician if you experience any of the following symptoms while playing: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.
4. License Grant
The Developer grants the User a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game on a device owned or controlled by the User for personal, non-commercial entertainment purposes only. This Game is licensed, not sold.
5. Restrictions on Use
The User agrees not to, and not to permit any third party to:
a) Distribute, rent, lease, sell, or otherwise transfer or assign the Game to any third party.
b) Modify, decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Game.
c) Use the Game for any commercial purpose without the prior written consent of the Developer.
d) Create derivative works based on the Game.
e) Use cheats, bots, automation software, hacks, or any unauthorized third-party software designed to modify or interfere with the Game experience.
f) Use the Game for any purpose that is illegal or violates the laws of the State of Israel or the User's local jurisdiction.
6. Ownership and Intellectual Property
All title, ownership rights, and intellectual property rights in and to the Game (including but not limited to any code, graphics, music, audio, text, and unique content) are owned by the Developer. Some graphical, audio, and other assets used in the Game may have been acquired under commercial licenses from third-party rights holders and remain the property of their respective authors. The Game is protected by the copyright laws of Israel, international copyright treaties, and other intellectual property laws.
7. Privacy Policy
The Developer does not directly collect, store, or process any personal data from the Users of the Game.
The User acknowledges that the Game is distributed through the Steam platform, which is operated by Valve Corporation. The use of Steam and any data collection performed by Valve Corporation (such as game usage statistics, achievement data, or crash reports) is subject to Steam's own Privacy Policy. The User is encouraged to review Steam's Privacy Policy, available on their official website.
8. Limitation of Liability and Disclaimer of Warranties
THE GAME IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE.
The Game belongs to the horror genre and is intended to evoke emotional reactions, including fear, stress, and anxiety.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PSYCHOLOGICAL DISTRESS, EMOTIONAL HARM, OR PHYSICAL INJURY) ARISING FROM:
a) The User’s emotional reactions to the Game.
b) The User’s violation of the age restrictions stated herein.
c) The use or inability to use the Game.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles.
The User agrees that any claim or dispute arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the competent courts of the Tel Aviv District, Israel.
10. Amendments to the Agreement
The Developer reserves the right, at its sole discretion, to modify or replace this Agreement at any time. The most current version will be made available on the Game's official website or its store page (e.g., Steam). By continuing to use the Game after any such changes become effective, the User agrees to be bound by the revised Agreement.
11. General (Miscellaneous)
a) Entire Agreement: This Agreement constitutes the entire agreement between the User and the Developer with respect to the Game and supersedes all prior or contemporaneous understandings and agreements.
b) Severability: If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
c) Waiver: No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof.
