These Terms of Service (“Terms”) govern your access to and use of Subway Builder (the “Game”), including the desktop application, downloadable content (“DLC”), mods, and the official website located at subwaybuilder.com (collectively, the “Service”). The Service is operated by Redistricter, LLC, 5900 Balcones Drive, STE 4000, Austin, TX 78731 (“Company,” “we,” “us,” or “our”).
By purchasing, downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
The Service is intended for users 13 years of age or older. By using the Service, you represent that you are at least 13. We do not knowingly permit use by children under 13 and do not knowingly collect personal data from them.
2. License and Access
2.1 License Grant
Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for personal, non-commercial use, subject to these Terms.
2.2 License Keys
Access to the Game may require a license key generated after purchase and delivered via email. You are responsible for maintaining the confidentiality of your license key. We reserve the right to revoke or disable license keys in cases of fraud, abuse, or violation of these Terms.
3. Payments and DLC
The Game is a paid product and may offer optional DLC. Payments are processed by third-party providers such as Steam and Stripe. We do not store your payment card information.
4. User Content (Mods, Maps, Names)
4.1 User-Generated Content
The Service may allow you to create, upload, or distribute user-generated content, including but not limited to mods, maps, and custom names (“User Content”).
4.2 License to Company
By submitting User Content, you grant the Company a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, and incorporate such content in connection with the Service.
4.3 Responsibility
You are solely responsible for your User Content. You represent that you have all necessary rights to submit it and that it does not infringe the rights of others.
We reserve the right to remove User Content or restrict access at our discretion.
5. Prohibited Conduct
You agree not to:
Cheat, exploit, or interfere with the normal operation of the Game
Reverse engineer, decompile, or disassemble the Service except as permitted by law
Use the Service for unlawful purposes
Distribute malware or malicious code
Circumvent license, payment, or DRM mechanisms
We may suspend or terminate access for violations of this section.
6. Intellectual Property
The Game and all associated content, code, artwork, and trademarks are owned by Redistricter, LLC or its licensors and are protected by intellectual property laws.
Subway Builder is an original work and is not affiliated with, endorsed by, or associated with any real-world transit authority, including the Metropolitan Transportation Authority (MTA).
7. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted operation, error-free gameplay, or preservation of saved data.
8. Limitation of Liability
To the maximum extent permitted by law, Redistricter, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to the Service.
9. Indemnification
You agree to indemnify and hold harmless Redistricter, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Termination
We may terminate or suspend access to the Service at any time for any reason, including violation of these Terms. Upon termination, your license to use the Game will end.
11. Governing Law and Arbitration
These Terms are governed by the laws of the State of New York, excluding conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis, and you waive any right to a jury trial or class action, except where prohibited by law.
