END-USER LICENSE AGREEMENT (EULA)

This End-User License Agreement ("EULA") is a legal agreement between you (hereinafter "User" or "You") and Nine Lives Interactive (hereinafter "Licensor") for the video game software "Vicky the Fox and the Lost Days" (hereinafter "Game"), including any future updates and downloadable content (DLC).

By installing, copying, or otherwise using the Game, You agree to be bound by the terms of this EULA. If You do not agree to the terms of this EULA, do not install, copy, or use the Game.

1. LICENSE GRANT
The Licensor grants You a limited, personal, non-exclusive, non-transferable, revocable license to install and use one copy of the Game for Your personal, non-commercial use, in accordance with the terms and conditions set forth herein.

2. INTELLECTUAL PROPERTY RIGHTS
  • a. All title, ownership rights, and intellectual property rights (including but not limited to copyright, trade secrets, and trademarks) in and to the Game (including all graphics, music, code, characters, and story) are owned exclusively by the Licensor. "Vicky The Fox" is a registered trademark of the Licensor. All rights not expressly granted in this EULA are reserved by the Licensor.
  • b. The Game was developed using the GameMaker engine. GameMaker is the intellectual property of YoYo Games Ltd. All rights in and to GameMaker and its components included in the Game belong to and vest in YoYo Games Ltd.

3. RESTRICTIONS ON USE
You agree that You will not, and will not permit others to:
  • a. Use, copy, transfer, distribute, modify, adapt, merge, translate, decompile, disassemble, or reverse engineer the Game or any part of it, except as may be expressly permitted by applicable law.
  • b. Remove, alter, or tamper with any copyright, trademark, or other proprietary notices contained in the Game.
  • c. Use the Game for any illegal, unlawful, or immoral purposes.
  • d. Exploit the Game or any of its parts for any commercial purpose without express written consent.

4. PRIVACY AND DATA COLLECTION
The Game does not collect, store, or transmit any personal data from the User to the Licensor's servers. Any technical data collected by the Steam platform is governed by Valve Corporation's Privacy Policy.

5. UPDATES AND MODIFICATIONS
The Licensor may, at its sole discretion, provide updates, patches, or fixes to the Game. You agree that such updates may modify the gameplay experience or system requirements. The Licensor has no obligation to provide support or future updates.

6. ADDITIONAL CONTENT (DLC)
The Licensor reserves the right to make available future paid or free downloadable content ("DLC"). The purchase and use of such DLC are governed by the terms of this EULA. You acknowledge that certain features, levels, or extra experiences may be accessible exclusively through the purchase of such DLC. However, failure to purchase DLCs will not affect the functioning of the base Game, which will remain playable in its original "stand-alone" version.

7. HEALTH WARNING (EPILEPSY)
Some people are susceptible to epileptic seizures or loss of consciousness when exposed to certain types of flashing lights or light patterns present in daily life. Such people may have a seizure while watching certain television images or playing certain video games. If You or anyone in Your family has a history of epilepsy, consult a doctor before playing.

8. DISCLAIMER OF WARRANTY & LIMITATION OF LIABILITY
  • a. For the Game: THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE LICENSOR DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE GAME IS AT YOUR OWN SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR DISCLAIMS ALL LIABILITY FOR ANY DIRECT OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, DATA LOSS, HARDWARE FAILURE, OR OTHER CONSEQUENTIAL DAMAGES) ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE GAME.
  • b. For GameMaker: YoYo Games Limited ("YoYo Games") is not involved in the creation of this Game. YoYo Games does not warrant that the operation of the Game will be uninterrupted or error-free. In no event will YoYo Games be liable to You for any loss or damage of any kind arising from the use of this Game.

9. TERM AND TERMINATION
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from the Licensor if You fail to comply with any of its terms. Upon termination, You shall cease all use of the Game and uninstall it from Your devices.

10. SEVERABILITY
If any provision of this EULA is held to be illegal, invalid, or unenforceable for any reason, such provision shall be deemed severable from this EULA and shall not affect the validity and enforceability of the remaining provisions.

11. GOVERNING LAW AND JURISDICTION
This EULA shall be governed by and construed in accordance with the laws of Italy. The parties agree to submit to the exclusive jurisdiction of the courts of Rome, Italy, for the resolution of any disputes arising from this agreement.

12. GENERAL PROVISIONS

  • b. Consumer Rights: This license does not affect Your mandatory statutory rights as a consumer under local law.
