Nexorion End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you (the "End User" or "You") and KHC Games ("Licensor," "we," "us," or "our") for the Nexorion game, including all associated software, media, and documentation (collectively, the "Game").
By installing, accessing, or using the Game, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install, access, or use the Game.
1. Grant of License
Subject to the terms and conditions of this EULA, KHC Games grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use one copy of the Game on a single device that you own or control. This license is for your personal, non-commercial entertainment purposes only.
2. Ownership
The Game is licensed, not sold, to you. KHC Games owns all rights, title, and interest in and to the Game, including all copyrights, trademarks, and other intellectual property rights. This EULA does not give you any rights to patents, copyrights, trade secrets, trademarks, or any other rights related to the Game.
3. Restrictions
You may not, and you may not allow anyone else to:
(a) Copy, modify, adapt, translate, or create works based on the Game.
(b) Reverse engineer, decompile, disassemble, or try to discover the source code of the Game, except where applicable law specifically allows it.
(c) Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make the Game available to any third party for any commercial purpose.
(d) Use the Game for any illegal or unauthorized purpose.
(e) Remove, change, or hide any copyright, trademark, or other ownership notices from the Game.
(f) Bypass or disable any technical protection measures within the Game.
(g) Use the Game in any way that could damage, disable, overload, or impair KHC Games' servers or networks, or interfere with anyone else's use and enjoyment of the Game.
4. Data Collection and Privacy
You acknowledge and agree that KHC Games may collect and use technical data and related information. This includes, but is not limited to, technical information about your device, system and application software, and connected devices, which is gathered regularly to provide software updates, product support, and other services related to the Game. KHC Games may also collect in-game data, as fully described in the Nexorion Privacy Policy, which is available at khcgames.com.
You understand and agree that despite our security efforts, no system is perfectly secure. In the event of a data breach or unauthorized access to the data collected from your use of the Game, KHC Games will not be held liable for any damages or losses you might experience, to the fullest extent permitted by applicable law.
5. Updates and Patches
KHC Games may, from time to time, provide updates or patches to the Game. These updates might be installed automatically without further notice to you. You agree to receive such updates and allow KHC Games to deliver them to you as part of the Game's operation.
6. Termination
This EULA remains in effect until terminated by either you or KHC Games. Your rights under this EULA will automatically end without notice from KHC Games if you fail to comply with any part of this EULA. Upon termination, you must stop all use of the Game and destroy all copies, whether full or partial.
7. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT ANY KIND OF WARRANTY. KHC GAMES HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS REGARDING THE GAME, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES, BUT IS NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. KHC GAMES DOES NOT GUARANTEE THAT THE GAME WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE FIXED, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KHC GAMES, OR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THIS APPLIES REGARDLESS OF WHETHER THE DAMAGE ARISES FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE GAME; (II) ANY BEHAVIOR OR CONTENT OF ANY THIRD PARTY WITHIN THE GAME; (III) ANY CONTENT OBTAINED FROM THE GAME; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF KHC GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
YOU EXPRESSLY AGREE THAT KHC GAMES SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES, LOSSES, OR DISPUTES RESULTING FROM OR RELATED TO ANY DATA BREACH, UNAUTHORIZED ACCESS TO, OR COMPROMISE OF YOUR ACCOUNT INFORMATION OR IN-GAME DATA, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Governing Law
This EULA will be governed by and interpreted in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.
10. Entire Agreement
This EULA constitutes the entire agreement between you and KHC Games regarding the use of the Game and supersedes all prior or contemporaneous understandings and agreements.
