END USER LICENSE AGREEMENT (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Tenacity Games ("Company") for the use of the video game "Model Kit Shop Simulator" ("Game").
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
1. GRANT OF LICENSE
Subject to your compliance with this Agreement, Tenacity Games grants you a non-exclusive, non-transferable, revocable, limited license to install and use the Game for your personal, non-commercial entertainment use on a device you own or control.
2. OWNERSHIP
The Game is licensed, not sold. Tenacity Games retains all right, title, and interest in and to the Game, including all intellectual property rights therein. The Game is protected by copyright laws and international treaties.
3. RESTRICTIONS
You agree not to:
(a) Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Game;
(b) Copy, modify, or create derivative works based on the Game;
(c) Sell, rent, lease, sublicense, or distribute the Game to any third party without express written consent;
(d) Remove or alter any proprietary notices or labels on the Game.
4. TERMINATION
This license is effective until terminated. You may terminate it at any time by uninstalling and destroying all copies of the Game. This license will also terminate immediately if you fail to comply with any term of this Agreement.
5. DISCLAIMER OF WARRANTY
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TENACITY GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TENACITY GAMES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME.
7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of laws principles.
