END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Voliware Inc ("Developer," "we," "our," or "us") governing your use of Battle Runes of Metalaria ("Game").
By installing, accessing, or playing the Game, you agree to be bound by this Agreement. If you do not agree, do not install or use the Game.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and play the Game solely for your personal, non-commercial entertainment.
You do not acquire ownership of the Game or any intellectual property by using it.
2. Ownership
The Game, including but not limited to its code, artwork, music, sounds, characters, text, logos, trademarks, and other content, is owned by the Developer and protected by applicable intellectual property laws.
3. Restrictions
You agree that you will not:
* Copy, distribute, or sell the Game except as permitted by law.
* Reverse engineer, decompile, or modify the Game except where applicable law expressly allows.
* Use cheats, hacks, bots, exploits, or unauthorized third-party software.
* Attempt to interfere with servers or networking systems.
* Circumvent security or anti-cheat measures.
* Use the Game for unlawful purposes.
Violation of these terms may result in suspension or permanent termination of your access.
4. Online Features
If the Game includes online multiplayer, chat, leaderboards, user-generated content, or other online features:
* We may modify or discontinue online services at any time.
* We do not guarantee continuous availability.
* Internet access is required for online functionality.
* You are responsible for your own internet connection and hardware.
5. User Conduct
You are solely responsible for your conduct while using the Game.
You agree not to:
* Harass, threaten, bully, or abuse others.
* Share illegal, defamatory, obscene, or offensive content.
* Impersonate other players or the Developer.
* Violate applicable laws.
We reserve the right to suspend or permanently ban accounts that violate these rules.
6. User-Generated Content
If the Game allows users to create or upload content, you retain ownership of your original content.
By uploading content, you grant the Developer a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and modify that content as necessary for operation of the Game.
You represent that you have the rights to any content you upload.
7. No Responsibility for User Actions
The Developer is not responsible for the actions, communications, or content of other players.
Interactions with other users are solely between those users.
You assume all risk arising from online interactions.
8. Assumption of Risk
You acknowledge that gameplay may involve competition, user interaction, or unpredictable events.
You voluntarily assume all risks associated with use of the Game.
9. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:
* MERCHANTABILITY
* FITNESS FOR A PARTICULAR PURPOSE
* NON-INFRINGEMENT
* ACCURACY
* RELIABILITY
* UNINTERRUPTED OPERATION
WE DO NOT GUARANTEE THAT THE GAME WILL BE ERROR-FREE, BUG-FREE, SECURE, OR AVAILABLE AT ALL TIMES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY:
* INDIRECT DAMAGES
* INCIDENTAL DAMAGES
* CONSEQUENTIAL DAMAGES
* SPECIAL DAMAGES
* PUNITIVE DAMAGES
* LOSS OF PROFITS
* LOSS OF DATA
* LOSS OF GOODWILL
* BUSINESS INTERRUPTION
ARISING OUT OF OR RELATED TO USE OF THE GAME.
IF LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE GAME.
11. Third-Party Services
The Game may use third-party software or services, including but not limited to:
* Steam
* Epic Games Store
* Discord
* Analytics providers
* Cloud hosting services
Use of those services is governed by their own terms and privacy policies.
12. Updates
We may provide updates, patches, bug fixes, or new content at our discretion.
We are under no obligation to continue supporting the Game indefinitely.
13. Termination
This Agreement remains in effect until terminated.
We may suspend or terminate your access immediately if you violate this Agreement.
Upon termination, your license to use the Game ends immediately.
14. Privacy
If the Game collects personal information, its collection and use are governed by the applicable Privacy Policy.
15. Indemnification
You agree to indemnify and hold harmless the Developer, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
* Your violation of this Agreement.
* Your misuse of the Game.
* Your violation of applicable law.
* Your interactions with other users.
16. Refunds
Refunds for purchases of the Game are subject to the refund policies of the platform through which the Game was purchased (including, but not limited to, Steam, the Epic Games Store, or other authorized distributors).
The Developer does not process or issue refunds directly unless required by applicable law or unless the Game was purchased directly from the Developer.
For purchases made through a third-party platform, you must submit any refund request through that platform in accordance with its applicable refund policy.
17. Governing Law
This Agreement shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts located within that jurisdiction.
18. Changes to this Agreement
We may modify this Agreement from time to time.
Continued use of the Game after changes become effective constitutes acceptance of the revised Agreement.
