END USER LICENSE AGREEMENT
By selecting the “I agree” button, or by installing or using the software, the end user (“You”) agrees to be bound by the terms of this Agreement with Valve Corporation (“Valve”).
For purposes of this Agreement, the term “Software” includes all software programs distributed, published or otherwise made available by Valve or its affiliates including, but not limited to mobile software, downloadable/installable software for personal computer, and software accessed by means of a browser or other online communication method. Software also includes updates and upgrades as well as accompanying manual(s), packaging and other written, files, electronic or on-line materials or documentation, and any and all copies of such software and its materials.
The Software is licensed, not sold, to You for use only under the terms of this license, unless a specific end user license agreement accompanied a particular Software, in which case the terms of that specific end user license agreement will control. Your license confers no title or ownership in the Software and should not be construed as a sale of any rights in the Software. All rights not specifically granted under this Agreement are reserved by Valve and, as applicable, its licensors.
The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All title and intellectual property rights in and to the content which may be accessed through use of the Software is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This license grants you no rights to use such content.
YOU AGREE THAT YOUR USE OF THE SOFTWARE IS AT YOUR SOLE RISK. The Software is provided on an “as is” and “as available” basis, without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
IN NO EVENT SHALL VALVE, ITS AFFILIATES, LICENSORS OR PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE FOREGOING LIMITATIONS OF LIABILITY, SO THEY MAY NOT APPLY TO YOU.
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. You consent to the exclusive jurisdiction and venue of the state and federal courts in King County, Washington.
This Agreement constitutes the entire agreement between You and Valve and supersedes all prior agreements, representations, warranties or understandings between You and Valve. In the event of any conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.
