END USER LICENSE AGREEMENT

This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “You”)
and GLASS CANNON CRAFT, LLC ("GLASS"), governing Your use of GLASS’s videogame,
application, software, associated upgrades, patches, and updates, and related services (“Product”).
By clicking "I Agree," You agree to be bound by the terms of this EULA. If You do not agree to
these terms, You may not download or use the Product. Your continued use of the Product
constitutes acceptance of this EULA and any future modifications.
This Product requires a Steam account and compliance with the Steam Subscriber Agreement. This
EULA supplements, but does not replace, the Steam Subscriber Agreement. In the event of a
conflict, this EULA governs matters specific to the Product, while the Steam Subscriber Agreement
governs Steam platform-related matters.
1. PHOTOSENSIVITY/EPILEPSY AND HEALTH WARNING.
1.1 A very small percentage of individuals may experience epileptic seizures or blackouts when
exposed to certain light patterns, flashing lights, or visual effects in videogames, including this
Product. Exposure to certain patterns or backgrounds on a screen may trigger epileptic seizures or
blackouts in these individuals, even if they have no prior history of seizures or epilepsy.
1.2 If You or anyone in Your family has an epileptic condition or has experienced seizures, consult
Your physician before playing the Product. Immediately discontinue use and consult a physician
if You experience any of the following symptoms while playing: dizziness, altered vision, eye or
muscle twitches, loss of awareness, disorientation, seizures, or any involuntary movement or
convulsion.
1.3 To reduce the likelihood of seizures, take frequent breaks during play, ensure the room is welllit, and avoid playing if You are tired, under the influence of alcohol or drugs, or have sleep
deprivation. These are general suggestions based on common guidelines; always consult your
physician for personalized advice. If symptoms persist, seek medical attention. GLASS assumes
no liability for any health issues arising from use of the Product.
2. GRANT OF LICENSE.
2.1 GLASS grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable
license to download, install, and use the Product on a single personal device that You own or
control for Your personal, non-commercial entertainment purposes only. This license does not
transfer ownership of the Product to You. You may access the Product through Your Steam account,
subject to Steam's terms. This license does not permit You to use the Product on more devices than
permitted by Your Steam account.
2.2 This license does not include any rights to resale, rental, leasing, transferring, assigning, or
commercial use. You may not use the Product for any purpose other than personal play, and all
rights not expressly granted are reserved by GLASS.
3. OWNERSHIP AND INTELLECTUAL PROPERTY.
3.1 GLASS retains all right, title, and interest in and to the Product, including but not limited to
all copyrights, trademarks, trade secrets, patents, and other intellectual property rights. The Product
is protected by United States and international copyright laws, treaties, and other laws. You
acknowledge that You receive only a limited license to use the Product and no ownership rights.
3.2 You may not remove, alter, or obscure any copyright, trademark, or proprietary notices in the
Product. Any unauthorized use or reproduction of the Product may result in civil and criminal
penalties.
4. RESTRICTIONS ON USE.
4.1 You agree not to, and will not permit others to, including but not limited to:
a. Copy, modify, adapt, translate, create derivative works based on, or reproduce the Product.
b. Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code
or underlying structure of the Product.
c. Remove, alter, or obscure any copyright, trademark, or proprietary notices in the Product.
d. Use cheats, automation software (bots), hacks, mods, or any unauthorized third-party
software to modify or interfere with the Product.
e. Distribute, rent, lease, sell, sublicense, transfer, or assign the Product.
f. Use the Product in violation of any applicable law or to promote illegal activities.
g. Attempt to gain unauthorized access to any part of the Product or related systems.
h. Use the Product for any commercial purpose or for any purpose other than personal, noncommercial entertainment.
i. Use the Product on more than a single personal device that You own or control, or on more
devices than permitted by Your Steam account.
j. Use the Product to produce, market, or support Your own products or services.
4.2 Any violation of these restrictions may result in immediate termination of Your license and
potential legal action.
5. UPDATES AND MODIFICATIONS.
5.1 GLASS may provide patches, updates, or modifications to the Product ("Updates") at its
discretion. You must install all Updates to continue using the Product. Updates are considered part
of the Product and are subject to this EULA. You consent to the automatic installation of Updates,
where applicable, to ensure the Product functions properly and remains secure. GLASS reserves
the right to modify, suspend, or discontinue the Product or any features at any time without notice
or liability.
6. TERM AND TERMINATION.
6.1 This EULA is effective upon acceptance and remains in perpetual effect unless terminated as
provided herein. GLASS may terminate this EULA at any time, with or without notice, for any
reason, including if You breach any term. Upon termination, You must immediately cease all use
of the Product and destroy all copies. Uninstalling or ceasing use of the Product does not terminate
this EULA or release You from any surviving obligations. Sections 3, 4, 5, 6, 7, 8, 9, 10, 11, 12,
13, and 14 survive termination.
7. DISCLAIMER OF WARRANTIES.
7.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE PRODUCT IS PROVIDED "AS
IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE
PRODUCT WILL BE ERROR-FREE OR UNINTERRUPTED. GLASS DOES NOT WARRANT
THAT THE PRODUCT WILL MEET YOUR REQUIREMENTS OR BE COMPATIBLE WITH
YOUR DEVICE.
8. LIMITATION OF LIABILITY.
8.1 TO THE FULLEST EXTENT PERMITTED BY LAW, GLASS SHALL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES ARISING FROM OR RELATED TO THE PRODUCT, INCLUDING LOSS OF
DATA, PROFITS, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES. IN NO EVENT SHALL GLASS’S TOTAL LIABILITY EXCEED THE AMOUNT
YOU PAID FOR THE PRODUCT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN
LIMITATIONS, SO THESE MAY NOT APPLY TO YOU.
9. GOVERNING LAW AND VENUE.
9.1 This EULA shall be governed and construed in accordance with the laws of Nevada, without
giving effect to any conflict of law rules or other rules that might render Nevada law inapplicable
or unavailable, and all claims relating to or arising out of this EULA, or the breach thereof, whether
sounding in contract, tort or otherwise, shall likewise be governed by the laws of Nevada, without
giving effect to any conflict of law rules or other rules that might render Nevada law inapplicable
or unavailable, with Clark County, Nevada serving as the exclusive venue for any related action
or proceeding.
10. BINDING ARBITRATION.
10.1 By clicking “I Agree,” You specifically acknowledge and consent that all disputes, claims or
controversies arising out of or relating to this EULA or the Product shall be resolved exclusively
through binding arbitration, rather than in court, administered by the American Arbitration
Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Clark
County, Nevada, before a single arbitrator. The arbitrator's decision shall be final and binding, and
judgment may be entered in any court of competent jurisdiction.
11. CLASS ACTION WAIVER.
11.1 You waive any right to participate in, initiate, or be a representative in any class action,
consolidated action, or representative action against GLASS. All claims must be brought in Your
individual capacity only.
12. MISCELLANEOUS.
12.1 SEVERABILITY. If any provision is held invalid or unenforceable, the remaining provisions
remain in full force and effect.
12.2 ENTIRE AGREEMENT. This EULA constitutes the entire agreement between You and
GLASS regarding the Product.
12.3 AMENDMENTS. GLASS reserves the right to change, modify, add or delete sections in this
EULA for any reason at any time. Continued use after amendment constitutes acceptance.
12.4 NO WAIVER. Failure to enforce any provision does not constitute a waiver.
12.5 NO RIGHTS GRANTED. Nothing in this EULA grants You any right, title, or interest in the
Product beyond the limited right to use as permitted herein. You may not sell, transfer, or use the
Product to produce, market, or support Your own products or services.
13. REMEDIES FOR BREACH.
13.1 Any breach may cause irreparable harm to GLASS, entitling GLASS to seek injunctive relief,
in addition to any other remedies available at law or equity. You agree to reimburse GLASS for all
costs, including reasonable attorney fees, incurred in enforcing this EULA.
14. FEEDBACK LICENSE.
14.1 If you provide any suggestions, comments, feedback, ideas, bug reports, or other input
regarding the Product (collectively, “Feedback”), You hereby grant GLASS a worldwide, nonexclusive, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable (through multiple tiers)
license to use, reproduce, modify, adapt, create derivative works from, distribute, perform, display,
and otherwise exploit such Feedback in any manner for any purpose, including incorporation into
the Product or other products and services, without any obligation to compensate You or attribute
the Feedback to You. You represent and warrant: (a) Your Feedback is original to You and does not
infringe any third-party intellectual property rights; and (b) You have all necessary rights to grant
this license.
14.2 Feedback is provided “AS IS” without any warranties of any kind. GLASS is under no
obligation to use or respond to Your Feedback.
14.3 You acknowledge that Your provision of Feedback and use of the Product is voluntary and
that You will receive no compensation, monetary or otherwise, for such Feedback or use, and
nothing in this EULA creates an employment, joint venture, or agency relationship between You
and GLASS.
