Aesper LLC created the Furia Rising game, so the terms of this agreement (“Terms of Service”) govern the relationship between you and Aesper LLC and its affiliates (hereinafter “Aesper” or “Us” or “We”) regarding the access and/or use of Furia Rising game and any other existing services (collectively, the “Service”). By accessing or using our Services, you agree to be bound by these Terms Of Service. If you do not agree, please do not use our Services.

By using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply to all users, including visitors, registered users, and others who access the Services.

Use the Services to harass, abuse, or harm others.
5.3 Content Ownership
The Services, including all text, graphics, software, and other materials ("Aesper Content"), are owned by Aesper or its licensors and protected by intellectual property laws. You may not use Aesper Content except as expressly permitted by these Terms.
6. User Content
6.1 Your Content
You may be able to upload, post, or submit content (e.g., text, images, or comments) through the Services ("User Content"). You retain ownership of your User Content but grant Aesper a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display it in connection with the Services.
6.2 Responsibility
You are solely responsible for your User Content. You represent that:
You have all necessary rights to submit your User Content.
Your User Content does not violate any laws, infringe on third-party rights, or contain harmful, offensive, or inappropriate material.
Aesper may remove or restrict access to User Content that violates these Terms at our discretion.
7. In-App Purchases and Payments

Some Services may offer virtual items, subscriptions, or other paid features ("In-App Purchases"). All payments are processed through third-party platforms (e.g., app stores), and their terms and conditions apply.
7.2 No Refunds
All In-App Purchases are final and non-refundable, except as required by applicable law or specified in the applicable platform’s refund policy.
8. Termination
We may suspend or terminate your access to the Services at our sole discretion, with or without notice, if you violate these Terms or for any other reason. You may also discontinue using the Services at any time by deleting your account or ceasing access.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Aesper does not guarantee that the Services will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, Aesper LLC, its affiliates, and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages. Our total liability to you will not exceed the amount you paid to us in the past 12 months, or $20, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Aesper LLC and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.
12. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Furia Rising does not guarantee that the Services will be uninterrupted, error-free, or secure.
Disclaimer for Account Loss: Aesper LLC is not responsible for any loss of account access, data, or virtual items resulting from user error, failure to secure account credentials, or violations of these Terms. This includes, but is not limited to, loss due to forgotten passwords, compromised accounts, or termination of your account by us in accordance with these Terms. We strongly recommend that you safeguard your account information and enable any available security features. Aesper will not be liable for restoring lost accounts or compensating for any associated losses, except as required by applicable law.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Services will be resolved through binding arbitration in Texas, except that either party may seek injunctive relief in a court of competent jurisdiction.
Encouragement to Settle Disputes Outside of Court: We encourage users to resolve any disputes with Aesper informally and outside of court whenever possible. If you have a concern or claim arising from your use of the Services, please contact us first at furiarisingadventure@gmail.com to seek a resolution. Both parties agree to make a good-faith effort to negotiate and settle disputes amicably before pursuing arbitration or legal action as outlined in this section.
14. Suspensions and Termination
AESPER LLC MAY, IN ITS SOLE DISCRETION, TERMINATE, LIMIT, SUSPEND, MODIFY, OR DELETE A USER’S ACCOUNT OR ACCESS TO AESPER SERVICE AND PROHIBIT OR DENY ACCESS TO THE GAMES AND THEIR CONTENTS.
THEREFORE, IF YOU ARE, OR AESPER SUSPECTS THAT YOU ARE, FAILING TO COMPLY WITH ANY OF THESE TERMS OF SERVICE, OR THERE IS ANY ACTUAL OR SUSPECTED ILLEGAL AND/OR IMPROPER USE OF THE SERVICE, AESPER IS UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY SUCH LOSSES OR RESULTS.
AESPER RESERVES THE RIGHT TO TERMINATE ANY ACCOUNT THAT HAS BEEN INACTIVE FOR 180 DAYS.
AESPER reserves the right to stop offering and/or supporting the Service at any time, and Aesper is not required to provide refunds, benefits or any other compensation to the user related to this discontinued Service.
15. Code of Conduct
You agree to comply with the following (“Code of Conduct”): Comply with the terms and conditions of third-party mobile platform providers, such as Apple and Google, from whom you download Aesper Services, including the terms regarding payment for In-App purchases made through the platform;
Not to, in any circumstances, attempt to access or obtain other users’ account or login information;
Not use cheats, exploits, hacks, automation software, bots, mods or any unauthorized third-party software to modify, interfere or disrupt the Services;
Not develop, distribute, or publicly inform other users of “auto” software programs, “macro” software programs, or other “cheat utility” software programs or applications in violation of the Terms of Service;
Not exploit, distribute, or publicly inform other users of any game error, miscue, or bug which gives an unintended advantage;
Not disrupt, overburden, aid or assist in the attempt to modify, interfere or disrupt the Service or any other Service-related environment;
Not institute, assist or become involved in any type of attack, including, without limitation. distributing viruses or other attempts to disrupt the Service or any other user’s use of the Service;
Not send, post, transmit, or make available any material and/or information that may be abusive, threatening, illegal, obscene, defamatory, libelous, or containing nudity, excessive violence, or racially, religiously, sexually or otherwise objectionable or offensive;
Not create a false identity or impersonate another person or entity, including, without limitation, identities falsely indicating that you are Aesper LLC. official or representative, message board or community board moderator, another user or host, and/or that you are a celebrity or public figure;
Through the Service, not make available any material or information that infringes upon any copyright, trademark, patent, trade secret, rights of privacy, rights of publicity or other rights of any persons or entities;
Not to harass, abuse, threaten or bully any other player or Aesper employees, including Aesper customer service representatives;
Not attempt to gain unauthorized access to the Service, accounts registered or others, or to networks from which portions of the Service are provided, including circumventing or modifying, attempting to circumvent or modify, or assisting or encouraging any other person to circumvent or modify any security, technology, device, or software that is part of the Service;
Not engage in attempts to modify, reverse engineer, decompile, disassemble, decipher or otherwise try to derive the source code for any underlying software and/or other intellectual property used to provide the any or all of Aesper Services;
Not improperly use Aesper support services, including by submitting false reports; Unless permitted by law or the existence and application of open source licenses, you will not modify, reverse engineer, decompile, disassemble, decipher or otherwise try to derive the source code for any underlying software or other intellectual property used to provide the Service or any Aesper game;
Failure to comply with this Code of Conduct may result in suspending or revoking your account, where Aesper reserves the right to determine which conduct is considered a violation and reserves the right to take action as needed.
16. Purchase Terms
The Service allows you to “earn” In-Game Items. You may also use real money to purchase a license to use certain In-Game Items. In-Game Items, including “Coins,” “Crystals,” and any other virtual currencies within the Game are for personal, non-commercial entertainment purposes, have no independent value outside of the Game, may not be redeemed for any cash value, and is simply a measurement of your limited license.
Aesper does not control or manage the payment process; please review the relevant terms and conditions with the applicable platform provider (e.g., Apple’s iOS, Google’s Android OS, etc.) before making any In-App Purchases.
Aesper may manage, regulate, control, modify, or eliminate In-Game Items and/or Merchandise (any other goods or services) at any time, with or without notice. Aesper shall have no liability to you or any third party in the event that Aesper exercises such rights.
Other than as authorized in the Service, you shall not sell, redeem or otherwise transfer In-Game Items or Merchandise to any person or entity, including but not limited to Aesper, other users or any third parties
ALL PURCHASES AND REDEMPTIONS OF THIRD-PARTY VIRTUAL CURRENCY MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE. YOU ACKNOWLEDGE THAT NEITHER Aesper NOR ANY MOBILE PLATFORM PROVIDER IS REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED IN-GAME ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY. IN THE EVENT THAT YOU DO NOT RECEIVE AN IN-GAME ITEM THAT YOU PROPERLY PURCHASED THROUGH A PLATFORM PROVIDER, YOU MAY REQUEST A REFUND DIRECTLY FROM THAT PLATFORM PROVIDER SUBJECT TO THEIR REFUND POLICY.
17. Ownership / Trademarks and Copyrights
All rights, titles, and interests of the Service (including, without limitation, any games, titles, computer codes, themes, objects, characters, character names, stories, dialogues, catch phrases, concepts, artworks, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a Aesper game client, and the Aesper game clients and server softwares) are owned by Aesper. Aesper reserves all rights without limitation, including all intellectual property rights or other proprietary rights, in connection with its games and the Service.

19. Governing Law/Jurisdiction
This Terms of Service is governed by and interpreted in accordance with the laws of the United Stats of America. 20. Miscellaneous
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aesper regarding the Services.
Severability: If any provision of these Terms is found invalid, the remaining provisions will remain in effect.
No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
