This End User License Agreement (“EULA”) is a legal agreement between you (the “User”) and Chosta Studios, a sole proprietorship based in France, for the use of the video game Urbexophobia, including all associated files, content, documentation, updates, and patches (the “Game”).
By installing, copying, or using the Game, you agree to all terms of this Agreement. If you do not agree to these terms, you must not install, play, or use the Game.
1. License
1.1 Chosta Studios grants you a personal, non-transferable, non-exclusive license to install and use one copy of the Game on a single computer, solely for personal and non-commercial purposes.
1.2 Any modification, resale, rental, lending, distribution, or commercial use is strictly prohibited.
1.3 You may not use mods, modify, decompile, disassemble, or attempt to access the Game’s source code.
1.4 The Game may include anti-cheat and modification detection systems.
2. Early Access
2.1 The Game is currently in Early Access. It may contain bugs, incomplete features, and stability issues.
2.2 By accessing the Game at this stage, you accept these risks and understand that the gameplay experience may change.
3. Distribution via Steam
3.1 The Game is distributed exclusively through Steam. Your use of the Game is also subject to Steam’s Terms of Service.
3.2 In the event of a conflict between this EULA and Steam’s rules, Steam’s rules may take precedence.
4. Multiplayer and Communication
4.1 The Game includes multiplayer features, voice chat, and text chat.
4.2 You are solely responsible for your behavior online.
4.3 Harassment, hate speech, abusive behavior, or inappropriate use of communication systems may result in suspension or termination of your access to the Game without refund.
5. Intellectual Property
5.1 The Game, including all original visuals, sounds, gameplay mechanics, code, text, interface, and any other element created by Chosta Studios, is and remains the exclusive property of Chosta Studios.
5.2 This EULA grants you no intellectual property rights over the Game or its elements.
5.3 Any reproduction, modification, distribution, or unauthorized use of any part of the Game is strictly prohibited.
5.4 The Game also contains third-party elements, used in accordance with their respective license terms.
5.5 All other names, logos, and trademarks mentioned in the Game are the property of their respective owners.
6. Warranty Disclaimer
6.1 The Game is provided “as is,” without any warranty of being free from bugs, errors, or interruptions.
6.2 Chosta Studios does not guarantee that the Game will function with all systems or hardware configurations.
6.3 You are solely responsible for backing up your data and configuring your system.
7. Health and Safety
7.1 The Game may include visual effects, intense sounds, or flashing lights.
7.2 Some individuals may be sensitive to these effects and risk photosensitive epileptic seizures, even without prior medical history.
7.3 If you experience dizziness, vision problems, muscle twitches, or discomfort, stop playing immediately and consult a doctor.
7.4 Chosta Studios declines any responsibility for injury, discomfort, or physical incidents occurring during or as a result of playing the Game.
7.5 Play in a safe environment, seated and without distractions, especially online.
8. Liability
8.1 To the fullest extent permitted by law, Chosta Studios shall not be held liable for:
indirect or special damages;
any loss of data or revenue;
any bodily injury related to the use of the Game;
any misuse or unauthorized use of the Game.
8.2 The maximum liability of Chosta Studios to you, regardless of the legal basis (contract, tort, negligence, etc.), is limited to the amount you paid for the Game.
9. Termination
9.1 This EULA takes effect upon your first installation of the Game and remains valid until terminated.
9.2 In case of breach of these terms, Chosta Studios may terminate your access to the Game without notice or refund.
9.3 Upon termination, you must uninstall and cease all use of the Game.
10. Governing Law
10.1 This EULA is governed by French law.
10.2 Any dispute will be subject to the exclusive jurisdiction of the competent French courts.
10.3 If any clause is found to be invalid, the remainder of the Agreement shall remain enforceable.
