END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and the developer and publisher of Gaming DNA & ESTI ("Developer", "we", "us", or "our") regarding your use of the game, including its software, content, online features, updates, and related services (collectively, the "Game").
By downloading, installing, accessing, or using the Game, you agree to this Agreement. If you do not agree, you should not install or use the Game.
1. License
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game for your personal, non-commercial entertainment purposes.
The Game is licensed, not sold. Except for the limited license granted under this Agreement, all rights in the Game remain with the Developer and applicable rights holders.
2. Steam
The Game may be distributed through Steam and may use Steam features and services.
Your use of Steam is also subject to the applicable agreements, rules, and policies provided by Valve Corporation. This Agreement governs your relationship with the Developer concerning the Game and does not replace your agreements with Valve.
3. Skill Tests and ESTI Results
Gaming DNA & ESTI includes gameplay challenges, skill assessments, performance tests, player profiles, rankings, and the Esports Style Type Indicator (ESTI).
These features are designed primarily for entertainment, gameplay analysis, and informational purposes.
Results generated by the Game, including skill scores, rankings, Gaming DNA profiles, ESTI types, reaction measurements, performance statistics, and other assessments:
- are not medical or psychological diagnoses;
- are not scientifically validated measures of intelligence, personality, health, or professional esports potential unless expressly stated otherwise;
- do not guarantee future gaming or competitive performance; and
- should not be used as the sole basis for educational, employment, medical, psychological, or professional decisions.
Different hardware, peripherals, displays, audio equipment, network conditions, system performance, player condition, and other factors may affect test results.
4. Rankings and Online Features
The Game may provide online features such as leaderboards, global comparisons, statistics, profiles, achievements, or other community features.
You acknowledge that rankings and comparative results may change over time and may be affected by the number of participating players, scoring systems, updates, anti-cheat measures, and other factors.
We may remove, reset, correct, or invalidate scores or rankings when reasonably necessary to address cheating, exploits, technical errors, corrupted data, or violations of this Agreement.
5. Acceptable Use
You agree not to:
- cheat, manipulate scores, or intentionally exploit bugs to obtain unfair results;
- use unauthorized software, bots, scripts, automation, or other tools to interfere with the Game or its ranking systems;
- attempt to bypass security or anti-cheat systems;
- interfere with servers, online services, or other users;
- use the Game for unlawful purposes;
- distribute unauthorized copies of the Game;
- reverse engineer, decompile, or disassemble the Game except where such restrictions are prohibited by applicable law;
- remove or alter copyright, trademark, or other proprietary notices; or
- use Game content commercially without authorization.
6. User-Generated and Shared Content
Where the Game allows you to create, upload, display, or share profiles, results, names, screenshots, or other content, you remain responsible for the content you submit.
You must not submit content that violates applicable law or the rights of others.
To the extent necessary to operate the relevant Game features, you grant us a non-exclusive license to host, reproduce, process, display, and distribute content that you voluntarily submit through those features.
7. Privacy and Data
Certain Game features may process gameplay information, test results, technical information, leaderboard data, identifiers, or other information necessary to provide the Game and its online features.
Where applicable, the collection and processing of personal data will be described in our Privacy Policy.
The Privacy Policy, where provided, should be read together with this Agreement.
8. Intellectual Property
The Game and its software, artwork, graphics, interface designs, characters, text, audio, music, trademarks, logos, assessment systems, and other original content are owned by or licensed to the Developer and are protected by applicable intellectual property laws.
No ownership rights are transferred to you under this Agreement.
Third-party trademarks, game names, or references that may appear in the Game remain the property of their respective owners.
9. Updates and Changes
We may provide patches, updates, balance changes, new tests, modified scoring methods, additional content, or other changes to the Game.
As the Game evolves, test methodologies, scoring systems, rankings, ESTI classifications, and other features may change.
We may modify or discontinue features where reasonably necessary for development, technical, security, legal, or operational reasons.
10. Early Builds, Demos, and Testing Versions
If you access a demo, playtest, beta, preview, Steam Next Fest build, or other pre-release version of the Game, you acknowledge that it may contain incomplete features, bugs, errors, temporary content, or systems that differ from the final release.
Scores, rankings, progression, settings, or other data from pre-release versions may be modified or reset before or after the full release.
11. Disclaimer
To the maximum extent permitted by applicable law, the Game is provided on an "as is" and "as available" basis.
We do not guarantee that the Game will be uninterrupted, error-free, or compatible with every hardware or software configuration.
Nothing in this Agreement excludes rights or remedies that cannot legally be excluded under applicable consumer protection law.
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use the Game.
Nothing in this Agreement limits liability where such limitation is prohibited by applicable law.
13. Suspension and Termination
We may suspend or restrict access to online features where reasonably necessary because of cheating, abuse, security risks, unlawful activity, or material violations of this Agreement.
Your license under this Agreement may terminate if you materially violate its terms.
Upon termination, you must cease using the Game where required by applicable law and the terms governing your Steam license.
14. Changes to This Agreement
We may update this Agreement when reasonably necessary to reflect changes to the Game, its services, applicable laws, or our business practices.
Where required by applicable law, material changes will be communicated appropriately.
The current version of this Agreement will identify its most recent update date.
15. Governing Rights
Nothing in this Agreement is intended to deprive you of mandatory consumer rights or other protections available to you under the laws applicable to you.
If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
