GuitarSesh – End-User Licence Agreement (EULA)

1. Grant of licence
The Licensor grants you a non-exclusive, non-transferable licence
to install and use GuitarSesh ("the Software") on any computer
you own or control, subject to the following:
COMMERCIAL USE TERMS:
* Standard commercial use is allowed – you may use the Software for
streaming, YouTube monetization, live performances, and independent
commercial releases with the following attribution requirement.
* Attribution Required – You must include the credit "Made with
GuitarSesh – songcreatorvision.com" in:
- Album/track credits for commercial releases (physical or digital)
- Video descriptions for online content
- Stream overlays or descriptions for live content
- Any promotional materials mentioning the tools used
* Major Commercial License – Additional licensing is required for:
- Releases through major record labels (Universal, Sony, Warner,
or their subsidiaries)
- Synchronization licensing for film, TV, or advertising
- Contact kyle@songcreatorvision.com for terms
GENERAL RESTRICTIONS:
* Reverse-engineering, de-obfuscation, redistribution, sub-licensing,
or modification of the Software or its assets is prohibited without
the Licensor's written permission.
* All trade marks and trade dress remain the property of their
respective owners.
INCLUDED MUSICAL CONTENT:
* The Software includes musical compositions created by the Licensor
("Included Songs"). These Included Songs are licensed to you as
part of the Software for personal use, practice, and gameplay.
You may not redistribute, re-sell, or claim ownership of the
Included Songs separately from the Software. The commercial use
terms above apply to performances or recordings you create using
the Included Songs as practice material.
USER-IMPORTED CONTENT:
* The Software allows you to import Guitar Pro and other compatible
music files. You are solely responsible for ensuring you have the
legal right to use any files you import. The Licensor does not
provide, host, or distribute user-imported content and assumes no
liability for copyright infringement arising from your use of
third-party music files.
2. User-generated content ("UGC")
You retain ownership of any original musical performance, lyrics,
commentary, or audiovisual material you create while using the
Software. The Licensor obtains no rights in your copyright except
the limited right to reference or showcase your publicly posted UGC
for marketing purposes (you may opt-out by written request).
3. Warranty disclaimer & limitation of liability
THIS SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND,
EXPRESS OR IMPLIED. IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY
CLAIM, DAMAGES, OR OTHER LIABILITY ARISING OUT OF OR IN CONNECTION
WITH THE SOFTWARE OR ITS USE.
4. Open-source components
The Software bundles unmodified third-party libraries under their
original licences (see THIRD_PARTY_LICENSES). Primary licences:

5. Termination
This licence terminates automatically if you breach its terms. Upon
termination you must cease all use and destroy or uninstall all
copies of the Software.
6. Data collection and privacy
6.1 LOCAL DATA. The Software stores gameplay data, settings, and progress
locally on your device. This local data is not transmitted without
your action.
6.2 OPTIONAL COMMUNICATIONS. The Software includes optional features
("Feedback" and "Community Polls") that transmit data to the
Licensor's servers at songcreatorvision.com when you choose to use
them. Before using these features for the first time, you will be
prompted to review and consent to the data transmitted.
When you use these features, the following data may be collected:
(a) Your Steam account identifier (Steam ID);
(b) Your operating system (Windows, macOS, or Linux);
(c) Application version;
(d) Free-text content you write (feedback text or poll selections);
(e) Your IP address (recorded by the server);
(f) Timestamp of the submission.
6.3 PURPOSE. Data collected under Section 6.2 is used solely for product
improvement, bug diagnosis, and community feature prioritisation.
The Licensor does not sell, share, or use this data for advertising.
6.4 CONSENT AND WITHDRAWAL. You may withdraw consent at any time through
the Settings screen of the Software. You may request deletion of
previously submitted data by contacting kyle@songcreatorvision.com.
6.5 PRIVACY POLICY. Full details are at:

7. Refunds
Refunds for purchases made through Steam are governed solely by
Steam's refund policy. The Licensor does not process refunds
directly.
8. Governing law and dispute resolution
This Agreement is governed by the laws of the State of California,
excluding its conflict-of-laws principles. Any dispute arising
under this Agreement shall be resolved exclusively in the state or
federal courts located in Los Angeles County, California, and you
consent to personal jurisdiction in those courts.
Before initiating any legal proceeding, both parties agree to
attempt good-faith informal resolution by contacting
kyle@songcreatorvision.com, allowing 30 days for response.
9. Acceptance
By installing, copying, or using the Software you acknowledge that
you have read this Agreement and agree to be bound by its terms.
You represent that you are at least 13 years of age (or the age of
digital consent in your jurisdiction, if higher) or that you have
obtained parental or guardian consent to use the Software.
