# END USER LICENSE AGREEMENT (EULA)
**SongVisualizer – Version 1.8W Alpha (Early Access)**

PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING OR USING SONGVISUALIZER ("SOFTWARE") YOU AGREE TO BE BOUND BY THE TERMS OF THIS END USER LICENSE AGREEMENT ("AGREEMENT"). IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.
## 1. LICENSE GRANT
1.1 **Scope.** Subject to your compliance with this Agreement and the Steam Subscriber Agreement, Kyle Abent ("Licensor") grants you a personal, revocable, non-exclusive, non-transferable license to install and use the Software on devices where you are signed into your Steam account, for **personal, non-commercial** use.
1.2 **Single User.** This license is for single-user use only. The Software does not include multiplayer or online features in this version.
## 2. EARLY ACCESS
2.1 The Software is provided in **Early Access** and is not feature-complete. Features may change, be added, or removed during development.
2.2 Save data and user progress may be affected by updates. While efforts will be made to preserve data, compatibility between versions is **not guaranteed**.
## 3. OWNERSHIP
3.1 The Software, including its code, artwork, original audio assets, and other content provided by Licensor, is protected by copyright and other intellectual property laws. Licensor retains all rights not expressly granted.
3.2 **User Creations.** Recordings, performances, exports, or other outputs you create using the Software **with your own files** remain the property of their respective rightsholders. Licensor claims no ownership in your user-created outputs, subject to Section 4.
3.3 **Future Content.** Any additional downloadable content (DLC), including but not limited to additional songs owned by Licensor, will be subject to this Agreement unless otherwise specified.
## 4. USER-SUPPLIED CONTENT (NO MUSIC INCLUDED)
4.1 The Software **loads Guitar Pro 5 (.gp5) files supplied by the user. No third-party music files are included with the Software.** "Guitar Pro" is a trademark of Arobas Music, with which SongVisualizer is not affiliated, endorsed, or sponsored.
4.2 You are solely responsible for ensuring you hold all necessary rights to any files or content you load into the Software. Do not distribute .gp5 or other music files with the Software or represent that the Software includes such files.
4.3 Licensor does not host or index third-party music files and may respond to valid takedown notices and legal processes related to user-supplied content.
4.4 **No Modifications.** The Software does not support user modifications ("mods") beyond loading user-supplied .gp5 files as intended.
## 5. CONTENT CREATION / STREAMING POLICY
5.1 Licensor permits you to capture, stream, and monetize gameplay footage of the Software (e.g., on YouTube/Twitch), provided you comply with this Agreement and **respect third-party rights** in any user-supplied files used in your content.
5.2 When streaming or creating content, you are responsible for ensuring your use of any user-supplied music files complies with applicable copyright laws and platform policies.
## 6. DATA COLLECTION AND PRIVACY
6.1 The Software stores user data locally on your device. No personal information is collected or transmitted without your explicit consent.
6.2 Performance data, settings, and progress are saved locally and remain under your control.
## 7. RESTRICTIONS
You may **not**:
(a) reverse engineer, decompile, or disassemble the Software except as permitted by applicable law;
(b) sell, rent, sublicense, or otherwise redistribute the Software without Licensor's prior written consent;
(c) remove or obscure any proprietary notices;
(d) use the Software for any **commercial** purpose without Licensor's written permission (except as permitted in Section 5);
(e) circumvent or disable any security features or technical measures;
(f) modify the Software or create derivative works based upon it.
## 8. HEALTH & SAFETY NOTICE
8.1 The Software may contain rapidly changing visuals and audio. If you experience dizziness, seizures, or discomfort, stop use immediately and consult a physician if needed.
8.2 Use safe listening levels. Licensor is not responsible for hearing loss or equipment damage resulting from misuse.
## 9. REFUNDS
9.1 Refunds are handled according to Steam's refund policy. Please refer to Steam's current refund policy for eligibility and procedures.
## 10. THIRD-PARTY COMPONENTS & NOTICES
10.1 **Open Source Components.** The Software includes third-party open-source components under various licenses including LGPL (PyGuitarPro, pygame-ce), BSD, MIT, Apache-2.0, and others. Complete attribution and license texts are provided in the "THIRD_PARTY_LICENSES" folder included with the Software.
10.2 **LGPL Components.** This Software uses libraries licensed under the GNU Lesser General Public License (LGPL), including PyGuitarPro (LGPL v3.0) and pygame-ce (LGPL v2.1). As required by the LGPL:
- You may request the source code for these LGPL components by contacting kyle@songcreatorvision.com within three years of receiving the Software
- These libraries are dynamically linked and can be replaced with modified versions compatible with the documented interfaces
- The LGPL license texts are included in the "THIRD_PARTY_LICENSES" folder
10.3 To the extent a third-party license grants you rights that conflict with this Agreement, that license controls for the relevant component only.
10.4 "Guitar Pro" is a trademark of Arobas Music. All other trademarks are the property of their respective owners.
## 11. LIMITED WARRANTY & DISCLAIMER
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SOFTWARE MAY CONTAIN BUGS AND ERRORS.
## 12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
## 13. UPDATES AND MODIFICATIONS
13.1 Licensor may update this Agreement at any time. **Material changes** will be communicated via Steam or in-app notice.
13.2 If you do not accept the revised terms, discontinue use of the Software. **Continued use after an update constitutes acceptance** of the revised terms.
## 14. TERMINATION
14.1 This Agreement terminates automatically if you breach any term. Upon termination, you must cease all use of the Software and destroy any copies in your possession.
14.2 **Survival.** Sections 3, 4, 7–13, 14.2, and 15–16 survive termination.
## 15. GOVERNING LAW
This Agreement is governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict-of-law principles.
## 16. ENTIRE AGREEMENT; SEVERABILITY; NO WAIVER
16.1 This Agreement constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior or contemporaneous understandings.
16.2 If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.
16.3 Failure to enforce any provision is not a waiver of that provision or any other.
