GuitarSesh – End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is a binding agreement between you
("you" or "User") and Kyle Abent, doing business as SongCreatorVision ("Licensor,"
"we," or "us"), governing your use of the GuitarSesh software application and any
bundled content (collectively, the "Software"). By installing, accessing, or using
the Software, you agree to be bound by this Agreement. If you do not agree, do not
install or use the Software.

1. GRANT OF LICENSE
------------------------------------------------------------------------------
Subject to your compliance with this Agreement, Licensor grants you a non-exclusive,
non-transferable, revocable license to install and use the Software on any computer
you own or control, for your personal and commercial use as described below.
1.1 COMMERCIAL USE
You may use the Software in connection with commercial activity — including
streaming, monetized video (e.g., YouTube), live performances, and independent
commercial releases of recordings you make. You retain all rights in your own
recorded performances; this Agreement does not grant Licensor any ownership of, or
royalty in, recordings or performances you create using the Software.
Attribution (requested, not required): If you find the Software useful, we'd
appreciate a credit such as "Made with GuitarSesh – songcreatorvision.com" in
your album/track credits, video descriptions, stream overlays, or promotional
materials. This is a courtesy request, not a condition of your license.
1.2 INCLUDED MUSICAL CONTENT ("Included Songs")
The Software may include musical compositions authored by Licensor ("Included
Songs"), provided for your personal use, practice, and gameplay. You may not
redistribute, re-sell, or separately claim ownership of the Included Songs
themselves. You are free to record and commercially release your own performances,
including performances created while practicing with Included Songs. However, if you
wish to commercially release a recording in which an Included Song is itself the
musical composition being exploited (as opposed to your own original composition or
performance), that use of the underlying composition is a separate licensing matter —
please contact kyle@songcreatorvision.com.
1.3 USER-IMPORTED CONTENT
The Software lets you import standard tablature files (.gp3, .gp4, .gp5, .gp, .gpx)
and other compatible music files. You are solely responsible for ensuring you have
the legal right to use any file you import. Licensor does not host, distribute, or
supply such files and assumes no liability for your use of imported content,
including any infringement of third-party rights.
1.4 GENERAL RESTRICTIONS
Except as expressly permitted by this Agreement or by applicable law that cannot be
contractually overridden, you may not: (a) reverse-engineer, decompile, disassemble,
or de-obfuscate the Software; (b) redistribute, sub-license, rent, lease, or sell the
Software; or (c) modify or create derivative works of the Software, in each case
without Licensor's prior written permission. All trademarks, trade dress, and other
intellectual property in the Software remain the property of their respective owners.

2. USER-GENERATED CONTENT (UGC)
------------------------------------------------------------------------------
You retain ownership of your original content — including your performances, lyrics,
commentary, and audio/visual material ("UGC"). With respect only to UGC you have
made publicly available (for example, public posts on social platforms or community
channels), you grant Licensor a limited, non-exclusive, royalty-free license to
reference and showcase that publicly posted UGC for the purpose of marketing and
promoting the Software (e.g., reposting a public clip or quoting a public review).
This license is limited to your publicly posted UGC and does not extend to private
or unpublished material. You may opt out at any time by written request to
kyle@songcreatorvision.com, after which Licensor will cease new uses of your UGC
within a reasonable period; this opt-out does not require removal of materials
already printed or distributed before the request.

3. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

3.1 "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS
PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
3.2 LIMITATION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL
LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO
THE SOFTWARE OR THIS AGREEMENT.
3.3 LIABILITY CAP. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR'S
TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS
AGREEMENT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE.
3.4 SAVINGS / CONSUMER RIGHTS. Nothing in this Agreement excludes or limits
Licensor's liability for: (a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation; (c) gross negligence or willful
misconduct; or (d) any other liability that cannot be excluded or limited under
applicable law. Some jurisdictions do not allow the exclusion or limitation of
certain warranties or liabilities, so some of the above exclusions and limitations
may not apply to you. This Agreement does not affect any statutory consumer rights
you have that cannot be waived by contract.

4. OPEN-SOURCE AND THIRD-PARTY COMPONENTS

The Software bundles unmodified third-party open-source components, each governed by
its own license. Required notices and full license texts are included with the
Software in the THIRD_PARTY_LICENSES/ directory and the accompanying COPYING.*.txt

LGPL notice: The Software uses pygame-ce, PyGuitarPro, and GEOS (the latter bundled
within the Shapely package), which are licensed under the GNU Lesser General Public
License (LGPL). In accordance
with the LGPL, these components are dynamically linked, and the corresponding license
texts together with complete, unmodified source code are provided in
THIRD_PARTY_LICENSES/src/ as required by the LGPL. You may also obtain the source code
for these components, and any modifications Licensor has made to them, by contacting
kyle@songcreatorvision.com. This permits you to modify and re-link the LGPL-covered
portions as provided under the LGPL.
4.1 TRADEMARK AND AFFILIATION DISCLAIMER
GuitarSesh is an independent product developed by Kyle Abent d/b/a SongCreatorVision.
It is not affiliated with, sponsored by, or endorsed by any third-party tablature
editor, rhythm-game publisher, or music-software vendor. References to file formats
such as .gp3, .gp4, .gp5, .gp, and .gpx are descriptive of file formats only. Format
support is implemented from publicly documented format specifications; no third-party
proprietary code is bundled. The GP6/.gpx (BCFZ/BCFS) container decoder is an
independent implementation informed by the MPL-2.0 alphaTab project. All product
names and trademarks are the property of their respective owners and are referenced
descriptively only.

5. TERMINATION
------------------------------------------------------------------------------
This Agreement and your license terminate automatically if you breach any of its
terms. Upon termination, you must cease all use of the Software and destroy or
uninstall all copies in your possession or control. Sections that by their nature
should survive termination (including Sections 1.2–1.4, 2, 3, 4, 6, 8, and 10) will
survive.

6. DATA COLLECTION AND PRIVACY
------------------------------------------------------------------------------
6.1 Local data. The Software stores gameplay data, settings, and statistics locally
on your device.
6.2 Optional Feedback and Community Polls. The Software includes optional features —
in-app Feedback submission and Community Polls — that transmit data to
songcreatorvision.com. These features are off by default and prompt for your consent
the first time you use them. When you choose to use them, they collect: (a) your
Steam ID; (b) your operating system; (c) the application version; (d) any free-text
content you submit; (e) your IP address; and (f) a timestamp.
6.3 Purpose. This data is used only for product improvement, bug diagnosis, and
feature prioritization. We do not sell or share this data, and we do not use it for
advertising.
6.4 Withdrawal and deletion. You may withdraw consent at any time in the Software's
Settings, which stops further transmission. You may request deletion of previously
submitted data by emailing kyle@songcreatorvision.com.
6.5 Privacy Policy. Our full Privacy Policy is available at
https://guitarsesh.com/privacy-policy and is incorporated into this Agreement by
reference. In the event of any conflict between this Section 6 and the Privacy
Policy regarding the handling of personal data, the Privacy Policy controls.

7. REFUNDS
------------------------------------------------------------------------------
The Software is sold through Steam. Refunds are handled solely in accordance with
Steam's then-current refund policy. This Section does not limit any non-waivable
statutory refund or withdrawal rights you may have under applicable consumer law.

8. GOVERNING LAW AND DISPUTE RESOLUTION
------------------------------------------------------------------------------
8.1 Informal resolution. Before bringing any formal claim, you agree to first
attempt to resolve the dispute informally by contacting kyle@songcreatorvision.com,
and to allow at least thirty (30) days for good-faith resolution.
8.2 Governing law and venue. This Agreement is governed by the laws of the State of
California, without regard to its conflict-of-laws rules, and the state and federal
courts located in Los Angeles County, California will have exclusive jurisdiction,
except as provided in Section 8.3.
8.3 Mandatory local consumer rights. If you are a consumer, nothing in this Section
deprives you of the protection of mandatory consumer-protection provisions of the
law of your country (or, in the EU/UK, your country of residence), including any
right you may have to bring proceedings in, or have the dispute governed by the law
of, your home jurisdiction.

9. ELIGIBILITY AND ACCEPTANCE

By installing or using the Software, you represent that you are at least the minimum
age required to consent to the processing of your personal data in your jurisdiction
(at least 13 years of age, or older where your jurisdiction requires a higher minimum
digital-consent age), or that you have the consent of a parent or legal guardian. The
Software is not directed to children under that minimum age, and we do not knowingly
collect personal data from them. If you do not meet these requirements, do not use
the Software.

10. GENERAL

10.1 Entire agreement. This Agreement, together with the referenced Privacy Policy,
the THIRD_PARTY_LICENSES/ notices, and the COPYING.*.txt files, constitutes the
entire agreement between you and Licensor regarding the Software and supersedes all
prior or contemporaneous understandings on that subject.
10.2 Severability. If any provision of this Agreement is held unenforceable, that
provision will be limited or severed to the minimum extent necessary, and the
remaining provisions will remain in full force and effect.
10.3 No waiver. Licensor's failure to enforce any provision is not a waiver of its
right to do so later.
10.4 Assignment. You may not assign or transfer this Agreement or your license
without Licensor's prior written consent. Licensor may assign this Agreement in
connection with a merger, acquisition, or sale of assets, or to an affiliate.
10.5 Relationship to third-party licenses. This is a proprietary EULA that co-exists
with the open-source licenses governing the third-party components described in
Section 4. Where an open-source license grants you rights that conflict with a
restriction in this Agreement, the open-source license controls for that component.
