End User License Agreement (EULA)
This End User License Agreement (“EULA”) is a legal agreement between you (“Licensee”) and Marcel Schmickerath (“Licensor”), operating under the name Schmiggi, for the video game “Light-Strucked”, developed using RPG Maker MV. By installing, copying, or otherwise using “Light-Strucked”, you agree to be bound by the terms of this EULA.
1. Grant of License
The Licensor grants the Licensee a non-exclusive, non-transferable, and revocable license to use “Light-Strucked” for personal and non-commercial purposes on supported devices. Any other use, especially commercial redistribution, is strictly prohibited.
2. Ownership and Rights
All copyrights, trademarks, and other intellectual property rights in “Light-Strucked” and its contents (including music, plugins, graphics, and scripts) remain the property of the Licensor or respective third-party providers. This license does not grant ownership of the content.
3. Restrictions
The Licensee is prohibited from: - decompiling, reverse engineering, or modifying the software, - renting, leasing, or selling the software, - using the software in critical systems, - extracting or redistributing individual resources (music, plugins, graphics) separately.
4. Third-Party Content
“Light-Strucked” includes various plugins and music tracks from third-party providers, each subject to their own license terms. The Licensee agrees to comply with these terms. A list of third-party resources is included in the game directory.
5. Disclaimer of Warranty
The software is provided "as is" without warranty of any kind, either express or implied. The Licensor shall not be liable for any direct or indirect damages, data loss, or lost profits resulting from the use or inability to use “Light-Strucked”.
6. Termination
This EULA is effective upon installation or use of the software and remains in effect until terminated. It will terminate automatically if the Licensee breaches any term of this agreement. Upon termination, all use must cease and all copies must be deleted.
7. Privacy
“Light-Strucked” does not collect any personal data without your explicit consent. For further details, refer to the separate privacy policy, if available.
8. Changes to the EULA
The Licensor reserves the right to update or modify this EULA at any time. Changes become effective upon publication. Continued use of the software constitutes acceptance of the revised EULA.
9. Governing Law
This agreement is governed by the laws of the Federal Republic of Germany. The place of jurisdiction, where legally permissible, is the Licensor’s place of business.
10. Severability
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
