END USER LICENSE AGREEMENT

This End User License Agreement (“EULA”) is a legal agreement between you and Ecomeum GmbH, Liniengasse 50-52, 1060 Vienna, Austria (“Ecomeum,” “we,” “us,” or “our”), regarding your use of the video game Dawn of Piracy: Caribbean Tides and any patches, updates, downloadable content, expansions, cosmetic add-ons, manuals, and related software or content that we make available for the game (collectively, the “Game”).
By downloading, installing, accessing, or using the Game, you agree to this EULA. If you do not agree, do not download, install, access, or use the Game.
If you obtain the Game through Steam, GOG, or another storefront or platform, your use of that storefront or platform is also subject to its own terms and policies. Refunds, billing, and platform-account matters are generally handled by the platform through which you purchased the Game, in addition to any mandatory statutory rights that may apply to you.
If you are a consumer, this EULA does not limit any mandatory rights you have under applicable law.
1. Eligibility
You may use the Game only if you have legal capacity to enter into this EULA under the law applicable to you.
If you are under the age at which you can independently enter into this EULA under applicable law, a parent or legal guardian must accept this EULA on your behalf. In that case, the parent or legal guardian enters into this EULA and is responsible for the minor’s compliance with it.
The Game is intended for audiences aged 16+.
2. License Grant
Subject to your compliance with this EULA, Ecomeum grants you a personal, limited, non-exclusive right to download, install, access, and use the Game for your private, non-commercial entertainment use on devices you own or control, in accordance with this EULA and any applicable platform rules.
When you purchase the Game, you obtain the right to keep and use your copy of the Game in accordance with this EULA and applicable law. This EULA does not transfer ownership of the Game’s intellectual property rights to you.
3. Ownership
The Game, including all software, code, audiovisual content, text, dialogue, characters, names, logos, designs, music, artwork, animations, worlds, and other content, and all intellectual property rights in and to them, are owned by Ecomeum and/or its licensors and are protected by applicable intellectual property and unfair competition laws.
All rights not expressly granted to you under this EULA are reserved.
4. Acceptable Use and Restrictions
You may not, except where expressly permitted by this EULA or by applicable law that cannot be excluded or limited:
a. copy, reproduce, distribute, sell, rent, lease, sublicense, publish, publicly perform, or otherwise exploit the Game except as expressly permitted;
b. use the Game for commercial purposes without our prior written consent;
c. remove, alter, conceal, or destroy proprietary notices in the Game;
d. use the Game in any unlawful manner or in any way that infringes the rights of Ecomeum, its licensors, or third parties;
e. reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Game, except to the extent such acts are expressly permitted by applicable law, including mandatory interoperability rights;
f. introduce malware, malicious code, or other harmful material into the Game or related distribution channels;
g. circumvent technical protection measures or security features, except to the extent such activity is expressly permitted by applicable law;
h. use the Game or its content to create, train, or improve datasets, machine-learning models, or automated systems for commercial exploitation of the Game’s content without our prior written permission.
For clarity, because the Game is currently single-player, this EULA does not prohibit your private single-player use of cheats, trainers, console commands, or mods, provided that doing so does not violate applicable law, third-party rights, platform security rules, or Section 4(f) or 4(g).
For clarity, Ecomeum does not use your UGC or Mods to train AI models, unless we clearly notify users in advance and have a lawful basis to do so where required by applicable law.
5. Mods and Fan-Made Modifications
We permit non-commercial mods for the Game, subject to this Section.
You may create and use mods, modifications, add-ons, and similar user-made content (“Mods”) for your own private or community use, provided that:
a. your Mods are lawful and do not infringe third-party rights;
b. your Mods do not include malware, spyware, or harmful code;
c. your Mods are not sold directly for a purchase price unless we expressly authorize this in writing;
d. your Mods do not misrepresent themselves as official Ecomeum content;
e. your Mods do not unlawfully use third-party intellectual property;
f. your Mods do not interfere with the normal operation, integrity, or security of the Game, Steam, GOG, or user devices; and
g. you comply with any modding guidelines we may publish in the future.
For clarity, Section 5(c) prohibits direct paid distribution of Mods unless we expressly approve it in writing. It does not automatically prohibit voluntary donations, creator-support pages, or similar indirect support, provided that the Mod itself remains freely available and all other parts of this EULA are respected. We may issue more specific monetization rules in the future.
We may, at any time and for legitimate reasons, limit, disable, or withdraw permission for specific Mods or categories of Mods, especially where reasonably necessary for legal, security, technical, or rights-clearance reasons.
You retain ownership of original content you create in your Mods. By distributing or making a Mod available for use with the Game or through our official community channels, you grant Ecomeum a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt as technically necessary, display, distribute, and make available that Mod solely for the purposes of operating, supporting, showcasing, and improving the Game and related community features. Where reasonably practicable, we will credit the creator when featuring a Mod in official community showcases.
6. User-Generated Content
The Game may allow certain user-generated content (“UGC”), such as save names, ship names, profile labels, screenshots, text entries, community submissions, or future community features.
You are responsible for your UGC. You represent that you have the necessary rights to create and share it and that it does not violate applicable law or third-party rights.
You retain ownership of your original UGC. However, by submitting, uploading, sharing, or otherwise making UGC available through the Game or official Game-related community channels operated by Ecomeum, you grant Ecomeum a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify as technically necessary, publish, display, distribute, and communicate that UGC solely for the purpose of operating, supporting, improving, and promoting the Game and related community activities.
We are not obliged to use, host, or maintain any UGC. We may remove or restrict UGC where reasonably necessary, including for legal, technical, rights-related, safety, or policy reasons.
7. Future Online Features
The Game is currently designed as a single-player game. If we later add online or cooperative features, additional rules may apply to those features, including rules on conduct, account suspension, abuse, harassment, impersonation, and unfair play. We may publish supplemental terms for such features if and when they are introduced.
8. Downloadable Content, Expansions, and Cosmetic Items
The Game may include optional paid or free downloadable content, expansions, or cosmetic items (“Additional Content”). Unless expressly stated otherwise, Additional Content forms part of the Game and is subject to this EULA.
Your purchase of Additional Content grants you the same limited license described in this EULA; it does not transfer ownership of the Additional Content to you.
Availability of specific Additional Content may vary by platform, region, language, and over time.
9. Updates, Conformity, and Changes
We may provide patches, updates, bug fixes, balancing changes, technical changes, and content adjustments for the Game. Some updates may be required for proper functioning of the Game on supported systems.
If you are a consumer, and to the extent required by applicable law, we will provide updates that are necessary to keep the Game in conformity for the period required by law, taking into account the nature and purpose of the Game and the circumstances of supply.
To the extent permitted by applicable law, we may modify or discontinue specific non-essential features of the Game for legitimate reasons, including technical necessity, legal requirements, security, licensing changes, prevention of abuse, or product improvement. If you are a consumer, this does not affect any mandatory statutory rights you may have in relation to conformity, remedies, or updates.
10. Support and Availability
We do not guarantee that the Game will always be available, error-free, uninterrupted, or compatible with every device, operating system, or hardware configuration.
However, if you are a consumer, nothing in this EULA excludes our obligation to provide the Game in conformity with mandatory applicable law.

11. Privacy
The Game is currently intended to operate without Ecomeum collecting gameplay telemetry, cookies, or analytics directly from within the Game.
However, personal data may still be processed in limited circumstances, for example:
• by Steam, GOG, or other platforms through which you purchase, download, install, or use the Game;
• when you contact us for support or legal inquiries;
• if you voluntarily submit UGC, emails, bug reports, or other communications to us; or
• if future online or community features are added.
Any platform-level data processing is governed by the relevant platform’s privacy documentation, not by this EULA.
Where Ecomeum itself processes personal data, we will do so in accordance with applicable data protection law. Privacy-related inquiries may be sent to: office@ecomeum.com
12. Term and Termination
This EULA starts when you first download, install, access, or use the Game, and continues until terminated.
You may terminate this EULA at any time by ceasing all use of the Game and deleting or uninstalling all copies of it in your possession or control.
We may terminate or suspend this EULA, or your access to any present or future Game-related services we operate, if you materially breach this EULA and, where appropriate, fail to remedy that breach within a reasonable time after notice from us. We may terminate immediately where the breach is serious, cannot reasonably be remedied, or where immediate action is reasonably necessary for legal, security, or safety reasons.
Upon termination, the license granted to you under this EULA ends, and you must stop using the Game. Sections that by their nature should survive termination will survive, including ownership, UGC/Mod licenses already granted, disclaimers, liability, governing law, and interpretation.
13. Refunds, Withdrawal Rights, and Consumer Rights
If you purchased the Game through Steam, GOG, or another platform, refund requests are generally handled by the platform through which you purchased the Game, in accordance with that platform’s then-current refund policy, in addition to any mandatory statutory rights that may apply.
If you are a consumer residing in the European Union or another jurisdiction with mandatory consumer protections, you may also have statutory rights in relation to the Game, including rights concerning conformity, remedies, and in some cases withdrawal from distance contracts.
Where the Game is supplied as digital content not on a tangible medium, your statutory right of withdrawal may, where permitted by applicable law, expire once supply has begun with your prior express consent and acknowledgment. If you purchase through a platform, the purchase flow and platform terms may govern how this is presented and handled.
Nothing in this EULA excludes, restricts, or limits any mandatory consumer rights that cannot lawfully be excluded or limited.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, and subject always to Section 13, the Game is provided on an “as is” and “as available” basis.
Except for statutory rights and remedies that cannot be excluded or limited, Ecomeum disclaims all warranties, representations, and conditions, whether express, implied, or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement.
Ecomeum does not warrant that the Game will be uninterrupted, error-free, secure, or free from bugs or harmful components, or that defects will always be corrected.
If you are a consumer, your mandatory statutory rights, including any applicable statutory warranty or conformity rights under applicable law, remain unaffected by this Section.
15. Limitation of Liability
Nothing in this EULA excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, intent, gross negligence where non-excludable, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, Ecomeum’s liability for damage caused by slight negligence is limited to foreseeable damage typical for this type of contract, except where a broader limitation is not permitted by law. Liability for intent and, where non-excludable, gross negligence remains unaffected.
Subject to the preceding paragraphs and to the maximum extent permitted by applicable law, Ecomeum shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, loss of revenue, loss of goodwill, loss of business opportunity, or loss of data, arising out of or related to your use of or inability to use the Game.
If you are not a consumer, Ecomeum’s total liability to you for claims arising out of or relating to this EULA or the Game shall not exceed the amount you actually paid for the Game or the specific Additional Content giving rise to the claim during the 12 months preceding the event giving rise to liability.
16. Unreal Engine / Epic Materials Disclaimer
The Game includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Ecomeum, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Ecomeum, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Game, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this Game, or will not revoke approval of this Game for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Ecomeum and Epic. Ecomeum, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph applies to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Ecomeum, Epic, Epic’s licensors, nor their affiliates, nor any of Ecomeum’s or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this EULA, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Ecomeum, Epic, Epic’s licensors, nor their affiliates, nor any of Ecomeum’s or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this EULA or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Ecomeum’s, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Ecomeum, Epic, or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Ecomeum, Epic, Epic’s licensors, their affiliates, and any of Ecomeum’s or Epic’s service providers shall be limited to the fullest extent permitted by law.
For the avoidance of doubt, if and to the extent this Section conflicts with non-excludable rights under applicable consumer law, those rights prevail.
17. Governing Law and Jurisdiction
This EULA and any non-contractual obligations arising out of or in connection with it shall be governed by the laws of Austria, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of the country in which you habitually reside that cannot be derogated from by agreement.
If you are a consumer, you may bring proceedings in the courts of the EU Member State in which you are domiciled or in the competent courts of Austria, and we may bring proceedings against you only in the courts of the EU Member State in which you are domiciled.
If you are not a consumer, the courts having subject-matter jurisdiction for Vienna, Austria shall have exclusive jurisdiction, to the extent permitted by law.
18. Consumer ADR Information
Ecomeum is not obliged, and is not generally willing, to participate in dispute resolution proceedings before a consumer arbitration body. If a dispute with a consumer cannot be resolved directly, we will provide information on any competent alternative dispute resolution body and whether we will participate, to the extent required by applicable law.
The former EU Online Dispute Resolution platform has been discontinued.
19. Severability
If any provision of this EULA is held to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The affected provision shall be interpreted, where possible, in a way that most closely reflects its intended purpose while remaining valid and enforceable.
20. No Waiver
If we do not enforce a provision of this EULA, that will not be considered a waiver of that provision or of our right to enforce it later.
21. Entire Agreement
This EULA constitutes the entire agreement between you and Ecomeum concerning the Game, except for:
a. applicable platform terms governing your use of Steam, GOG, or other storefronts or services; and
b. any additional terms expressly provided for specific features, DLC, expansions, or future online services.

We may terminate or suspend this EULA, or your access to any present or future Game-related services we operate, if you materially breach this EULA and, where appropriate, fail to remedy that breach within a reasonable time after notice from us. We may terminate immediately where the breach is serious, cannot reasonably be remedied, or where immediate action is reasonably necessary for legal, security, or safety reasons.
Upon termination, the license granted to you under this EULA ends, and you must stop using the Game. Sections that by their nature should survive termination will survive, including ownership, UGC/Mod licenses already granted, disclaimers, liability, governing law, and interpretation.
13. Refunds, Withdrawal Rights, and Consumer Rights
If you purchased the Game through Steam, GOG, or another platform, refund requests are generally handled by the platform through which you purchased the Game, in accordance with that platform’s then-current refund policy, in addition to any mandatory statutory rights that may apply.
If you are a consumer residing in the European Union or another jurisdiction with mandatory consumer protections, you may also have statutory rights in relation to the Game, including rights concerning conformity, remedies, and in some cases withdrawal from distance contracts.
Where the Game is supplied as digital content not on a tangible medium, your statutory right of withdrawal may, where permitted by applicable law, expire once supply has begun with your prior express consent and acknowledgment. If you purchase through a platform, the purchase flow and platform terms may govern how this is presented and handled.
Nothing in this EULA excludes, restricts, or limits any mandatory consumer rights that cannot lawfully be excluded or limited.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, and subject always to Section 13, the Game is provided on an “as is” and “as available” basis.
Except for statutory rights and remedies that cannot be excluded or limited, Ecomeum disclaims all warranties, representations, and conditions, whether express, implied, or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement.
Ecomeum does not warrant that the Game will be uninterrupted, error-free, secure, or free from bugs or harmful components, or that defects will always be corrected.
If you are a consumer, your mandatory statutory rights, including any applicable statutory warranty or conformity rights under applicable law, remain unaffected by this Section.
15. Limitation of Liability
Nothing in this EULA excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, intent, gross negligence where non-excludable, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, Ecomeum’s liability for damage caused by slight negligence is limited to foreseeable damage typical for this type of contract, except where a broader limitation is not permitted by law. Liability for intent and, where non-excludable, gross negligence remains unaffected.
Subject to the preceding paragraphs and to the maximum extent permitted by applicable law, Ecomeum shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, loss of revenue, loss of goodwill, loss of business opportunity, or loss of data, arising out of or related to your use of or inability to use the Game.
If you are not a consumer, Ecomeum’s total liability to you for claims arising out of or relating to this EULA or the Game shall not exceed the amount you actually paid for the Game or the specific Additional Content giving rise to the claim during the 12 months preceding the event giving rise to liability.
16. Unreal Engine / Epic Materials Disclaimer
The Game includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Ecomeum, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Epic Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Ecomeum, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in the Game, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve this Game, or will not revoke approval of this Game for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Ecomeum and Epic. Ecomeum, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph applies to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Ecomeum, Epic, Epic’s licensors, nor their affiliates, nor any of Ecomeum’s or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this EULA, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Ecomeum, Epic, Epic’s licensors, nor their affiliates, nor any of Ecomeum’s or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this EULA or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Ecomeum’s, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Ecomeum, Epic, or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Ecomeum, Epic, Epic’s licensors, their affiliates, and any of Ecomeum’s or Epic’s service providers shall be limited to the fullest extent permitted by law.
For the avoidance of doubt, if and to the extent this Section conflicts with non-excludable rights under applicable consumer law, those rights prevail.
17. Governing Law and Jurisdiction
This EULA and any non-contractual obligations arising out of or in connection with it shall be governed by the laws of Austria, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of the country in which you habitually reside that cannot be derogated from by agreement.
If you are a consumer, you may bring proceedings in the courts of the EU Member State in which you are domiciled or in the competent courts of Austria, and we may bring proceedings against you only in the courts of the EU Member State in which you are domiciled.
If you are not a consumer, the courts having subject-matter jurisdiction for Vienna, Austria shall have exclusive jurisdiction, to the extent permitted by law.
18. Consumer ADR Information
Ecomeum is not obliged, and is not generally willing, to participate in dispute resolution proceedings before a consumer arbitration body. If a dispute with a consumer cannot be resolved directly, we will provide information on any competent alternative dispute resolution body and whether we will participate, to the extent required by applicable law.
The former EU Online Dispute Resolution platform has been discontinued.
19. Severability
If any provision of this EULA is held to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The affected provision shall be interpreted, where possible, in a way that most closely reflects its intended purpose while remaining valid and enforceable.
20. No Waiver
If we do not enforce a provision of this EULA, that will not be considered a waiver of that provision or of our right to enforce it later.
21. Entire Agreement
This EULA constitutes the entire agreement between you and Ecomeum concerning the Game, except for:
a. applicable platform terms governing your use of Steam, GOG, or other storefronts or services; and
b. any additional terms expressly provided for specific features, DLC, expansions, or future online services.
