Milios Panagiotis – Nektarios, (address: 14, Kimolou street, Kipseli 11362 Athens Greece – e-mail: contact@noble-front.com) (“we”, “us”) have designed and developed NobleFront™ (“the Game”) which is made available to you (“User”,”You”, “Participant”, “Your”) through a Gaming Platform owned and run by a third party. The Game includes the Software, all accompanying material, files, electronic or on-line material and documentation and all copies thereof. The Game is licensed to you for personal use only, and not sold, under the present terms and conditions.
1.Application of Terms of Use and amendments
Under the terms and conditions of the present agreement you are granted a non -exclusive, limited, non – transferable and revocable license to use one copy of the Game for your personal, non-commercial use for game play on a Gaming Platform. Please read the present Terms and Conditions of Use (ToU). If you do not agree to all such terms and conditions, you are not permitted to make any use of the Game, to download, open, install, copy or make any other use thereof. By downloading, installing, using in any way, copying the Game and any and all material included therein, you agree to be bound by the present Terms and Conditions of Use.
These terms are published on the website of the Game and may be accessed at all times. The specific relevant Game Rules and Instructions, found once you download the Game, also apply to your use of the Game, but the ToU will always prevail in case there is a contradiction between them. The present ToU do not cover services provided by third parties, including the services provided by the Gaming Platform hosting the Game, through which the Game is made available to you. In order to have access to and use the Game you must first acknowledge the ToU by ticking the box “I accept the Terms and Conditions of Use” and then proceed with the log in button.
We reserve the right to amend the ToU with effect for the future and you will be notified for such change when you login in the Game, or through an in-game message, or by e-mail in the e-mail address you have registered. The continued use by you of the Game after being notified of the change in the ToU means you accept the new ToU and you are bound by them. If you do not agree with the amended ToU your only remedy is to cease using the Game.
In order to have access to the Game you are required to have and maintain a valid and active user account with the specific Gaming Platform that hosts the Game (Gaming Platform User Account). Such subscription is subject to the terms of use of the said Gaming Platform. The present ToU are considered additional and special terms to those of the Gaming Platform and constitute an end user license agreement specific to the particular Game. The Game may also require that you create a Game specific user account with us (User Account). You will be asked to provide an e-mail address at which you may be reached in relation to the present. You are responsible for the use and the security of your Gaming Platform Account and the User Account and for ensuring that no third parties have access to your passwords and codes.
2. End-user License and restrictions
You acknowledge, that as the Game is licensed and not sold to you, no ownership is being transferred or assigned to you under the present. The Game is intended for private use only.
This Game is protected by copyright and trademark laws and all applicable intellectual property laws and treaties around the world. We retain any and all right, title and interest to the Game, including, but not limited to all intellectual and industrial property rights, copyrights, trademarks, patents, design rights, trade secrets, trade names, know how, proprietary rights, computer codes, audiovisual effects, sounds effects, artwork, musical works, characters, character names, stories, dialog, settings, themes, titles, computer codes and moral rights and any work connected with the Game.
The Game may not be copied, reproduced, distributed in any manner or any medium, in whole or in part. Under the license granted to you, you are not allowed to exploit the Game commercially in any way, sell, transfer, assign, distribute, lease, license, rent the Game and any copies thereof, make a copy of the Game or any part thereof for any other reason than the permitted use, make a copy of the Game available for use or download by multiple users on a network or on-line, transfer reproductions of any part of the Game, copy, photocopy, reproduce, publish, translate, reverse-engineer, derive source code from, modify, decompile, disassemble, display, perform, create any derivative works based on the Game, or in any other way modify the Game, in whole or in part, or exploit the Game and any part thereof for any commercial purpose.
You are further not allowed to remove or modify any marks, labels embedded in the Game, as well as any proprietary notices, or circumvent any technical measures set to control access to the Game and prevent unauthorized copies thereof, and you are not allowed to restrict or hinder others from lawfully using the Game. You must also not violate the terms, licenses and policies connected with the Game, violate any laws and regulations in general, as well as the laws and regulations of the country where the Game has been accessed and is further used, as such laws and regulations are in force from time to time.
Violation of the above prohibitions may lead to serious civil, as well as criminal penalties. You agree to indemnify, defend and hold us (and any contractor acting on our behalf,) harmless form all damages, losses, and expenses arising directly or indirectly from your acts or omissions in using the Game that constitute breach of the present ToU.
3. Use of the Game
The Game is offered to users above thirteen (13) years of age. Persons under the age of 13 are not eligible to play the Game. Participation in the Game is for entertainment purposes only.
The license itself is granted by us free of charge, while the use of the Game is subject to charges as analyzed and listed in the respective price list. All purchases made and all charges incurred are initiated and concluded within and by the Gaming Platform hosting the Game. There are no separate or additional charges to be handled by us with regard to your use of the Game.
The Gaming Platform through which you access the Game is responsible for the user registration, subscription procedures, payment and billing procedures.
Therefore, we are not involved in any billing, payment or subscription processing, and the relevant terms set by the Gaming Platform, any charges associated with your account, the account balance associated with your account, any subscription cancellation, trading and transactions that may be permitted by the Gaming Platform between subscribers, the processing of any payment information provided by you to the Gaming Platform, any payment authorization provided by you to the Gaming Platform, and any claims related thereto, even if such refer to your participation in the Game, any refunds or the right of withdrawal, as all of the above are handled exclusively by the Gaming Platform. We will not receive any personal billing information you reveal at the Gaming Platform.
Users may have the opportunity to take part in chat discussions or direct dialogue with other participants. In all such uses, users are precluded from using any content which is pornographic, racist, offensive, promotes violence, or is otherwise illegal.
We reserve the right to monitor the use of the Game at any time. The Game may include measures to control access thereto or to prevent unauthorized use thereof in violation of the limited rights and the license granted hereunder. Such measures may include security technology and monitoring usage (time, date, access and related controls). You must not attempt to disable such security features or circumvent them or interfere with them in any other way.
The Game may at times be enhanced and updated for optimal gaming experience and access to such updates presupposes a valid license to use the Game itself.
If you provide any suggestions or any feedback regarding the Game to us, such content will be considered free of any proprietary rights and we will thus be entitled to use such suggestions or feedback in any way we deem fit, even by incorporation in the Game, without any obligation to you whatsoever, and you are not entitled to any compensation from us as a result of such modifications.
4. Disclaimers
You acknowledge that the Game, just like any other software, can never be completely free of defects. Defects which are attributed to external influences, or operating faults for which you are responsible or faults attributed to force majeure are excluded from any warranty.
We expressly disclaim to the maximum extent permitted by applicable law any warranty for the Game. The Game is compatible with a personal computer meeting the minimum system requirements, as these are set in the respective documentation. Due to variations in hardware, software, Internet connections, we do not warrant the performance of the Game on your specific computer or gaming unit.
The Game, the content thereof and the relevant information available in connection therewith, is provided on an “as is” basis and “as available” with all faults and without warranty of any kind, express or implied, including without limitation the warranty for merchantability, fitness for a particular purpose, and non - infringement. Furthermore, no warranty is provided with regard to non-interference with your enjoyment of the Game. We do not provide any warranty that the Game will meet your requirements, that the operation thereof and access thereto will be continuous, uninterrupted, error or virus free, secure, that the Game as software will be compatible with third party software or hardware or that any errors in the Game will be corrected. No advice provided by us, either oral or written, with regard to the Game may be considered a warranty.

We disclaim any and all liability resulting from or related to third party actions or omissions that impair or disrupt your connections to the Internet, any wireless services, or the use of the Game.
5.Limitation of liability
To the maximum extent permitted by the applicable law, we shall not be liable in any way for any loss or damage of any kind resulting from the use or the inability to use the Game, including but not limited to property damage, lost profit, loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses and to the extent permitted by law damages for personal injuries. In no event shall we be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, or any other damages arising out of or in any way connected with the Game and any information available in connection therewith, the possession, use, malfunction, or the delay or inability to use the Game, even in the event of our fault, tort (including negligence), strict liability, or breach of any warranty and even if we have been advised of the possibility of such damages. In no way shall our liability for all damages exceed the actual price paid by you for the use of the Game.
We do not assume any liability for third party websites that make direct or indirect reference to the Game. The providers of the relevant websites are responsible for such content.
6.Term and Termination
The term of the present license agreement (“The Term”) commences on the date you first accept the present ToU, install and first use the Game and ends on the termination of the agreement as provided below.
You may cease to use the Game at any time you choose. As provided in the agreement with the Gaming Platform the cessation to use the Game will not entitle you to any refund. The license may further be terminated by us at any time we cease to operate the Game and make it available, or in case of your breach of any terms of the present or in case your use of the Game involves or may involve improper or illegal activity, in which cases no refund will be granted. Upon the termination of the license agreement your rights to use the Game will be terminated immediately and you must cease all use of the Game. As a consequence, you must further destroy permanently any copies of the Game (software), accompanying documentation, associated materials and all of its component parts in your possession or control, including from any computer, gaming unit or other device on which it has been installed. The termination of the license agreement will not affect our rights and your obligations under the license agreement. Terms which by their content are meant to bind parties even after the expiration or termination of the agreement will survive such expiration or termination.
To the extent permitted by applicable law, we have the right to limit, suspend and also terminate the license granted hereunder and the access to the Game, and any related services, at any time for any reason and without prior notice.
We also have the right to cease the operation of the Game or certain features thereof, in which case prior notice will be given so that users may utilize any remaining balance.
7.Personal data processing
We respect your privacy when accessing the Game and comply with the applicable law regarding the protection of your privacy, including the General Data Protection Regulation (GDPR). You may find information regarding the processing of personal data (type, scope, purpose of collecting, processing and use of personal data) necessary for the performance of the Game and your rights in this respect, in the Privacy Policy.
8.Applicable law and jurisdiction
The present ToU and any agreement concluded under these ToU, as well as any claims arising therefrom, are subject to the laws of Greece with the exclusion of the rules on conflict of laws.
For any disputes and actions related to the subject matter of the present, and in case an attempt for the amicable resolution thereof has failed, the courts of Athens, Greece will have the sole and exclusive jurisdiction and venue.
9.Miscellaneous
In case any provision of the present ToU is held to be void, unlawful, or unenforceable for any reason, this shall not affect the validity or the enforceability of the remaining ToU.
