END USER LICENSE AGREEMENT (EULA)
IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THIS SOFTWARE.
This End User LICENSE Agreement ("Agreement") is a legal contract between you (the "User" or "Licensee") and Cruel Rose ("Licensor", "we", "us", or "our") governing your use of the video game Meaningless Suffering, including all software, data, assets, updates, and associated media (collectively, the "Game").
By installing, copying, or otherwise using the Game via Valve Corporation’s Steam platform, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Game.
1. License Grant
Licensor hereby grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and play one (1) copy of the Game on a compatible device solely for your personal, non-commercial entertainment purposes, subject to the Steam Subscriber Agreement and the terms herein.
2. Restrictions on Use
You agree not to, and will not permit any third party to:
Modify, reverse engineer, decompile, or disassemble the Game, except as permitted by applicable law.
Exploit the Game, or any of its parts, for any commercial purpose.
Distribute, rent, lease, sub-license, assign, or otherwise transfer copies of the Game to third parties.
Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Game.
3. Intellectual Property
All title, ownership rights, and intellectual property rights in and to the Game (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, and text) are owned exclusively by Cruel Rose or its licensors. The Game is protected by copyright laws and international treaties.
4. Disclaimer of Warranties
THE GAME IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
LICENSOR DOES NOT WARRANT THAT THE OPERATION OF THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER.
THIS INCLUDES, BUT IS NOT LIMITED TO:
PERSONAL INJURY, PHYSICAL OR PSYCHOLOGICAL HARM, EMOTIONAL DISTRESS, OR MENTAL ANXIESTIES ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE GAME, THE THEMES OR TEXT CONTAINED WITHIN THE GAME, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS AGREEMENT.
LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR COMPUTER FAILURE/MALFUNCTION.
THIS LIMITATION APPLIES EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM ARISES IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE. IN NO EVENT SHALL LICENSOR’S TOTAL LIABILITY EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE GAME.
6. Health and Safety Notice
The Game features themes that may be psychologically challenging, existential, or frustrating by design. By accepting this agreement, you acknowledge that you are voluntarily participating in this entertainment experience. If you experience emotional distress, anxiety, or find the themes detrimental to your well-being, you should cease playing immediately.
7. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from the Licensor if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Game and destroy all copies in your possession.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Antalya, Turkey.
9. Entire Agreement
This Agreement, together with the Steam Subscriber Agreement and Privacy Policy, constitutes the entire agreement between you and Licensor concerning the Game and supersedes all prior understandings.
