END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and NomadSoft LLC ("Company," "We," "Our," or "Us") for the use of the software application provided by NomadSoft LLC ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.
1. LICENSE GRANT
NomadSoft LLC grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software on a single device for personal, non-commercial use, in accordance with the terms of this Agreement.
2. RESTRICTIONS
You agree not to:
- Copy, modify, or distribute the Software or any part of it.
- Reverse engineer, decompile, or disassemble the Software, except to the extent permitted by applicable law.
- Rent, lease, lend, or sublicense the Software.
- Use the Software for any unlawful purpose or in violation of any applicable laws or regulations.
- Remove, alter, or obscure any proprietary notices on the Software.
3. INTELLECTUAL PROPERTY RIGHTS
The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all intellectual property rights, are and will remain the exclusive property of NomadSoft LLC. This Agreement does not grant you any ownership interest in the Software.
4. UPDATES
NomadSoft LLC may provide updates, patches, or new versions of the Software to enhance or improve it. This Agreement will apply to any updates provided by NomadSoft LLC unless the update is accompanied by a separate license, in which case the terms of that license will apply.
5. TERMINATION
This Agreement is effective until terminated. Your rights under this Agreement will automatically terminate without notice from NomadSoft LLC if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.
6. DISCLAIMER OF WARRANTIES
The Software is provided "AS IS," without warranty of any kind. To the maximum extent permitted by applicable law, NomadSoft LLC disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. NomadSoft does not warrant that the Software will meet your requirements, operate without interruption, or be error-free.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event shall NomadSoft LLC be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with the use or inability to use the Software, even if NomadSoft LLC has been advised of the possibility of such damages. NomadSoft LLC's total liability for any damages under this Agreement shall not exceed the amount you paid for the Software, if any.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless NomadSoft LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Software or your breach of this Agreement.
9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of The United States of America, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in The United States of America for the resolution of any disputes arising out of or related to this Agreement or the Software.
10. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and NomadSoft LLC regarding the use of the Software and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Software.
11. SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
12. WAIVER
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and NomadSoft LLC's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
13. DATA COLLECTION AND ERROR REPORTING
The Software uses a third-party service, Sentry (sentry.io), to automatically collect crash reports and diagnostic data when errors occur. This helps NomadSoft LLC identify and fix bugs to improve your experience.
The following data may be collected and transmitted to Sentry when an error occurs:
- Device type and operating system
- Software version
- Error details and stack traces
This data is used solely for debugging and quality improvement purposes. No personal gameplay data, account credentials, or chat content is collected by this service. Data is processed in accordance with Sentry's Privacy Policy, available at: https://sentry.io/privacy/
By agreeing to this EULA, you consent to this data collection. If you do not consent, do not install or use the Software.
