This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity, "You" or "Licensee") and Richard Drum (Ionforge Labs) ("Licensor" or "We") for the video game software product known as Arcane Assembly, including any associated media, printed materials, and "online" or electronic documentation (collectively, the "Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
Subject to your compliance with the terms and conditions of this EULA, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Software on a single computer or gaming device that you own or control for your personal, non-commercial entertainment use.
You agree not to, and not to permit any third party to, do any of the following:

• Exploit the Software or any of its parts commercially.
• Distribute, lease, license, sell, rent, or otherwise transfer or assign the Software, or any copies of the Software, without the express prior written consent of Licensor.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Software, except to the extent that this restriction is expressly prohibited by applicable law.
• Modify, translate, or create derivative works based on the Software.
• Remove, alter, or obscure any proprietary notices or labels on the Software.
• Use the Software in any way that is fraudulent, illegal, or that could harm Licensor, its service providers, or any other person.

All title, ownership rights, and intellectual property rights in and to the Software (including, but not limited to, any titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, and any related documentation) are owned by Licensor or its licensors. The Software is protected by the copyright laws of the United States, international copyright treaties, and other intellectual property laws. All rights not expressly granted to you through this EULA are reserved by Licensor.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR OR ITS AFFILIATES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Licensor if you fail to comply with any of its terms and conditions. Upon termination of this EULA, you shall cease all use of the Software and destroy all copies, full or partial, of the Software. Sections 2, 3, 4, 5, 7, and 8 will survive any termination.
This EULA will be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from, or related to, this EULA shall be subject to the exclusive jurisdiction of the state and federal courts located in Collin County, Texas.

• Entire Agreement: This EULA constitutes the entire agreement between you and Licensor with respect to the Software and supersedes all prior or contemporaneous understandings, whether written or oral.
• Severability: If any provision of this EULA is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
