END USER LICENSE FOR COMPUTER {DESCENT} SOFTWARE.

Carefully read this document before installing the product in order to understand the license you are granted. The “Software” includes all Software included with this agreement, MANUALS, PACKAGING, ELECTRONICS, DOCUMENTATION, AND ALL COPIES OF THIS SOFTWARE. By installing and using this Software, you declare that you have read the Software Agreement License and you accept all it’s terms and conditions. This End User License Agreement (the “Agreement”) is a binding Agreement between you (“End User”,“you” or “your”) and Hubert Włosik (LICENSOR). The License Agreement is subject to Polish Law.
1. LICENSE. You (“End User”,“you” or “your”) are granted by LICENSOR to use one copy of this software on a single computer that is in possesion by You (“End User”,“you” or “your”). All ownership rights are kept and reserved by the LICENSOR. No ownership is being transferred or assigned in this Agreement. End User is not authorized to make any changes to the Software’s documentation without prior written consent.
2. OWNERSHIP. You (“End User”,“you” or “your”) are not permitted in any shape or form to sell, redistribute, publicly display or license this software without the prior written consent of the LICENSOR. You are not permitted to modify, replicate, reverse engineer this Software, copyrights, patents, trademark and other proprietary rights. LICENSOR reserves and carries all rights to the Software including, but not limited to, assets, music work and sounds, story, characters, copyright, trademarks, patents, graphics, concepts. The User hereby accepts that they have no rights to the Software, except for the rights under this Agreement.
3. TERMS.
(a) All the custom assets created by you are owned by the LICENSOR and you hereby assign and transfer all rights to LICENSOR and LICENSOR is permitted to use or modify custom assets for all purposes;
(b)You cannot permit third parties to use the Software or custom assets created by you for any commercial reasons, including, but not limited to selling, distributing, licensing;
(c) Custom assets must be distributed for free;
(d) Custom assets must not hold any defamatory, illegal, malicious, trademarked, copyright-protected content;
(e) All the rights to the Software are retained solely by the LICENSOR;
(f) Violation of EULA allows the LICENSOR to suspend your rights to use the Software;
(g) You carry full liability for your medical condition and psychological condition when using this Software;
4. CONDITIONS. You agree not to:
a) sell, distribute, publicly display, license or transfer this Software without prior written consent of LICENSOR;
(b) alter or modify, reverse engineer or replicate this Software, copyrights, patents, trademark and other proprietary rights;
(c) use or install this Software on more than one computer;
(d) promote any illegal, violent, or war related content by using this Software;
5. SOFTWARE
(a) This Software does not refer to any real events;
(b) This Software does not promote any illegal activities;
(c) All similarities of this Software with real events are accidental and unintentional;
6. LIMITATIONS ON LIABILITY
LICENSOR fully disclaims liability for any losses sustained by You (financial, informational and other) resulting from the use or inability to use this Software, even in the case of a prior mention of a possibility of those damages and in NO CASE shall LICENSOR be liable for DIRECT or INCIDENTAL damages. LICENSOR does not promise a completely correct functioning of the Software in certain scenarios with regard to the Software and the documentation. LICENSOR does not promise a full compatibility with other Software chosen by you. The responsibility for choosing and using the Software will always be held by the End User.
7. DISCLAIMERS
(a) Any rights or ownership not stated or clearly expressed by LICENSOR in this agreement are reserved by the LICENSOR and LICENSOR ONLY.
(b) LICENSOR may find it necessary to make an update to the Software, which might change, balance or reset certain parameters. Such updates may affect your progress in the Software and possibly cause not intentional setbacks. LICENSOR is not liable for such setbacks and reserves the right to make updates.
(c) You hereby declare that You (“End User”,“you” or “your”) have read this agreement, you understand all it’s terms, and you accept all the conditions. You agree that this End User License Agreement (the “Agreement”) is a binding agreement between you (“End User”,“you” or “your”) and Hubert Włosik (LICENSOR).
