End User License Agreement (EULA)
for “Ponchyo: A Platypus Adventure”
IMPORTANT: Please read this agreement carefully before installing or using the game. By installing, copying, or using "Ponchyo: A Platypus Adventure", you agree to the terms of this End User License Agreement (EULA). If you do not agree to these terms, do not install or use the game.
1. License Grant
The developer ("Licensor") grants you ("Licensee") a personal, non-exclusive, non-transferable, and revocable license to install and use one copy of "Ponchyo: A Platypus Adventure" on your own devices for private, non-commercial use—except where otherwise permitted (see Section 9).
2. Ownership and Intellectual Property
All rights, title, and interest in and to the game and its content (including but not limited to graphics, audio, code, artwork, and design) remain the sole property of the Licensor. This license does not transfer any ownership or intellectual property rights to the user.
3. Restrictions
You may not:
reverse engineer, decompile, or disassemble the game;
modify, translate, or create derivative works of the game;
resell, rent, lease, sublicense, or otherwise distribute the game;
use the game in any way that violates applicable laws or this EULA.
4. Installation and Updates
The game may receive updates or patches at the discretion of the Licensor. All updates are subject to this EULA. The Licensor is not obligated to provide future updates or maintain compatibility with specific systems or platforms.
5. User-Generated Content
If the game enables the creation or uploading of custom content, you retain ownership of your creations. However, you grant the Licensor a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content as part of the game or in promotional materials.
6. Disclaimer of Warranty
The game is provided "as is" without warranty of any kind. The Licensor makes no guarantees that the game will be error-free or uninterrupted, and shall not be held liable for any damages resulting from the use or inability to use the game, to the extent permitted by law.
7. Termination
This license is effective until terminated. It will terminate automatically without notice if you breach any term of this agreement. Upon termination, you must delete all copies of the game from your devices.
8. Governing Law
This EULA shall be governed by the laws of the country where the Licensor is located, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction lies with the courts at the Licensor’s place of business, if legally permissible.
9. Let’s Plays, Streaming & Fan Content
The Licensor explicitly allows the creation, publishing, and monetization of Let’s Plays, gameplay videos, streams, reviews, and similar content on platforms such as YouTube, Twitch, and others, under the following conditions:
Monetization via ads, tips, or donations is permitted.
Content must not be misleading, offensive, discriminatory, or in violation of any law.
You must clearly state that your content is unofficial (e.g., "fan video" or "unofficial Let’s Play").
You may not sell, repackage, or claim the game or its assets as your own (e.g., no unofficial merchandise).
This permission may be revoked in cases of abuse or significant breach of these terms.
10. Miscellaneous
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Changes or amendments to this agreement must be made in writing.
