END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and DIOM GAMES Sp. z o.o., a company registered in Poland with its principal office at ul. Stanisławowska 47, 54-611 Wrocław, Poland ("Licensor", "we", "us", or "our"), regarding your use of the video game titled Whisperborn: Child of the Forest ("Game").
By installing, copying, accessing, or otherwise using the Game, you agree to be bound by the terms of this Agreement and by our Privacy Policy.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Game on a compatible device that you own or control for your personal, non-commercial entertainment use, subject to the terms of this Agreement.
2. Ownership
The Game is licensed, not sold. All rights, title, and interest in and to the Game, including but not limited to copyrights, trademarks, and other intellectual property rights, are and shall remain the property of DIOM GAMES Sp. z o.o. or its licensors.

The Game includes cooperative multiplayer functionality for up to four players via Steam services. Player progress may be stored using Steam Cloud. An internet connection and a valid Steam account are required for access to these features.
5. Third-Party Software
The Game was developed using Unity and may contain components licensed by third parties. By using the Game, you also agree to be bound by any applicable third-party terms.
6. Refund Policy
No refunds will be issued for the Game except as provided by Steam's refund policy. All purchases are final and governed by the Steam Subscriber Agreement.
7. Children and Age Restrictions
The Game is rated PEGI 12 and is not intended for children under the age of 12. By using the Game, you affirm that you are at least 12 years old, or have obtained consent from a parent or legal guardian if you are under the age of majority in your jurisdiction.
8. Privacy Policy
By using the Game, you acknowledge and accept the terms of our Privacy Policy [https://diom.games/privacy-policy/], which explains how we collect, use, and protect your data.
9. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use and delete all copies of the Game.
10. No Warranty
The Game is provided "as is" without warranty of any kind. We do not warrant that the Game will be error-free or operate without interruption.
11. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall DIOM GAMES Sp. z o.o. be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Game.
12. Governing Law
This Agreement is governed by the laws of Poland. Any disputes shall be resolved by the competent courts located in Wrocław, Poland.

- Remove or obscure any copyright or proprietary notices from the Game;
- Attempt to circumvent any technical protection measures incorporated in the Game.
