These Terms and Conditions regulate the download, access, and use of the mobile application Master of Cladia (hereinafter the "APPLICATION") that BACKGRID makes available to users. The user acquires this condition with the download and use of the same. This version of the APPLICATION is available for free on Google Play and Apple Store. The user acknowledges and agrees to comply with all applicable terms and conditions regarding obtaining, downloading, and updating the APPLICATION as determined by these stores respectively. Access to the APPLICATION means that the user acknowledges having accepted and consented without reservation to these terms of use.
For registered users:All the functionalities of the video game.
For the game to be played normally, the user must ACCEPT that the following data is stored on their device:
1. OBJECTIVE
The APPLICATION aims to play a turn-based strategy video game set in a fantasy world. Some of the groups that can benefit from this project are all types of adults who enjoy strategy games. Professionals and a group of users who participated in the testing period were involved in the design and development of this APPLICATION. The APPLICATION is made available to users for personal use (never business use). It works on a mobile phone with an Android or IOS operating system.2. FUNCTIONALITIES
For anonymous users:None. Registration is required.For registered users:All the functionalities of the video game.
For the game to be played normally, the user must ACCEPT that the following data is stored on their device:
- Game preferences are stored in a configuration file in the default area provided by Android/iPhone.
- Access data is also stored in this default space.
- Other data stored as local files include:
- Saved games: Information that allows a user to CONTINUE the game.
- Multiplayer games: A user can participate in multiplayer games and must DOWNLOAD the game from the multiplayer server to make their moves for that turn. Additionally, there is data stored on the Master of Cladia multiplayer game server. This data includes:
- Registration data provided by the user at the time of registration.
- Game data in which the user participates: Each user's turn movements must be sent to the multiplayer server to generate the turn's result (which the server executes when it receives all players' moves).
- Game statistics: dragons born, players eliminated, average turns played, turn frequency, games won, games lost, etc. These statistics may or may not be published on the game's/company's website at the manufacturer's discretion. All the data movements described above must be performed by user interaction. The user will decide to:
- PARTICIPATE in a game: They can view the list of games and "join" the one they want to participate in.
- View the turn of the game they participate in (and therefore download the game to their device).
- Make MOVEMENTS in the game they participate in and therefore SEND the data of their moves/actions in the games to the MULTIPLAYER server.
- Create/save saved games of "single-player" or "multiplayer" games in which they participate. Some data must be sent to the server without user interaction:
- Connect to the MULTIPLAYER SERVER to see which version of the APP they have. If it is OLD, it will prevent them from playing NEW multiplayer games. In MULTIPLAYER, all participating devices must have the SAME VERSION.
- Verify game information:
- Open games
- Pending turns/moves to be sent Finally, the APP will send NOTIFICATIONS exclusively related to the games the player has decided to participate in. These notifications are solely to allow the user to make their moves comfortably. The notifications are:
- There is a new turn available for game X.
- You are the last to compile. Send your turn as soon as possible.
- You have been eliminated from game X.
- You have won game X. Congratulations! If the user wants to DELETE their account data, they will have an "Unsubscribe" button within the options menu, which will delete their account from the multiplayer server of the video game. If the user wants to remove any of the permissions indicated in this document, they must UNINSTALL the video game as the permissions indicated in this document are necessary for the correct operation of the video game. The interested party has the right to withdraw their consent at any time. The withdrawal of consent does not affect the legality of the processing based on the consent prior to its withdrawal. Before giving consent, the interested party will be informed of this. It will be as easy to withdraw consent as to give it.
- Being necessary for the contractual relationship of which you are a part, which implies the acceptance of these terms and conditions of use (Art. 6.1.b GDPR).
- Your consent given for one or more specific purposes (Article 6.1.a GDPR) by filling out any of the forms and/or contact methods that we make available to you in this APPLICATION and checking the box provided for this purpose.
- Our legitimate interest in responding to your requests or inquiries made through any of the forms and/or contact methods we provide in the APPLICATION (Article 6.1.f GDPR). How long will we keep your personal data?We will keep your personal data no longer than necessary to maintain the purpose of the treatment, that is, as long as the contractual relationship object of the use of the APPLICATION lasts (including the obligation to keep them for the applicable prescription periods) and when they are no longer necessary for such purpose, they will be deleted with appropriate security measures to ensure their anonymization or total destruction.To whom do we provide your personal data?Your personal data will be communicated to:
- Public Administrations and other private entities to comply with legal obligations that BACKGRID is subject to due to its activities.
- Suppliers who need to access the user's personal data to provide the services that BACKGRID has contracted with them or who, due to the functioning of electronic services (application, website, and emails), may have access to certain personal data. BACKGRID has signed confidentiality and data processing agreements with all of them, as required by regulations to protect your privacy (Article 28.3 GDPR).
- The registration and control of user sessions is done through BACKGRID's own platform, which provides a virtual cloud server managed exclusively by BACKGRID for the management of MULTIPLAYER games. Registering on this server is MANDATORY to play the video game. The APPLICATION will use Google Analytics and Unity Analytics as tools to understand the use and interaction trends. BACKGRID may use the personal information you provide in a dissociated manner (without personal identification) for internal purposes, such as compiling statistics, especially to improve the user experience of the video game.The APPLICATION may collect, store, or accumulate certain non-personal information regarding its use. Google Analytics is governed by Google's general terms and conditions accessible at http://www.google.com/analytics/terms/us.html and Google's privacy policies accessible at https://www.google.com/intl/en/policies/privacy/.Additionally, our game uses Unity Analytics to collect data about your use of the game to improve the user experience. Unity Analytics may collect information about your device, such as the model, operating system, and IP address, as well as data about how you interact with the game. This data helps us identify problems, improve game performance, and better understand player preferences. The information collected is handled in accordance with Unity's privacy policy available at https://unity.com/legal/privacy-policy.By using our game, you accept the collection and use of your data in accordance with this policy. 3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The intellectual and industrial property rights over the APPLICATION are owned by BACKGRID RESPONSIVE TECHNOLOGIES SL (hereinafter BACKGRID), holding the exclusive rights to exploit them in any form, especially the rights of reproduction, distribution, public communication, and transformation. Third parties holding intellectual and industrial property rights over photographs, logos, and any other symbols or content included in the APPLICATION have granted the corresponding authorizations for their reproduction, distribution, and public availability. The user acknowledges that the reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques, or any other means to obtain the source code, transformation, or publication of any unauthorized reference results of any of the elements and utilities integrated within the development constitutes an infringement of BACKGRID's intellectual property rights, thereby obligating not to perform any of the mentioned actions.4. Users, by checking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the forms of the APPLICATION, expressly and freely and unequivocally accept that their personal data is necessary for the provider to fulfill their request, with the inclusion of data in the remaining fields being voluntary. The user guarantees that the personal data provided to BACKGRID is true and is responsible for communicating any changes to them. BACKGRID informs that all data requested through the APPLICATION is mandatory as it is necessary to provide an optimal service to the User. If not all data is provided, it is not guaranteed that the information and services provided will be fully adjusted to your needs.7. SECURITY MEASURES
In accordance with current regulations on personal data protection, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD for the processing of personal data under its responsibility and manifestly with the principles described in Article 5 of the GDPR, whereby they are processed lawfully, fairly, and transparently concerning the data subject and are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed. BACKGRID guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD to protect the rights and freedoms of users and has provided them with the necessary information to exercise them. All information transfer that the APPLICATION performs with cloud servers (own or third-party) is carried out in an encrypted and secure manner through a secure hypertext transfer protocol (HTTPS), ensuring that the information cannot be intercepted. The information transfer is done through a custom-developed API by BACKGRID in API REST technology, respecting all the best practices used in the EU for its development. The virtual cloud servers used as servers for multiplayer games comply with the EU security standard ISO 27001. BACKGRID reserves the right to edit, update, modify, suspend, delete, or terminate the services offered by the APPLICATION, including all or part of its content, without prior notice, as well as to modify the form or type of access to it. The possible reasons for modification may include adaptation to legislative changes, changes in the APPLICATION itself, or those derived from existing codes of conduct in the field or for strategic or corporate reasons. BACKGRID is not responsible for the use of the APPLICATION by a minor, with the download and use of the APPLICATION being the sole responsibility of the user. The APPLICATION is provided "as is" and without any warranty. BACKGRID is not responsible for the final quality of the APPLICATION or for it serving and meeting all the objectives of the same. Nevertheless, BACKGRID commits to contribute to improving the quality of the APPLICATION as far as possible but cannot guarantee the accuracy or timeliness of its content. The responsibility for using the APPLICATION lies solely with the user. Except as established in these Terms and Conditions, BACKGRID is not responsible for any loss or damage arising from downloading or using the APPLICATION, such as those caused by failures, malfunctions, or blocks in the operation of the APPLICATION (for example, and without limitation: communication line errors, defects in the APPLICATION hardware or software, or Internet network failures). Similarly, BACKGRID is not responsible for damage caused by improper or inappropriate use of the APPLICATION by users.9. LEGISLATION AND JURISDICTION
The user accepts that the applicable legislation and competent courts to know the divergences derived from the interpretation or application of this clause are Spanish and submits, with express waiver of any other jurisdiction, to the courts and tribunals closest to the city of SANTA CRUZ DE TENERIFE.
